Did the Baliffs enter your property. Were they county court baliffs ? Is this a consumer regulated debt under the consumer credit act 1974. ?

This Is my Opinion Andyorch, Asset collections and investigations are not the owners or debt buyers of these Alleged Debts. In Fact one would go so far as to suggest that they are of the same company.. 1) Any Debt buyer would register in their own name and would show such on an individuals credit file. ( in my case my so called debt was purchased by this company 4 years ago) 2) They would not provide different Assignment dates on letters of assignment. 3) They would not shy from any court hearings when challenged on issues 1 &2 .

Look You need to put Asset Collection and Investigation to Strict Proof that they Actually own the alleged debt by Transfer. You need to see or be in receipt of a copy of the Deed of assignment and you need to re-enforce this in your Defence. A letter of assignment is just that. A letter. Its not proof that it has been properly Assigned. I have been through 2 claims with the company for the same, each time I have raised the issue in my defence they have backed of from providing a full deed and the claim has not progressed. In two of the claims I have asked A.C.I to prove that they own the Debt in question, and twice they have failed to do so... In the Two claims they have made they have Provided 4 different assignments with at least 3 different dates between so called asignments. and lots of emails quoting their clients...... Well either they own the debt or they are managing on behalf of lending stream. They can not be both. Do you have an assignment from ACI back to lending stream ? I suspect the Answer is no.. ... Why.... .. Because it was not legally Assigned in the first place ???? Hence Asset Collections have no legal court claim

Firstly if a new consumer unit has been installed Then there should be an E.I.C not an E.I.C.R. Secondly the new consumer unit is classed as Notifiable work under part P of the building regulations and recorded with the local Authority building control, unless its been fitted by a mate of a mate or a man down the pub. Instead of running around in circles I would suggest that you do a google search on Planning and building control in the area you live, usually planning portal type your address in the search for building control and it will list the Notifiable works that have been complied with ie notification of works to building control. If non are there then I would suspect that the work has been carried out by a non CPS member which is against Part P. On to the issue that might be causing the problem... I would suggest that the issue lies with the hob... And I would bet on that it is a solid steel ring hob these ave caught many electricians out in the past when changing consumer units has they have their inherant faults when swaping from rewireable fuses to modern RCD MCBs The Next point is who owns the oven/hob If the landlord then they have a duty under the E.W.R 1989 electricity at work regulations..... To ensure that they are fit , proper and safe. Don't be fooled by the at work bit... This applies to rented Accomodation as that is designated as their work. HTH -

As I understand it A Default notice must not misstate the arrears and by adding charges to the amount does just that.. Unlike overdraft and bank charges which are deemed a fee for a service, loans credit card charges are not a fee for a service and are assessible for fairness under UTCCR. -

I would also take a look at page 8 of the pdf Fixed sum lending agreement £8 default charge for arrears Not back in 2013 it wasnt It was £10 They may charge £8 now which gives rise to my suspicion that the agreement provided is not original or even properly reconstructed.
