Hi FC,

part of the reason that i do not use the penalty charge arguement, is that it requires that you establish that the charge is a penalty first, which would require a greater arguement and reliance upon case & common law. whereas, the defences i post for users i try to keep simple,and as long as they have a strong defence i leave it at that, after all we must not forget that it is the OP and not me that will be in the court arguing their case so i try to keep it simple
