  1. Thank you for your reply. I have rang the court and the clerk explained that they have received a letter from Abbey saying that they have settled but if I wasn't satisfied, that I should attend the hearing. I've explained that even the cheque did not clear yet, I had no reason to believe it would not. She then said, that she could not offer any legal advise and that it was up to me. What I do not want to do, is waste the Judge's time and with so little time left if which to act, I am really unsure at what to do. Sending a letter to the court now, maybe to late.
  2. I am due in court tomorrow morning. Abbey had offered a full settlement, they sent the cheque very late and as of today, it hasn't cleared yet. What do I do? Attend the court case and explain or go down today and say that I have received a settlement but the cheque is yet to clear?

    It's not true. They will have to disclose in court the true costs of their charges and they will not do this.
  4. I'm claiming contractual to but still at preliminary stage.

Today, I completed my pre-liminary letter for 1,022.00 + Contractual interest@ 26.845% (540.30) which equals £1562.30 All helps to reading this website, otherwise I would have never known any different. I expect them to play games, since that is the kind of treatment I have been receiving from them as customer. Will report back in 14 days. Fingers crossed
