  1. Don't worry about it, they submitted a defence to my money claim too! They've just paid me out including court costs, Stat Int and charges. My claim was acknowledged 15th May and I got a letter from them today dated 25th May settling in full! My only problem now is they've paid part of my money into an account that has be closed! So I've told them that I need it by chaps transfer today, otherwise the claim hasn't been settled, they doing it as I type!!!! Just sit tight, you will get your money. Tink2
  2. What defence have they got? They haven't actually got that far yet as far as I can make out. I'll let you know when and if we get that far! If it's anything like our Nationwide claim, they say they'll defend. They then give their defence as 'the claim has been paid', and miraculously the money appears in your account! All you then need to do is email moneyclaim (or contact your local Court if you went that route) and let them know that it's been settled, (once the monies have cleared), No problems!! Don't let them bamboozle you.
  3. This seems to be standard practice for smile now. Keep to your timetable, 14 days, etc! We've just filed with moneyclaim against them!

    Caro, how long ago did you claim against Smile? They have been absolutely terrible for me! I would understand if I was claiming back a massive amount, but I'm not!

    When will your 'eight weeks' be up? If it's only a couple of weeks after your LBA, and in view of your current circumstances, I agree with Caro, and wait until they're up.

    Just had the usual 'we'll respond as per guidelines, etc., etc,' to my LBA too, yeah right! Has your overdraft been taken away too and your cards cancelled? Mine have this week. I wouldn't mind but they never bothered to tell me? I happened to log on and wondered why my overdraft limit showed £0.00! My card also got swallowed by the cashpoint that morning! So had to transfer wages quick to my other account! They haven't responded to my message of Sunday(22nd April) when I asked why they hadn't written to me and given me notice, guess what I get this morning - yep, a letter telling me about my overdraft and cards, and that my authorised overdraft is now an unauthorised one, and they want to know what my proposals are for clearing it! (By the way, although the letter was sent by them 1st class. it was dated 18th April!) I've sent back saying my proposal is SIMPLE - PAY ME BACK MY UNLAWFUL CHARGES PLUS INTEREST!!! I wonder what sort of reply I'll get!!!! Give me another round with Nationwide anyday!!!

    Stick to your timetable. Smile have changed tack by the look of some previous threads, I take it their using the FSA eight week rules as THEY have deemed the issue as a complaint. Having successfully claimed twice against Nationwide, the way Smile are acting with my current claim is infuriating. We're getting the same delaying tactics. I'm keeping to my timetable and have told them that. LBA sent today, time limit up 3rd May, then Court.
  9. Hey guess what! :o This week I received a letter from the Nationwide regarding the final closure of my account. It said, words to the affect of, ' We have reviewed our decision to close you account, and have decided that in an effort to 'save our banking relationship' we will NOT now be closing your account. But please be a very good person and keep to the rules and regs and don't cause us any more trouble, blah, blah, blah' Laugh! you could have knocked me down with a feather!!!
  10. Hi Paul, that's an acknowledgement you've received. NW have 28 days to submit their defence. I've made two claims from them now, and they usually pay up around 10-15 days after the acknowledgement date. Their defence with mine was that they had paid all the monies due! The date on their defence was the same as the date of the last payment to my account. So don't worry you'll soon see the money roll in! Tink2

Just had a letter in the post today from Mr Huntley saying that further to my correspondence with Charles Bacon, (funny the only correspondence with him was the MCOL summons!), Mr Huntley has refunded the charges claimed, interest and Court fee and Pending charges!!! I don't believe it! I'm rich! (£3842.87 in total). Thank you CAG members for giving me the confidence to take on Nationwide! NOW, let's move onto my next victim................. .......................
  13. Go for it. They take a bit of time though, we filed on the 16th Jan, acknowledged on the 19th Jan, money started coming in on the 25th Jan. We've only had the interest and Court fee back yet, so fingers crossed! If not we'll carry on with the court proceedings. I'd love to send the bailliffs into Mr Bacon's office!!!!!
  14. There should be a LOT more to come yet. Reading the previous posts it seems that Nationwide can only afford to pay in installments. They start off with the interest and MCOL charge, then it appears that the rest drips in! I suppose they've got to cover the cost of the merger with the Portman!! Anyhow, I'll keep this updated, and they probably will close the account, but I haven't had anything yet to say that they will!
  15. Well well well!! There has been a cash deposit on our Nationwide account!!! Guess what it's for EXACTLY the same amount as the MCOL fee and the interest!!! Mmmmmmmmm coool!
  16. Just received acknowledgement of service. Charles Bacon intends to defend whole claim, now have to wait 28 days, (Acknowledgement dated 190107), I take it it'll be 28 days from the 190107? (i.e., til 160207?). This is just the next stage in the 'dance' isn't it? (Bit of reasurrance needed please!!).
  17. Apparently they do close your account after paying out. But ask yourself if they are ripping you off, why stay loyal to them? It's your money after all! It's a totally personal decision, but they were our main account and we just had enough of it and changed.
  18. That was your basic 'foboff' letter. If that was your prelim letter, the next stage is LBA, templates on website. You'll probably get the same reply to that too, we did, give them 14 days after LBA then file your claim. Nationwide, it appears, don't usually pay out until you take them to Court. Read the other threads, they do actually 'empower' you. There's loads of help on this site, you just need to read loads!!! Good luck.
  19. Just going through the process with Nationwide. Currently at MCOL stage, with claim acknowledged. This site has given us the confidence to take them on. MTM is right when he says it's our money!! This is the most fun I've had in ages! (Really bad year in 2006!!!) Thank you CAG. to Nationwide!
  20. Hi everyone, first time posting. This is an excellent site, and has given us the courage to take Nationwide to task. Currently at the MCOL stage with claim acknowledged, (after following all the previous advice on these pages), now 'bring it on' Nationwide!!!!!
