  1. Hi Michael, I'm not subject to an income order,it was very straight forward. however HSBC were included as a creditor and they did write off more than the charges are cheers Gary
  2. I dithered for nearly 2 years about what to do,being hassled all the time by creditors. I wish i had done it sooner. If the car is required for family purposes it is highly unlikely it will be sold. As i mentioned earlier,i was told by the official receiver that they would not of touched the car as it was only worth £3000 and was needed for work,but we sold it to pay the bankruptcy costs and bought a replacement car

My wife and i have recently been discharged from our Bankruptcy and i feel slightly aggreived that HSBC put us on the long slippery road 2 years ago by piling on charge after charge at a time when my wife was due with our 1st child, not working and we were unable to keep up with household bills let alone credit repayments. Has anybody that you know of ever tried to reclaim charges after a bankruptcy. This bank had over a £700 off me in 8 months,pleas for help went unanswered and was then systematically hounded for a year. Any advice would be helpful. Thanks in advance
  4. I worked for a 'no win no fee' company when shortfalls came to light a few years ago.Go to the Which consumer website and use the template letter for initial complaint. You have 3 years from the date of the 1st High risk(red letter) was recieved to complain.Do not let them fob you off.If they reject it go to the financial ombudsman. Prepare for the long haul anything up to a year. Thay want you to get fed up and go away. If an offer is made it will not reflect the shortfall your mother is facing, but will reflect the comparison made had she taken out a repayment mortgage instead over the same period of time. Her first priority is to make sure there are provisions for the mortgage to be repayed at the end of the term, Whether she changes to repayment or increases the premium on the endowment to make sure its covered. But why would you want to continue giving money to a company that has not looked after her interests. Good luck and hang in there

I went Bankrupt in May of this year and received my discharge last week.My wife an i had £47000 in unsecured debt,Usual story,wife had baby,stopped working living off one income, cannot meet minimum payments, Hammered by charges left,right and centre. No other option but to go bankrupt. We had looked at all options including iva, but if we missed payments on that we would still end up bankrupt. we had a 51 plate Ford Focus worth about 3000 which we sold and bought a cheaper car for a £1000.the money was used to pay for the court and official receiver costs. In my interview i was informed that they would of let us keep the car as it was of no significant value. All i say to you,if you have no assets and are honest with them you will have no bother.If you lie and try and hide things you may end up with a restriction order
