  1. So are you going to bother reclaiming charges as they will just go into your trust deed to be split up amongst your creditors?

I didnt know how it worked to be honest.

will maybe send away for statements to see how much i would be claiming first

  2. Got a letter fromTSB today.

I have already had statements and also sent away letter claiming for charges.

"Thanks you for getting in touch with us. I am sorry you are unhappy aboit your account charges".

It goes on to say about the charges they have for overdrawn and not having enough money to pay dd.

at the end of the letter it says

" I do hope you can see that we make our charging system as fair as possible - and why i can't agree to cancel charges.

If you have asked for a copy statements and paid the fee. We will send them to you within the 40 day limit set by the data protection act.

If you have not yet sent the £10 fee you will need to send it to us at the address below. the 40 day limit starts from when we receive your payment.

I hope this fully answers the points you raised with us. please let me know if there is anything else i can do to help. If we cannot come to an agreement, I will provide you with details of the FOS so they can consider your complaint independently.

If you are happy with the way I have dealt with our complaint there is no need for you to replay to my letter. If i have not heard from you by the 26 july 2007 I will close my file, though of course i will re-open it should you come back at any point afterwards."

do i send a letter saying i have already sent away 2 letters?

  3. Caz, can you confirm if you are talking about Clydesdale or another bank on this thread please

Can you confirm that a trust deed is to do with your debts being written off in Scotland? Also can I ask if the information regarding not claiming due to the trust deed came from someone on this site. It isn't something I know about, but I think it may be worth you sending a S.A.R - (Subject Access Request) for all your info from Clydesdale. If your charges were higher than the amount written off I think you could have a claim, but this needs much more investigation. I think it may depend on what was agreed with the trust deed.

im talking about tsb i sent letter to, i didnt know how to go about getting thread moved, sorry

originaly i was sending to clydesdale bank but was told by someone (not on this board ) not to as my trust deed(in scotland) will be effected if i sent letter.

if i am paid a lump sum of any sort i have to let the trust deed people know about it.

    sorry for any confusion

  4. Have you sent them a letter giving them a further 7 days? If not then send them 1 and say if they don't comply then you will start court action as they have failed to comply with the 40 day limitations.

  5. Not sure on the trust deed thing but if you start a thread in your banks forum and post there I am sure people will be able to advise you. Thanks :)
