  1. Hi gorgel If you are using your scottish home address you must use the scottish court system (your local sheriffs court). If you are using an english address (either a friends or one of the companies mentioned previously) you can use the english system (either n1 or mcol).
  2. forgot to say, don't worry about "no more refunds" that is a note to other cso at the bank not to do further refunds on the account. I think they are only allowed to refund charges (when you phone the call centre) on one or two occasions. This will have no implications when you go to court or if they contact you with an offer.
  3. Hi gorgel I am also at the court stage with BOS. I filed at the local Sheriff's court on March 2nd, apart from the standard response to complaints I havent heard anything. From reading previous threads it would expect to get some kind of offer before the return date, however if not I've gone this far and will continue. With regards to 2 claims i have had to split mine (at court stage) and ivo some cases failing on 2nd claim I decided to split my amounts pre and post merger, that way I felt I would be able to counter the "i knew about all the charges before I started action" with this - who knows if that will work. All I can say is everything here shows we will get our money and however annoying it is we just have to be patient.

Hi Laura d I'm actually claiming for a bank account with BOS rather than a cc, they have responded with letters, no offers which I am hoping will change once they realise court papers have been served! The Halifax/BOS threads are good though and everyone seems to be getting the same positive result in the end. I would go for it - nothing ventured nothing gained??

Hi, I've been reading for a few months and have a claim against BOS at summary claim stage so decided to sort out my husband's account with NatWest - I was very impressed how quickly the statements arrived (in two sets) and very unimpressed to find the total of charges to be £1428 (including a card misuse fee of £50!!!!) In fact he hasent actually used this account much over the last 3 years but with overdraft interest being added each month if there wasent enough money to cover this he was then hit with a £28 charge etc etc. So I sent the Request for repayment on 7/3/7 and await NW response!! Hopefully quicker than BOS. I have claimed thru scottish courts for myself however as hubbie's family reside in England thought may well try the english court system - varietys the spice of life and all that!!
