posted the original problem in jan/feb and have tried to keep to the same thread but have no idea where tonight's post has gone so started a new thread.sorry. i sent Lowell a statute barred letter as advised and have just received a reply from them. Office of fair trading information sheet and a statement of my account. " This notice is being given to you as required by the Consumer Credit Act 1974 because you fell behind with your payments under this agreement with your original creditor" Statement date: 24/02/2012 Period covered: 01/10/2010 to 31/01/2012 Goes on with account summery ... the original creditor was capital one. This debt was from 2000/2001 i have not sent any payments or any correspondence,apart from the statute barred letter,last week. i have no idea what to respond back with. thanks in advance to any one who advises. -

hi i have recently received several letters from red debt collection services. as previously advised.i have printed off a statute barred letter to send to them. my question is, should i address the letter to the collection manager, or should it be addressed to a specific person? thanks. -

hi not made a payment since i was forced to sell my home when my marriage broke up, well over 8 years. i have not checked my credit file. the debt is owed to capital one. if i carry on ignoring their letters will they eventually stop? really worried in case i get a knock on my door. really appreciate any help. -
hi can someone please advise me whether i should reply to Lowell who are chasing me for a debt approx 8years old.i have not acknowledged this debt so far,they are saying they have obtained a copy of my credit file to identify my residence and have noticed i am making payment to a mobile company or a credit card or a bank from this address.thanks for any help

feeling stressed just thinking about going through this again! the guy at capquest last time was a barry davies,wonder if he's still there. if i dont find the original letteres inot sure what i will do -

hi i got so much valuable advice back in september i managed to win a case against capquest over a 7 year old loan. i was awarded cost and thought that was the end of it.today i have received another letter from them stating "on the 30 april 09 a statutory demand for bankruptcy was sent which we have not received a positive contact from." they are once again threatening me with field agents to visit my address. why has this started up again?? please any help gratefully received. -

just thought i would let everone on here know of todays success. capquest had issued me with a statutory demand for a debt from 1999 the hearing was to take place tomorrow, but after fantastic advice from you lot they have backed down and i won court cost of £137.00!! many thanks to everyone who has helped me with a massive thank you going to brent-London,without your help i never would have fought this. -

still struggling! ive just emailed capquest with a cost application,what i need to know for sure (as ive received conflicting advice) is do i or do i not need to send a request to the court hearing which takes place on tuesday to have a statutory demand set aside? if i do is it the same as the one just sent to capquest? -

thanks for your help brent,feel really cheeky asking for costs,havent sent any letters to them so no postage, probably £10.00 in petrol to and froing to court and about 6 hours navigating round this site,lol! plus 3 hours sitting in citizens advice and 2 mornings off work. wouldnt i need prove of the above claim? and would i just set it our like yours,sending one copy to b.davies and another to court? crap at things like this!! am i likely to be asked any questions by the judge? -

hi once again! great advice given in the past,just need bit more. after asking the courts to set aside my statutory demand i am now due to attend court this coming tuesday:( i have just received a letter from capquest which they have forwarded to the court,this is what it says: " we acknowledge receipt of the application to set aside the statutory demand. capquest investments ltd are the creditor by virtue of the debt having purchased the debt from RBS. in order to deal fully with the application to set aside we will need information from the originator which we not be able to obtain in time to prepare ans serve evidence in opposition to the application. we are also mindful of paragraph 6.5(4)(b) of the insolvency rules which provide that if the debt is disputed on grounds which appear to the court to be substantial then the court may grant the application. we do not accept that the debt is not due but in view of the time considerations and use of the courts time we ask that the application be granted but with no costs. if, as we anticipate we subsequently obtain information which enables us to prove that the debt is due we will proceed bu issuing a claim in the county court which will allow the applicant the opportunity to defend the claim. so sorry for asking you to read all this but please can someone explain what happens next,do i still turn up for court? wasnt going to ask for costs anyhow because i dont know what to ask for or how to go about getting costs. will this debt ever go away! many thanks -

hi thanks for your help earlier,should i have communicated with capquest before i went to court to have the statutory demand set aside? just reading similar problems on here and some advice given says send a "proof it letter" to the agencies,wondering if thats something i should be doing? thanks again -

hi all i recently received excellent advice from you guys on how to deal with demands from capquest, for a debt from 1999 ,which forms to fill in and what to do with them. advice taken on board and of i popped to the local court with relevant paperwork,dont know what i expected but ive just had a letter telling me a hearing is to take place in 2 weeks! does this mean i will face barry davies from capquest? i feel sick with nerves! please someone tell me what happens in court. thanks. -

posted 1st class. reading the letter again it states 18 days to set aside. i will send the letter you suggested but unsure how then to proceed,do i just print off the forms and take them to a court?
