  1. Hi there... Could someone please send me the OFT statement please. I need it for my court bundle. Do I need to include all the "Relevant case law" and just fill in all the page numbers and include my correspondance. My court dates tomorrow afternoon! I know Im late in sorting this out, but Abbeys messed me around and partially paid up last minute, but the people in the court have advised me to bring my bundle and turn up for the hearing as they havent paid in full!!!! Yikes!!!!!!!!!

  4. Helloo again... Ive just received my credit report from experian and Abbey have logged a series of late and missed payments against me... Ive received letters from Debt recovery agencies for the payment of the overdraft, even though ive told them countless times, i wont be paying until the claim is settled. (As mentioned in previous threads, the overdraft is there due to snowballing charges) Im worried that this will have an effect on my credit rating. Is there anything I can do to get them removed? Please help....

  6. Hello there... Im claiming £1299 including charges, interest and court fees from Abbey. Im at the stage where I have a court case date (7th August). I am in the process of putting together three files of evidence. Today I received a letter from Abbey stating that they will settle my claim totalling £1299. The problem is, since putting the claim in up to 26th Feb, they have charged me an extra £400 between Feb and June, even though i stopped using the account. In light of the test case, im wondering what to do. Shall I accept this offer of £1299 and then claim the £400 after the test case is put forward, or should I continue with the claim and wait for the court date on the 7th Aug (Sunderland Couny Court have not informed me that the case is suspended yet). Any advice will be greatly appreciated, Regards.

  8. Hi... Thanks for your reply... Still not clear on section G of the AQ...... Do I put the bit in about lasting an hour and do I include the draft directions.... Do i need to attach any documents and can I mention the additional charges??? At what stage to I ask abbey to pay out the additional charges?? And can I claim the interest they are charging me each day for not paying this overdraft immediately?? I appreciate your help!! Claire.
  9. Hello there.... I was wondering if you could help me out with my Abbey Claim... I've followed all of your steps and Im now up to filling in the allocation questionnaire... I was wondering if you had any suggestions in filling out section G for 'other information'. I am claiming £1150 and have stopped using the abbey account because the charges were snowballing so I couldnt afford to live on the money I had left over from tax credits and child benefit. I was advised from one of your moderators to use a different bank account which ive done and everythings fine. but since filing the claim with the court theyve charged me an extra £300 in additional unpaid direct debits and exceeding overdraft limits etc and are now adding interest on a daily basis. I spoke to the court and they said I cant change the claim amount to add on the £300+ because the notice has been served. Is this right??? They said to start a new claim. I also spoke to abbey and explained the account was in dispute and asked why they cant freeze it until its resolved, but they wont and said they wont stop trying to reclaim the money they say I owe them.... Im getting worried now that Im still going to owe them more money once the claim is settled... Can I request the reclaimed money in the form of a cheque. Just so I can pay them back the original claim, until I sort the additional charges out. Does this make sense?? Hope you can advise me... I really appreciate any help... Many thanks...   10. Thanx for your quick reply... total claim is for £1108.64..... So, just to clarify shall I send the letter giving the 14 extra days to repond and then they wont hear anymore from me and I'll proceed with my claim through the courts??? Cheers!!!!! Claire.
  11. Abbey have paid a GOGW into my account without notifying me until afterwards, by telephone!!!. I sent the 1st request for money along with the schedule of charges, then on the 11 december i sent the letter notifying them of 14 more days to comply. In the meantime they paid £265.00 as a GOGW and cancelled £315.00 of charges scheduled to leave my account. Theyve sent two more letters, one on the 7th feb stating they wont refund any more charges and then one one the 9th feb saying theyre still looking into my claim???? I wish Id just stuck to the advice given on your forum and not engaged in any telephone conversations.. Have u any advice on what to do next??? Shall I send them a letter stating that they have 14 more days to respond to my claim for the full whack or else they wont hear from me again and I'll file the claim at court and then take away the GOGW amount??? Do you have a template for this??? Please help?? My heads battered!! Hehe!!
  12. Ive just recieved my first reply (micorfiche letter) and will be sending the letter that is mentioned in the forum to stop them delaying my claim.. fingers crossed
