  1. hi guys thanks for the help so far, i have been doing this for my mother in law, but at the time she did not want me to put it was for her as she was scared of anyone knowing her situation so i put it was me, she has now spoke to cccs and did thier debt remidy there suggestion was bankruptcy.they were great so she feels a bit better now and is ok about me putting it is her with the problem, but i have been trying to sort it out for her with your guidence. she still being harrassed by funny phonecalls (halifax) the calls start at 8am till late into the night every 15minutes. i have reported them to the trading standards authority and found that so have a lot of people. i have asked bt to block them but they said they cant because she owes halifax money (one of the credit cards is owned by them) she is hoping to file for bankruptcy but is worried that as she got some of the cards when she was on disability benifit she will be prosicuted for fraud. she said on her application she was self employed, but it was only so she could get the 0% balance transfer deal to try to dig herself out of the trap of only paying interest every month in the hope of lowing her debt each month. can they look into this if she applys for bankrupcy? she is really worried she will end up in prison she has been admitted to hospital and i an really concered that she will end up having a nervous breakdown or worse!!
  2. i did not send recorded delivery but have copies of all dated letters, the ones who have replyed have only offered a settlement with a reduction of £10!!! ie i offered capital one 35% as i did with all. so i actually have a balance of £921.83 so i offered £322.64 (35%) they have responded by offering a settlement of £911.27!!! most are saying we dont deal in settlement offers and to pay my monthly bill as usual and they are all now charging me non payment fees for this month, i am going to call cccs today however im not sure how much they can help as i was self employed and now on benifits.
  3. oh and i have only missed the last months payments as suggested and it is the first time ever i havent payed so why is this number harrassing me already! [please please please someone reply, im terrified that bayliffs will be next and the funny phonecalls are bad enough!
  4. ok, so im waiting for the creditors to respond to my 35% offer, however a lot of them are just sending my notices that ive been charged for missing payments, and not aknologing my attempts to settle, im just getting my usual bills and notice of charges. i am also being harressed now by a telephone number 08708503492 they are phoning my mobile and home phone every half hour or so starting about 8am till late into the evening. when i answer theres no one there. i did a search on the internet, and found a lot of people are being harrassed by this number. from what ive read on the internet i gather that its halifax. ive wrote to these people so why are they doing this to me! im a nervous wreck. please someone help me im really scared
  5. ok so ive started to do a financial statement showing my income and my outgoings. my out goings are more than my incoming! thats not even taking into account any of the credit cards. just wondering do i need to show where my income is coming from, as i am now on benifits being out of work. do i just show i have an income of £xx or do i have to say it is benifits. problem is i went on benifits a while ago as i came out of work about 12 months ago (self employed) i did not take out protection on the cards and applied and got a few cards after this time (balance transfers) i said i was still working self employed to get these cards as it was the only way i could lower my repayments and actually lower the balance as they were offered at 0% for 12 months etc. now i just get rejected. i am worried that if they find out i was not working when i got these cards ie check how long ive been on benifits, i will be in trouble, thing is it was the only way i could get 0% at the time and keep up my repayments. can i just put income is £xx without saying its benifits, or if i put benifits will they check how long i have been on them. it was a stupid thing to do i know, but i didnt miss any payments this way and at the time it seemed the only way i could keep up repayments and slowly lower the balance.
  6. well i dont own my own home, i rent, and i have had to sell my car, so i dont really have anything of value to my name. so theres definatly no property in the equasion.

  8. ok so ill start to send out the second letter. but the second letter needs a schedule with it as stated by glenn so my next question is how much should i offer each creditor in terms of a percentage of what i owe?
  9. ok so ive had one letter back from capital one after sending the letter 1 as provided by glenn. capital one have offered a partial payment of £2972.55, i owe on that particular car £3097.39 so its only £124.82 which is about 4% however they have stated it would only be a partial payment not full settlement. i was hoping of a final settlement which would be less than that amount as i have about 12 credit cards i need to deal with and limited funds as ive said before what should i do? could someone please help me with a letter template, i really struggle with writing letters. this would be most most appriciated. thanks sheracer
  10. i really really want to get it right, im not well at the moment, and i cant take any more stress im an absolute nervous wreck. i just want to be able to survive on the money i have got coming in now and the only way i can do this is to clear the credit card debt. so doing it right is very important too me, with no repercussions (sorry cant get the spell checker to work!) in the future.

  12. right ive just read glens post again and i think i get you now, i dont understand the creditor a/total thing but basically do i need to write to them and offer 50% of what i owe each one and see what they say? or is that not right (sorry im not too quick when it comes to these things, young and nieve i think!)
  13. thanks for the advice, but what i want to do for my own sanity is to write to them instead of phone because i know ill go to pieces, and i am ok with paying the loan as the payments will be mangaeable once the credit card debt is cleared its the interest on the cards thats cripling me. i need to clear as much of the cards as possable in one swift move. then im not paying any more interest on them as they are all like 18% whereas my loan is much much lower than this. i couldnt get 30,000 loan i could only get 20,000 so i am hoping if i say to them i can pay in full at a reduced final total they will accept! i lost my job a few months back so we are living off my partners wages, thats why ive fallen into the trap off paying credit cards with credit cards!! hence more and more interest added every month with higher and higher minimum payments. ive never missed a payment because debt terrifys me, and i dont want to start missing them so im trying to wipe them before this starts to happen. if someone could link me with a template of a letter asking the companys to offer me a settlement due to the fact my circumstances have changed, i was hopeing i could say i can afford to clear some of my debts and will be paying and settleing with those companies who offer me the best settlement offers, maybe i could be left with debt say 2-5 grand rather than 10 grand. then i could manage. if you get what i mean eg say i owe creditor a - £2000, they may offer a settlement of £1700 that saves me £300 and so on
  14. hi all, here goes.... i am in serious debt with credit cards. i owe around 30,000 on several different cards. to sort myself out i have got a 20,000 loan the most i could get by taking it out on our house. i want to write to all my creditors asking for a reduced full and final settlement offer. do i need to give them an amount and see if they take it, if so what percentage should it be of the total amount? or do i ask for an offer and wait for them to offer me a reduced amount? i have found some templates on this site but i dont know which one is the one i should be using. so if someone could give me the best template to use that would mean the world to me please someone help me as i am really scared and worried that bayliffs will be at my door, and i dont want to waste my loan on minium payments which just cover the interest. i want to clear as much as possable hopefully all with the 20,000 that i will have in the next few days. thankyou

  16. hi everyone, a big big thankyou for all the advice!! just had a payment of £1578 deposited into my account. i accepted halifax offer after court action was issued and they have stated they dont accept liability but have offered this ammount its only £300 short of my claim so i accepted this (this includes court costs of £120 one last question though do i need to stop the court proceedings? i did it online as following the status of my claim, it wont let me end judgement by default as it hasnt been 28 days the only other option it is giving me is jugment by admission but halifax states in bold type! they dont admit liability but as it would cost them too much to defend they offered me a settlement. so do i need to stop the court proceedings or do they do this? i have sent a letter to halifax accepting thier offer and have recieved the money today so its concluded but online the court proceedure is still active. thanks sheracer. ps.   18. ok so ive started court action against halifax for over 2 grand, they offered me £500 and i wrote to them stating i would accept only as a partial refund then did not hear back so now ive issued my court order online and have been guided through it all by all the kind people on this site. but now im panicking as ive paid the £120 fee and the ball is rolling however both me and my partner have lost our jobs just before xmas so we are desparte for this money to keep our house as it will pay the rent. we have recieved a letter of acknowledgment from the courts andattached is a copy of the response pack which says that halifax intends to defend all of the claim. is this normal and what are my chances of winning this as i literally cant afford to loose. help!!!
  19. everyone has been great so far so i want to issue a big thankyou to all who have offered me advice!!!!! i can most certainly say i would not have got this far without your support: the story continues..... ok so i wrote the letter stateing i would only accept as a pertial refund and have been ignored. dead line is up so ive just issued a claim online with hmcs. my next question is what now? do i need to send the bank charges with the 8% calculation anywhere as the online claims form did not have an attach file option, or do i need to send a copy to halifax? i have a clain number and paid the £120 charges (i really really hope this goes my way as both me and my partner have been laid off from work redundancy has almost gone with £200 left in the bank until we get another job and that was a portion of next months rent!) so im feeling a bit lost, do i need to do anything else, how long does it usually take?

  22. hi, im currently at the stage where halifax have wrote to me offering £525 as a "good will guesture" and states full and final settlement of your complaint. in reality my claim is for over £1000, I am not really happy with this as it is less than half of what my claim is. What do i do now, is there a way to say no...ie a template letter, or do i have to take it! reading the step by step guide, this advises to take it but continue to persue the full claim, however, the halifax have sent a letter for me to sign which states that i will accept the offer in full and final settlement. someone please help me.
