  1. Hi DA, Thanks for the info. The company is Commercial Vehicle Direct, I spoke to a lady the other day and complained that we have never had to pay a fee before and that it was excessive. As we hold another policy with them they have agreed to half the fee to £56. I then agreed to pay £1 per week as that is all that we can afford. But my husband isn't happy he doesn't want to pay anything. Will love to know if there is a way of not paying this fee. Cheers Ealexander
  2. :mad: Hi Guys My husband recently sold his van and so he cancelled his insurance policy. Two week later we recieve a letter asking for £125 cancellation fee. When we asked where it states this fee, we were told its in the policy manual and that we were made aware via an automated message when you phone up to arrange the insurance, and by continuing to take out the policy you agree to the terms. My husband does not recall this message and I have asked where we signed to agree to this fee. They have said that they don't me writen proof as it was verbal. I don't mind paying a fee for early cancellation but when it is over a third of the total policy amount it seem unfair. Where do we stand ? Do we have to pay it??? Advice please!!!!! Ealexander
  3. Hi, Surely they can't take money earlier than stated????? It drives me mad, My husband gets paid by the same people, same day every week, yet Halifax change from week to week which day the money will clear. If I didn't know better I would think that they purposely delay clearing monies to incurre bank charges. If it is not bad enough that they take our money and invest it for three days before giving us it!!!!! Shame I can't prove it!!:-? Unfortunately the letter with "To Cover our cost" is from the previous complaint, so I don't think I will be able to use it in court.:-? Well keep me up to date with how you get on too.   4. Hi guys, Well I sent the letter giving them a further seven days. Whilst I was looking at all the paperwork from the last claim and there was nothing there stating that all further charges would stand. I also found a letter where we had been charged four times in one day. Interesting as Halifax say they will make a maximum of three charges a day!!!! On closer inspection they, then took one of these charges out a day earlier than stated on the letter. Which is the lesser of too evils????. I also found several letter stating " To cover our cost". I think if I go to court I have got enough to throw at them. Cheers Ealexander

Thanks for the heads up, I will write back giving them a further 7 days before court action, stating this is a new complaint and claim and that I feel I have no choice but to enter court action against them as they have yet negotiated with me at all. Cheers, I will let you know how I get on. I have removed all activity from this account now and have set up a standing order to make regular payments off the overdraft. Is there anything else I should do that will look good in court??? Many Thanks Ealexander
  6. Hi there, Yes because I settled out of court I signed a full and final conclusion letter for my complaint. I am only claiming what they have levied since the last complaint/claim. I have not included any previous charges. They have not entered into negotiations this time ,they have point blank refused my claim. Can I claim a second time??? Help and advice required.   7. Hi every1, Last November I accepted £1000 from the halifax as a refund of bank charges and moved most of my monies into another account. My husband continued to use this account for his wages and a few direct debits. In the last six months they have levied a further £1086.54:mad: . I have sent the letters again and have recieved a letter stating that as we settled last year we waived our right to any futher refunds. Is this true???? If not I will start MCOL. I dont want to get to court and have the case thrown out because of this. Help and advice required.:? Thanks Ealexander
  8. Hi everyone, I think i am going to accept the offer of £1000, £1313 is including interest and the other charges £86 that they will cancel is also included in that figure. This all really started when Argos (see thread for more info) didn't refund me £550 when they promised to. They are compensating me the other £300 so all good really i am happy. I would advise everyone trying to negotiate a figure, it was really quite quick and easy, not the fight i was expecting!!! Good luck everyone E
  9. Hi again Well quick update I have finally got my money back!. have had £25 in vouchers sent to me to say sorry, and according to the lady I spoke to a cheque for £120 is too, If this is true a small win for me! Cheers E
  10. Well I got a phone call today from the Halifax. It was a phone negotiation on a settlement figure. Started at £600, got to £1000 plus will cancel all further charges set on the account. If I except it the monet will be in my account within 7 days. Tempting isn't it. For info claim now totals £1313 cheers guys E
  11. Hi guys, Bank charge for direct debits and debit card payment on the account, halifax current account. Didn't cancel them because they promised the money would be in my account by these dates. These charges have now caused more charges etc, etc. I have asked for £3 for letters sent and £3 for phone calls. Wait and see hey a lot of worry and for once not really my fault. Cheers guys E
  12. Hi again, I have recieved a letter from the Halifax saying that they are taking my complaint seriously and someone will investigate my complaint and I will have a reply within 4 weeks. Advice? Cheers E
  13. Hi again, Well I'm still waiting for my refund another computer system hitch apparently.Yes I did sent a letter asking for full and immediate refund and have now sent another saying the same. Should have the money by Friday 24-11-06. I have sent a letter asking them to pay all charges I have incurred because they didn't put the money into my account as promised. I have given them 14 days or I will take court action. So lets wait and see! Keep you updated E
  14. In a big dispute with Argos at the moment. I order £550 worth of funiture on their wedsite on the 14-08-06. After the delivery date was pushed back 4 times i decided to ask for a refund. Was told the money would be back in my account by 10 days on 26-10-06. On the 06-11-06 still no money. So I phoned them and was told that there had been a computer error and the money would be in my bank within another 10 days. 15-11-06 I am still waiting!!!!!!

  16. Hi everyone, I sent a letter yesterday to the Halifax. Only had the account 13month and have paid to date £947 in bank charges. Just recently they are charging me £120 a week with is causing me to get deeper into debt. When phoning to tell them I can not afford these excessive charges, their attitude was tough luck. I am not sure what I can claim back so I have started by asking for the above amount. The charges vary from £28 to £138 in one day. For all sorts of things such as cheques, direct debits and debit card payments. Their excuss for the high amount is to put us off doing it again. They also pay the none guaranteed items first and then charge for the rest. If they refused the none guarateed item on several occasions I would have only incurred one charge not three or four etc. Recently they have been taking their charge out first or early to causing us to incurr more charges again with other payments. For example if I have two debit card payments and two direct debits coming out on the same day but there is only enough fund for two items they will pay all four items and charge be £30 each of the four items paid. This dosn't seen right! Advise is welcome. Cheers Ealexander
