  1. A similar thing happened to me 2 years ago. My bank details were sent to the wrong address and I filed for compensation. I wrote a letter complaining and asking for compensation quoting that I would take this complaint to the Financial Ombusman if I did not receive the proper compensation. I held out for £500. The reason for this is that the Ombusman charges the Banks £500 for each complaint that they have to handle if it is found to be a fault by the bank - which in your case it clearly is. They did try and get rid of me for £100 then increased to £180 but 2 weeks after that call I got a cheque in the post for £500. They have clearly breached the DPA rules and therefore you are entitled to claim. Good Luck.
  2. Thanks so much 4 that. Think my best bet is to serve thro the Scottish Jurisdiction as I dont know anyone in England. In the Scottish system if i serve a Summary Cause I can claim upto £1500 and then do a small claim for the rest of it. Fingers crossed!
  3. I am at the final stage and just about to submit a claim to the court but confused as to where I should be filing this. I live in Scotland and my local branch is in Glasgow but my banks registered address is in Bootle. Should I go to the Scottish or English Courts? Thanks:confused:
  4. Thanks so much for that. One more thing - sorry. do u know anything about the interest charged in the Vampress scottish schedule? I have added everything up and it's calculated the interest automatically which is interest on unlawfully deducted items but then adds judicial interest - can i claim both and for the judicial do I just add 8% to the full amount? Sorry I just want to get it right first time and am a little confused and nervous.
  5. Sorry but I'm very confused. I am raising an action against A&L for £1700 in Scotland. one thread says that I should divide this up to fit into small claims and other advises that this could be struck out which means that i would incur the court costs and asked to re file. What should I do? if I take out a summary case how much will this be, will I have to get a solicitor and will I be able to claim the full £1700 on a summary. Help is much appreciated!
  6. I have now received details of all my charges and sent out a letter asking for £1600 back. they have now sent a lett adv they will not pay so I'm sticking to the timetable. I fully expect to have to file a claim in court and am confused in relation to the interest. Having filled out the excel spreadsheet it's calculated the interest I am entitled to claim on the right hand side but at the bottom it has Judicial interest at 8% which stays at £0.00. Is this seperate or do I have to add more interest??? Very confused (remember I'm filling in the Scottish one) Thanks
  7. I sent my letter requesting details of all bank charges but the deadline is now past. Having looked at the letter templates I cant see one that relates. I know this is probably a simple problem but I'm not sure which letter to send to them now - help?
  8. Received a letter telling me they are putting a default on my account. I phoned and explained that I had already talked to someone and they agreed to hold my account till mid dec, which is when i can pay off the o/draft. They told me they need to continuously send me letters advising of my account status, which is costing me money!!! Cant wait to get them!
  9. I dont understand why they do this as it will only cost them more in the long run - they must think people will get scared and drop the case - NOT ME THO!
  10. Thanks. For the past 2 days i've been reading the FAQ's and the threads. I've already opened up a new bank account and arranged for my wages to go into this - I expect the worst from the A&L, they seem to be taking the hard line with all these complaints. I wouldn't have done this without the knowledge I have gained through this site, thanks to everyone posting their news. I will keep everyone updated on my progress
  11. This is a fantastic site. I have been off work recently and in this month alone I have received over £500 in charges. I had no idea that this legislation came out and when I called A&L to ask for assistance I got no help at all! They are now the reason that i cannot meet my DD! Anyho DPA letter sent today - wish me luck!
