  4. Hi to all With ref to Account B in my last post, the 40 day SAR limit ended today and I have not heard a dicky bird from Barclays at all, no statements, no letter , zilch. The question I now have is, apart from reporting barclays to the Information Commisioner, how should I respond to their non-compliance and the ignoring of my letters to them in order to get my money back? Any help much appreciated. Thank you jacksie

I have received my statements following S.A.R - (Subject Access Request) but there are 6 missing from various years plus they have not sent me any info relating to the DCA they engaged to collect payments (Equidebt, who incidentally took more payments than they should have after the account was cleared). I have also sent them a reminder about this and that the time limit was running out but they have ignored my letters. The 40 limit has now expired on Monday last, 4/12. What do I do now? send them an LBA as per template 2 by alanfromderby? and how do I go about getting my money back from Equidebt? Thx for any help jacksie
  6. I had 2 accounts, A & B, both closed. Requested both lots of statements on same SAR. Account A is the one for which I got my statements and the stage I am at with this acc is Barclays are due a LBA early next week. Account B however is the account for which Barclays have indicated that there is NO TRACE OF, even though prior to the SAR I received the last 2 statements following a call to customer services. I have already sent them a reminder about the 40 day limit, which expires on Dec 18th. I paid off this account in Nov 2005 to BRU. I am leaving the DCA on the back burner for a while, that they engaged when they closed the account in June 1999 as it was BRU that I was paying the money to from March 2000. I had never heard of the DCA until 2004, but they had defaulted me in 1999 for the same debt that I ended up paying to Barclays, who sued me in March 2000. I hope this clarifies things up a bit. cheers jacksie

    Old Debt

    Can an old debt become 'live' again simply by making a DPA SAR? I'm asking because I have an old one which I cannot recall nwether I paid it off or not. cheers jacksie
  8. I went ahead anyway, S.A.R. to Barclays for two seperate accounts. I collected one set (Dec02 to Oct06) from local branch on Monday. Barclays left an internal letter amongst the statements and it said that there was no trace of the second account !(199? to July 1999) although I know this is a load of bulls*** since a couple of weeks before I phoned Customer Services and they sent me the statements for June /July 1999. What should I do? the 40 days are up on the 18 Dec. I am concerned though because when the account was closed in the July for £200 plus and this was cleared by and passed onto Barclays Recovery Unit (BRU) for collection. In March 2000 they got a CCJ against me and the total it had risen to was £700 plus, so do I chase BRU for any statements or what? I would appreciate any help or advice very, very much as I am becoming quite stressed out by it all and feel like jacking it all in, this could be my last try before I give up.
  9. Received statements (microfiche copies?)yesterday, dating back to December 1997 :o Now hard at work trawling through them with highlighters at the ready to find out what they have ripped me off for. Not long before the request, nay demand, for payment is on its way. Will stay posted humpty

  12. I had my account closed by Barclays in 1999 for an O/D balance of £***.**. This was passed to Barclays Recovery Unit (BRU, Manchester address), then sometime between this date and March 2000 the was balance reduced to £***.**. On 30 March 2000 Barclays took me to court and obtained judgment for £595.00 + costs. In Nov 2005 I finished paying it off. In July 2004 however I received a letter from CSL, who it transpired where acting for Aktiv-Kapital, who were chasing the balance that remained prior to Barclays taking me to court in March 2000. This has been the only time that I have been contacted, either directly or indirectly by Aktiv-Kapital to my knowledge. It appears to me that BRU immediately either passed on or sold the original default sum/debt to Aktiv-Kapital who recorded the default, and then somehow got it back and subsequently obtained the judgment against me. The question I have is, how could this be possible? is it lawful/illegal? What laws etc, if any, have been contravened? I have sent my D.P.A. subject access request to Barclays and await my records with interest. Anyone who can throw any light into any dark corners will be much appreciated. Anyway, I digress, I rang Barclays customer services to request the account number for the above account. The person I spoke to initially told me that Barclays would not hold records for more than 3 years! :o When I told her that the conversation was being recorded she quickly changed her mind and said that the system could possibly go back to 1998. On asking me why I wanted the information, I told her I needed the account number for a D.P.A. She then said that they could go back 12 years maximum!:grin:

  14. hi i took my pc for repair and got back a different one that does not work properly. i have not paid for the repair yet because i am dissatisfied with the service i received so i wrote and complained. i am worried now because they have wrote back to me to say amongst other things, and i quote "Please return the computer or make prompt payment within 10 days or we will have no choice other than to file for a CJJ (their spelling) against your name and costs. i am very worried and frightened about this. What should I do?

There are 2 entries on my credit reports as follows: Credit Report dated 26/10/2006 Linked Addresses Entry Number B2 Name & Addresses Mr ************ Address 1 Linked To Addresses 2 Source AKTIV KAPITAL (UK) LTD Date of Link 20/03/2005 Credit Report dated 11/05/2005 Credit Acc Information C5 Mr ************ Address 1 Date of Birth **/**/**** GONE AWAY 11/03 AKTIV KAPITAL (UK) LTD BANK Default £243 Defaulted 01/06/1999 Current Balance £151 Status History 8 File updated for the period to 17/0/05 These are the only entries relating to AKTIV on my reports and I do not have any CCJ's relating to them either. On reflection, If I remember correctly this default may refer to a Barclays current account that I had and was subsequently closed around that time, mid 1999. I am considering a Data Protection Act to Barclays, without acknowledging any debt to them, suitably ajusting the wording of the DPA. This way I hope to discover if this default is with this old account when I eventually get my statements etc from Barclays even though this means getting info that is older than six years. Any opinions/advice on this approach, rewording etc, would be most welcome. Cheers, BigJacksie
  16. Hi guys As I say I have never ever had any communication direct from Aktiv. I had missed the entry in last years report and only became aware of them via the CSL lots' letter in July 2005. They have never contacted me since. There is no judgement on my file only Aktiv's link on 20/03/2005 in my latest report of last week. I cannot recall when my last payment may have been but at a guess it must have been prior to 06/2003 Thanks again
  17. I had never heard of Aktiv Kapital until I recieved my credit report in May 2005. They had an entry dated Nov 2003 saying that I had GONE AWAY, even though I have been at my current address fo the last 11 years! Other info says that i defaulted Barclays for £243 on 1/6/99, current balance £151. They next came to my notice in a letter from CSL(Credit Security Ltd) of Aylesbury, Bucks dated 20/07/2005. In a phone call to CSL they told me they were acting for Aktiv and that the debt had been bought from Barclays. Last week I got a new credit report and Aktiv rears its ugly head again, this time linking me with my current address that 3+ years ago they said I had gone away from! What are these people on????? My real question is though, should I ignore Aktiv altogether since it is 7 years+ since the original default and let sleeping dogs lie. Does this also mean that the debt is written off?? Or should I contact one of them, but who? CSL, Aktiv or Barclays? Any help will be most welcome.
  18. Hi all, Thanks for that Katie, won't forget both acc no's, I will be Data Protection Act'ing Barc's this weekend. As for Registry Trust, just googled it and found their site here RTL Home Gives plenty of info about the recording of CCJ's, Child Support Agency and lots more. It is searchable for a fee. I discovered it on my credit report and I had never heard of them before either. Hope it may be of use to anyone out there. BigJacksie
