    Contact your local MP advise him or her why you think that Atos got it wrong and the length of time it has taken to get an hearing complete with copies of your appeal and hearing letter and they will send a letter to the judge supporting you.

    The more the doctor and judge sees before your hearing the better as there mind will be almost made up by the time you get in there.

     

    Also they are not interested how you are now it's all about the time of your examination that's all they are looking at.

  12. going to my hearing on 28th march and would like to know if I have to put everything in writing or can I just speak to the judge/doctor on the day as they have my medical records etc, stating my conditions, ive read the sticky about appeals and it says to highlight the descriptors you are challenging i did this in my original letter on GL24 saying what descriptors i disagree with, so do i need to send this in again to the tribunal, i have had to deal with my wife battling breast cancer so have been thinking about other things and now got to sort this as well any help would be welcome thanks

  13. Hi, recently reclaimed esa before 6 month period due to worsening condition. Have been advised by dwp that my claim has went to a decision maker yesterday. Anyone had similar experience or know how long this might take and possible outcomes. Any help greatfully appreciated, thanks x

  14. Hi first thing first tell the credit score company you dispute the default and tell them to add a note on your report stating this,

    Next search the ICO information commissioner office and read about what they need to do before they can default you if the have not complied write to the one who issued the default and copy in the credit score company stating how they did not comply with the ICO guide lines and request they remove it with by rerun as this is effecting your credit rating and coursing no end of stress to you and your family (Lay in on thick) or you will complain to the ICO, the courts to get it removed, they will not listen and say it is staying so reply by doing just what you said. It will be a long process but they will remove it if they are wrong in what they have done, I know as I have been there with American Express it took 9 months but worth it as I also revived compensation hope this helps

  15. sounds like you will have a bit of a battle on your hands to remove it.

     

    Orange must have reported you to the CRA as they are the ones you signed the contract with, the person on the phone sounds like he is not interested in helping.

     

    you will need to write to them to politely complain about the phone call and the negative response you received from there operative and explain your circumstance as to why you left to go back to the US, and it has been a big misunderstanding.

     

    Do not tell them you are trying to get a mortgage as they will have no sympathy and say up your and they have to report you by law.

     

    it would be a good idea to also write to Experian and request they put a note of correction on your report stating

     

    "THE CONSUMER HAS DISPUTED THE ACCURACY OF THIS ENTRY AND HAVE

    ASKED THE PROVIDER TO INVESTIGATE IT. GIVEN THAT THIS DATA IS DISPUTED, PLEASE

    TAKE CARE IF MAKING AN ASSESSMENT OF ANY KIND THAT MAY INCLUDE THIS DATA."

  16. Hi All

     

    AE have finally agreed they should not have issue the default and have confirmed they will remove it with in 48 hours.

     

    I advised both AE and Experian 14 months ago what intended to do when the default was remove if they did not remove it until the final outcome, but they both said up yours.

     

    now the tables have turned after a long hard battle and i intend to make them both suffer for the distress they have caused me over the last 14 months.

     

    AE have offered me £100 and Experian have offered me £62 compensation which i am about to tell them thanks but no thanks as i feel this is a unreasonably offer for the damage the defamation comments has caused me and my family.

     

    Can anyone offer me any advice please?

  17. Dear all,

     

    after a long battle between me and AE, and with the help of the FOS, AE have agreed to remove the default, which i proved to them that they should not have issued it in the first place according to the ICO, as i was only late with 2 payment.

     

    it has been a hard and long battle and coursed no end of stress for me and my family, i have been unable to get a bank account, car loan and car insurance due to the default.

     

    because of this i am now going to claim compensation from AE and Experian for Deformation.

     

    my question is

     

    1) can any advise if they have taken this curse of action, that can give me some advise?

     

    2) what is a reasonable amount i should claim from each off both them giving the stress they have put me thought?

     

    3) IF ANYONE NEEDS ANY HELP OR ADVISE ON GETTING A DEFAULT REMOVE PLEASE ASK ME AND I WILL ONLY BE TO GLAD TO HELP?
