Just a quick message to Citi Thanks Mark, not only have you failed to settle to my claim or respond with any of the information to allow me to close it, you have now dug yourself an even bigger hole, you guys might think you are the bees knees but even you can't go against law. Your threats to do so have created me a problem though in who do I complain to first???? Oh & by the way I will not drop my claim for charges either!

  4. Ok quick update on this one. Phone them yesterday as I had not received funds in the required 14 days. I got told it had been applied to my account, which is long closed, after a few mins discussing my agreement in relation to the offer they made & me saying OK fine I will issue a claim & go for full disclosure on you charges this evening they agreed to send me the cash via the BACS system, it should be in my account by Tuesday so watch this space.

    OK guys & gals your help is needed. I have a response from the Muppets First of all to set the seen I am in an IVA, MBNA were a cred & sold to Eversheds/Max recovery in July 2006 Main points of the letter 1) They dispute the charges are unfair you signed the terms blah, blah, blah 2) They will credit my account with £160 - 55% approx 3) The Account was sold in October therefore they will pass this credit to Eversheds.(Account was sold in July) 4) They have not treated as a S.A.R - (Subject Access Request) (It never was one) Do you think the letter below is satisfactory? Should I send as an LBA or should I follow up with an LBA in 14 days? I am very disappointed that you have failed to reply to my letter of the 9th March 2007 by your promised response date of the 10th April 2007 & only responded on the 24th April. Firstly in response to the charges applied to the account I now understand that the regime of 'fees' which you have been applying to my account in relation to late payments & exceeding credit limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I would not have expected you to have treated my letter as a SAR as it was not & therefore did not contain the required payment & information that is required for it to be a SAR. The details of charges attached to your letter show that you have charged me £295. I therefore decline your offer of crediting £160 to the account you transferred to Eversheds on the 31st July 2006 (Not the 31st October as stated in your Letter) & request the a full refund of £295 plus compound interest of £xxx to be paid via cheque. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest & my costs and without further notice. Thanks in advance FB

    OK well suprise suprise no reply. LBA drafted, phoned them up they are working on letters due 10th & 11th now so will have a response by EOW. Agreed to hold LBA till Monday then time to shaft them.
  7. Ok quicky on this one it is looking good. I submitted a prelim & they have responded. They do not agree they are unlawful but will credit the full amount of charges to my account or if the account is closed they will pay me via BACS if I supply bank details. I am going to give them this & settle ignoring interest as it is only £12! I will let you know when I have the cash.
  8. Ok guys & gals need some help. I have done a prelim letter to MInt, got my figures wrong (luckly counted to many charges not to few). They have come back & offered the difference between £20 & £12 & the interest to be credit to our account (now defaulted & closed). Obviously I want to reject as I want the full £20, also I want in cheque not credited to the account, does anyone have any ideas for the letter? Thanks in advance

    Corn, Thanks for your input, I didn't need to go down the SAR route as I had 1 charge in 4 years up till last year when it all went t1ts up! I have been reading on here & got the addresses, I wrote to them & they got the letter on the 14th (recorded delivery) but nothing yet, I suppose the next stage is an LBA. Will keep you up to date

    Ok time to go after these git bags. I sent off my Prelim letters & MBNA received on the 14th, how long do they usually take to respond. I have also sent to Mint, B/Card & Monument so if anyone has any idea on response times from these guys please let me know
