  5. Been offered £600 by some chap called Pereira. Typical bumph in the letter along with 'your view that the charges are unfair' . I don't just think they're unfair, I know they're unlawful, buffoon. MCOL will be launched at the end of next week.
  6. Er...if you're in the situation where you are claiming back a substantial sum of money then surely you've got defaults issued against you anyway!? Pretty sure I have! I'm hoping to take advantage of the 'defaults repair' my bank will do, once they've forked out the cash, by taking out a loan and paying back what's left of my o/d at a preferential rate.

What I have done is a mere paper exercise, merely illustrative, and far too simplistic to stand up to any scrutiny. If it were possible I'm sure we'd have been provided with a method for calculating how much we're owed. My point is not to ignore this interest. It can be significant amount as I've demonstrated. As previously stated, I'm adding £400 to the £1100 I'm owed. Using the data I've just knocked-up it seems to be a good guess and is for them to prove it's wrong. The work people have done on this site and for the campaign is fantastic and much appreciated. A marvellous resource. Thank you Personally, I am going to donate as I wouldn't have been able to do this without your help. Plus, I know too many law students from Plymouth which is where a lot of this work has been done.
  8. Probably offer you about a third to a half of your charges, depending on the amount. Ignore the 28 days they have attempted to stall you with and carry on with the terms you set.
  9. I really don't mean to try and be argumentative, but I genuinely believe that attitude is not helpful to those of us who are owed money, or is not being properly considered. A mere resignation that it is not worth the effort is contradictory to the point of this website and campaign. We are making an effort to reclaim our money after all! My point is that I am owed an extra £99 in flat interest accrued in only one year on an amount of £1000 in penalty charges between 2000 - 2005. As this will have been compounded year on year the amount is considerable. e.g. If you were charged £200 per annum every year since 2000 in illegal fees this is how your debt would increase merely through being charged 9.9%. Year..... Illegal money owed O/d..... interest @ 9.9%.... End of yr 2000..... 200..... 19.8..... 219.8 2001..... 419.8..... 41.56...... 461.36 2002..... 661.36..... 65.47..... 726.83 2003..... 926.83..... 91.76..... 1017.76 2004..... 1217.76..... 120.56..... 1338.32 2005..... 1538.32..... 152.29..... 1690.61 So, 5 years of £200 fees per annum will result in a debt of £1690.61, nearly seven hundred pounds more than the £1000 you have been fined!!!! No wonder I can't clear my overdraft!! I have heard, but am willing to defer if someone can confirm otherwise, that it is for the banks to prove they don’t owe you the money. Adding a theoretical ball-park figure is not tricky and is for the banks to prove wrong. Veering towards conservatism will ensure you are being seen as reasonable and not pushing your luck.
  10. In response to Lueeze's last point 'usually works out to be not that much'!?! My overdraft (authorised) is charged at 9.9% per annum. If I had had £1000 in illegal penalty fees this time last year then I have been charged £99 pounds. Compounded, over 6 years, this is could be a huge amount of money!! If you have an unauthorised overdraft this figure could be collosal. Again, stealing from those who can least afford it!
  11. This seems to be a great point of confusion. You cannot claim the 8% apr until it goes to court. That is now pretty much known by everyone who has read the FAQs. However, as some of us have been charged £25 upto 6 years ago then we have been charged interset at a very high rate on our debts. Possibly the unauthorised overdraft rate of 25%+. Calculating how much they owe you for this is extremely difficult - no-one, to my knowledge, has come up with a method for calculating this as yet. From what I understand, so far, it is for the bank to prove they don't owe you this money and prove it should be a different amount. Personally, I am adding an assumed amount of £400 in intersest accrued on my £1100 charges. Could be more!!??
  12. Just throwing one out here, but let's not be naive... ...there seems to be a lack of people who have reported to have gotten their money back. None have put their details into the litigation concluded section. Make what you will of this. However, no one has reported to have not won their money back...gagging orders? I've a few days left before I launch my moneyclaim as the LBA is about to have run its course. I, like most others, have been offered a few quid, in relative terms, to drop my case. I will not. The lack of reprted victories/acts of justice is not testament to the genuine results...hopefully!!??
  13. Very easy and don't doubt it's possible. However, most of the 0% offers aren't available to the vasy majority of the site as we are currently 'high risk' - until we win, that is, and our defaults are wiped away. Another possible drawback, and worth checking for individual circumstances/accounts, is the 0% is often accompanied by an asterix stating balance transfers (which can have a fee attatched) and purchases only. Cash advances aren't often included on these type of acounts. Check the fine print before attempting this!!
  14. Thanks, so short-changing me around £900, not to mention the initial 'theft', is reasonable behaviour! I see. May be it's time to start bandying around "extreme stress due to financial pressure caused by your maladiministration" or "considered suicide" and go for some proper compensation! Maybe I should ring-up and tell them I'll accept the amount with cleaning the credit record without o'd interest/costs/8%APR if they want me to settle for a reasonable amount!? Merged threads, please keep to the same one.
  15. Received a very typical letter from Dave Chapman offering me £425.00 full and final. Normal spiel with T&Cs and disagreeing with my view etc, but also interestingly... "This is with the cost and inconvenience inherent in a further dispute in mind and is intended as a gesture of goodwill" I'd been quite patient with them and actually didn't send my LBA off, as stated previously. With cases looming for about 4 or 5 others I was playing a bit of a waiting game. They must be just stalling, as mentioned by OBLong in another thread, they can't know something no-one else does!? LBA will be sent this afternoon.

  18. ...looks like there are a lot of people from Plymouth on this site due to the publicity it has attracted in the local media, so has anyone else been 'done' by the city council today? I didn't get paid and will not until Tuesday morning!! Skint all bank hol now and have missed DD payment so yet another penalty charge. The cheeky, sorry lying, sh!t on the phone told me that banks had been contacted and would extend o/d's, not charge you fees etc... . I now have another black mark against my credit rating and had to walk 5 miles to work today thanks to some useless tw@t who missed the pay deadline. They even had the nerve to try and apease me by saying 'we haven't been paid either!'...I DON'T CARE! They will apparently pay all penalty charges back to me so, but doesn't help today and certainly doesn't help my credit score. Any ideas on how to deal with these @ssholes!?

  21. They're really taking the p!ss now. I'm sure that £10 over the o/d limit incurred a £25 penalty. Just been sent a letter charging me £30 for going £5 over. Swear I haven't been informed of the change!? Anyone else noticed this? Horribly crass considering! Not sure whether I should phone-up and demand a full refund of this penalty charge or just add it onto the £1300+ they owe me!?
  22. No further reply from Barclays so LBA will be on it's way tomorrow. Still unclear on how to work out the o/d interest on the penalty fees, do I need to detail this now or just acknowledge that I am seeking it? Slightly concerned in the lack of cases resolved. Pretty sure it will just be a matter of time as there seems to be a large amount of cases pending.

  24. Cheers for the info, I have already written to him asking for receipts and a full refund giving him 21 days to respond. It wasn't sent recorded delivery as we posted it through his letter box. We have heard nothing... For the LBA I will certainly get it done recorded. 28 days seems reasonable, I am trying to be firm and not step down to his level. By giving him this I assume it will only look better on my behalf. My assumption is that he thinks he can get away with it and we won't challenge him - guess he doesn't know me very well! I am in a very lucky position as I play cricket and am friendly with a whole host of solicitors, so will get one of them to amend and look over my letter this evening over a pint or two. I any extra info pos up I'll see if it's useful to anyone here and keep you informed.
  25. Cheers for the insights and help folks, much appreciated. Just to keep you updated, I'm sending him an LBA detailing points we concede on (wallpaper damage from one of the lad's blue tack) and points we are contesting (most of the others). It's my belief that if I demonstrate that we are behaving honestly and he has been deliberately misleading then it can only strengthen our case. He still requires invoices to evidence that he ahs carrioed out these tasks, if they come from the price list he sent us referencing an unnamed agency at this own postcode, then he'll be shown to be pretty dodgy IMHO. Good luck to everyone else. I'm very much once bitten, twice shy now and will follow then advice given by those in the know with prior experience of this kind of thing. Although, I have rented many properties in the past this is my first genuinely negative experience. A majority of tenants and landlord are good, fair and reasonable people, shame the selfish few spoil it for the rest of us. I'll keep the board updated with the progress G
