  2. hi all, i would like to thank you all for your advice on my predicament. i still have not had a formal notice sent to me yet(s8 housing act 1988), i phoned my ll to ask for one, and my ll did not know what i was asking for!. the ll said that he was giving me back this months rent when i hand over the keys on the 30th april 2008,at 8.30pm, does he still have to give me my deposit back also? just had a call from a mate, a house has come up for rent, which i accepted as i dont have much time left. i will keep all posted what the outcome is, thanks to all dicky6.
  3. thanks for your good advice, but there is one thing, how do i go about finding out if the LL told the bank that they were letting the house out? do i get in touch with the bank? do i ask the LL ? should i get in touch with the LL and ask for a notice to quit, as i will need this to show to the council, etc? i have sent an email to shelter asking there thoughts on this matter, thanks again for your good work in your replies, and i will post the reply from my LL and shelter. thanks dicky6
  4. thanks for your replies, the LL only notified me by phone, not in writing. the LL said in the phone conversation that they will hand back to me this months rent, which i will recieve from them on the 30th april when i vacate the premises. they are in arrears on the morgage which i found out, thats why the house is being handed back to the bank, (before it has a reposetion order imposed). thanks
  5. sorry about the date mix up. should have been the 30th april and the 30th june, sorry.
  6. can someone please help me as reading the housing act is all greek to me. i rent a house and pay rent monthly, the landlord phoned me up on the 2nd of april stating that they are handing the house back to the bank at the end of april!!!! THIS ONLY GIVES ME FOUR WEEKS TO FIND ANOTHER ACCOMODATION, FOR ME AND MY SON.what do i do? i thought that i had to be given two months notice in writing? is this correct??? also as it was on the 2nd of april, the notice should be a full two months ,ie, if notice was given after the rent date (runs from the first of each month) so the tennancy should finnish on the 31st june 2008, is this correct??. the landlord stated that he was handing the keys back to the bank on the 31st april, what do i do?? IM STUCK ,WHERE DO I STAND, CAN I STAY TILL THE 31ST JUNE???(AS THE BANK WILL BE IN POSSESION OF THE HOUSE THEN!!). COULD SOMEONE PLEASE SHED SOME LIGHT ON THIS MATTER FOR ME,THANKS.
  7. back again, took your advice thailand and (i phoned rather than send a letter),and spoke to the sender of the letter i recieved about my account being closed, ( mr akib ahmed.) i put forward to him a weekly payment plan, and the amount was reduced by £52.11, straight away, so a result in there, and the account will stay open .i will of course ask for all charges relating to this to be returned. by the way he had no idea of any court order presented to the woolwich, and there was nothing on my records to state this???????? well back to work, keep you all posted soon, thanks dicky6.
  8. hi thailand, yes i have, i opened one a few months ago. i will write to them offering a payment plan ,see what happens thanks ,dicky6
  9. thanks thailand, the termination notice is issued in accordance with sections 76(1) and 98(1) of the consumer credit act 1974, thanks, dicky6.
  10. hi all, sorry that ive been so long in keeping things up to date on this thread, xxth november i recieved a letter from the court stating that (the woolwich) barclays bank dispute the full amount and are contesting the claim. i was expecting this (as in a lot of cases). still another few weeks to go. 17th november, i recieved a letter this morning from barclays, excitement!!!!!!! was this a letter stating that all my bank charges have been rightfully returned???? NO. IT IS A TERMINATION NOTICE TO CLOSE BY BANK ACCOUNT DOWN WITHIN 14 DAYS FROM THE DATE ON THE LETTER(16TH NOVEMBER). THE LETTER STATES THAT I CAN NO LONGER USE MY CARD ETC AND TO RETURN IT STRAIGHT AWAY. DAILY INTEREST AND CHARGES WILL CONTINUE TO ACCRUE AT THE RATE OF 27.5% AGAINST THE BALLANCE IN EXCESS OF AGREED OVERDRAFT LIMIT, AND 15.6%AGAINST THE BALANCE . INTEREST IS CALCULATED ON A DAILY BASIS. ALSO YOU ARE REMINDED THAT THERE IS ALSO A CHARGE OF £3.00 LEVIED FOR EACH DAY YOUR ACCOUNT HAS AN UNAUTHORISED OVERDRAFT BALANCE. THE OVERDRAFT IS ON MY ACCOUNT DUE TO THE BANK CHARGES ACCRUED IN THE LAST 3 MONTHS, WHICH WAS £99.00 AND HAS NOW ESCALATED TO £399.84. SHOULD I PHONE THEM??????? AS THE LETTER IS FROM THE WOOLWICH , AND IM SURE THAT THEY DONT KNOW ABOUT THE COUNTY COURT PROCEEDINGS??. WHATS THE BEST OBJECTIVE TO TAKE ???? THANKS DICKY6.
  11. hi all, ive at last resorted to the county court to retreve my bank charges, claim issued on the 19th october 2006. sent by post on the 19th october 2006 deemed to be served on the 24th october 2006 defendant has untill the 7th november to reply court case number 6QZ75015 NORTHAMPTON COUNTY COURT. wil keep you posted on the outcome. p.s. my brother issued a cc order to nationwide,a few days later he recieved a letter disputing the claim, then on the same day, paid in full (£5000) plus over a £1000 compensation etc. this is what prompted me into me issuing my cc claim. thanks to all that work on this site.
  12. Upon reading a few threads last night, i am posting a letter granting the Woolwich 7 days in which to reinstate all money taken from my account, or a court order will be issued. Lets hope that does the trick.
  13. Thanks for the advice, i will do just that and send the final letter on the 27th april 2006.
  14. 20th march 2006. Went into local branch (8 miles away), and asked for 6 years of statements, only to be told thats going to cost you, well they wanted around £400. Phoned the head office later that evening and once again told that its about £400 for all my statements. stating that under the DPA disclosure request i would pay no more than £10 he dissagreed with me, then after having a word with "the statement department" for about 4mins, he came back on the phone and said that they agreed to £10. He said that £10 would come out of my bank account. after 4 days no money went out of my account. 24th march 2006. I downloaded the DPA request form, enclosed a cheque and sent it recorded delivery. 3rd april 2006. Result! all bank statements for the past 6 years turned up. 10th april 2006.
