Well today I got home and found two letters - one from Student Loans offering me £256 back (the sum of the charges they took but without the 8% interest I'd claimed) plus the return of my subject access fee, and another one from the courts with the particulars of Student Loan's Defence. I'm a bit annoyed that SLC is offering to settle without the interest at this stage. Earlier on, that's fine, but now it's nearly got to court, I'm not happy about not getting the interest that amounts to around £100. What do you advise? Am I pushing it to say I won't settle without the interest? I mean, I'd rather not go to court for the sake of a mere £100. It's more the principle. I don't really know where I stand with the 8% statutory interest anyway. I've been told you can only claim this when you actually enter a court claim, not before. In that case, if I settle out of court, then I can't really claim the interest anyway? What's anyone's advice?
  2. Hi, I have a moneyclaim order out against Student Loans Company for £246 worth of charges plus interest. I checked on the Moneyclaim website today as their time to put in a defence is running out (up on Sunday) and I see they have entered a defence. Has anyone else had this experience? More to the point, has anyone got charges back from SLC without going to court? I'm hoping that the defence will just be a bluff and there'll be a letter at home waiting for me offering me my money back, but I'm not counting my chickens!!! Any advice?
  3. I've just served a Moneyclaim order on them - it was deemed served this Monday. Claiming for around £400. It took months to get the data protection stuff from them and they ignored my prelim letter and passed my letter before action onto Honours Student Loans who I also have been claiming charges back from. Student Loans Company owe me £400 and Honours £195. Honours won't take any responsibility for the old loans with SLC so it was incorrect of them to pass the letter on. I've had no response back yet from the Moneyclaim but fingers crossed.
  4. Hello, Does anyone know if I can start proceedings against The Student Loans Company through Moneyclaim? The reason I ask is that the company is based in Glasgow and in order to issue a claim online, you need to enter a service address in England. Is there one or do I have to approach Student Loans through the Scottish legal system? If so, how do I go about this? Thanks

  7. Further to this, I've just been reading that you can only apply the 8% interest once you file a court claim, not at the Letter before Action stage. Does this mean then, that if RBS has settled the charges in full but has refused the 8% interest and Subject Access that I have no right to take them to court for the interest? Seems strange that the Court says I'm entitled to it but I can't ask for it if the bank settles the charges before the court claim. Can someone clarify this please?

I received a letter from RBS on Friday in response to my Letter before action offering me the full amount for the charges on my old credit card but refusing to offer me either the interest I've asked for or the return of my £10 Subject Access Fee. They actually enclosed a cheque for £364 in the post. What should I do? The interest at 8% which I asked for - the standard amount I could claim for in court amounted to £166 so this is a substantial amount of money. The reason they gave for not offering it suggested they misunderstood what I was asking for, despite my having included a schedule showing the charges and interest. The letter stated that I had incorrectly worked out the amount I had been charged for interest on the fees and they were giving me that back - about £3 - whereas I was actually asking them for my interest on the money I would have had if they hadn't have charged me, if you get my drift. I am entitled to ask for this aren't I? And for the subject access fee? Can someone confirm just before I reply? I want to be sure I've got my facts right.
  9. HSBC closed my account but only after I claimed for a second lot of charges, not after the first. In fact they very helpfully pointed out to me exactly how much they had charged me over 6 years themselves when I sent a letter asking for a mere single £30 charge back. On that occasion they paid up with £1850. Unfortunately, when I claimed for a further £150 applied to my account after they had agreed to pay up, they gave me the full amount but a week later I received a letter telling me that my account would be closed in a month. Still, it was worth it to get nearly £2k back.
  10. Today I received an offer letter from Marbles's solicitors offering me the full amount if I sign a confidentiality clause. I don't want to sign the confidentiality clause and I am thinking of crossing it out before I accept the offer. I know others have done this and the bank still paid up but I'm not sure whether to risk it. Any advice?
  11. I have started a Moneyclaim against marbles for £175 charges + £30 fee + £31 interest. The claim was served on Monday and Marbles acknowledged the claim today. Based on others' experiences, what do you reckon the next step is? Are Marbles likely to defend or will they settle?
  12. I thought I saw a 'pack' of the documents that you should use to defend yourself in court here, complete with paragraphs taken from previous cases. Now I can't find it. It was a free pack you could just download. Does anyone know where I can find it? Failing that, specifically what documents do I need to defend my case?
  13. Hmm, that's the address I sent my SAR to. I've heard absolutely nothing back and I first sent it on 11 August with follow up letters on 9 October and 18 October. I made a complaint to the Information Commissioner and sent a letter to Honours to tell them I'd done so but still nothing. What do I do now?
  14. I have filed a Money Claim against Marbles which has been served. Today Marbles rang my house phone and my boyfriend took the call and said I'd phone them back. I see they have gone to the trouble to look up my house phone number since I have never given it to them! My question is - should I ring them back? My gut instinct is that if I do they will try and bully me out of taking them to court or perhaps they are trying to find out if I know what I'm talking about and if I'm likely to win in court. I would rather correspond by letter. Would it be acceptable for me now to write back and say that I'd rather all correspondence relating to the case was by letter so that I had hard copies? What does anyone think?
  15. That's the address for the Student Loans Company. I've sent a SAR to them too, although the data's been sent back to them as it got delivered to the wrong address. Typical. The address I'm looking for is for Honours Student Loans who are a different company who took on some of SLC's debts a couple of years ago. Has anyone got their address to send the SAR?
