Sent my prelim to marbles on 27/11/06, received a letter back within a few days saying they have looked into the matter and are not refunding any charges back. Sent my lba on 30/11/06, again I received a reply within a few days, this time offering me a good will payment of half the amount of my charges. I refused saying I would only accept the offer as partial payment and would commence my court claim if I did not get the full amount. This morning I received another letter offering me the full amount...result!

I have received a letter from DG solicitors this morning saying that it feels the charges are fair and they are confident with resisting the claim in court but they are prepared to make an ex-gratia payment of £1241. The £1241 covers my charges and the court fee but no interest, so do i just send the partial pment rejection letter and still claim for the interest or is this offer worth accepting??
-
Thanks Bong, will get it sent off tommorrow, do i include ineterest upto todays date?
-
I know, it'll be all worth it in the end though. Ive sent the schedule of charges to hsbc but not the spreadsheet with ineterest, is it hsbc or the courts i need to send it to?
-
HSBC have left it till the last day to file their defence which now means more waiting
-
Yeah, wasnt sure whether it would accept a p o box address but it went through ok

Posted my lba on the 29th of november, received another letter saying they are looking into it
-
Sent my prelim to tesco on 20/11, received a letter back dated the 22nd basically saying they are looking into it. Received another letter this morning with all the usual crap on it about how their charges are fair etc but the bit that baffled me is 'Whilst we disagree with the office of fair tradings legal position on credit card default charges we have lowered late payment and overlimit fees to £12. It is not our policy to refund fees that were previously charged at a higher rate. Prior to 2004 our late payment and overlimit fees were charged at £10, under our current level of charges, and so do not qualify for a refund. From 2004 or charges rose to £15 and therefor to bring this matter to a resolution i have today refunded the difference between those charges and our current charge of £12. These refunds will show on your next statement' Right well for starters, this account is now closed so i dont know why the idiots are putting the refund on my account but my concern was can i claim for these charges of £10 that are under the £12 guidelines??? Id be greatful for any help on this, should i go ahead now and send a lba for the whole amount of my claim?
-
I sent it to p o box 6050 southend on sea ss99 1wl

I have received another letter from MINT this morning basically saying that charges and fees were clearly and consistently communicated as part of their published tarriffs and that they have lowered their fees to £12 but it is not their policy to refund fees that were previously charged at a higher level and therefor the charges on my account will stand. So do I send the lba now or wait till the 14 days from my 1st letter is up??
-
Really, thats surprising. So did you give them thet 10 working days to get back to you as they requested or did you stick to your 14 day deadline and go to the next stage?
-
I have received a letter this morning stating the following "we are sorry that you were less than satisfied with the level of service you received from us.Thank you for letting us know your concerns as it gives us a chance to address the issues raised. we need more time to look into matters further so we can answer your concern fully. We will contact you within the mext ten working business days to let you know how we propose to resolve things for you, or at least let you know how we are progressing." has anyone else had this letter? Is it the bog standard reply?
-
Well I have received a 'notice of acknowledge' letter this morning from the court saying that HSBC now have 28 days to file a defence
