  1. No one in the group was asked to sign a code of conduct or to submit a credit card for damages as a condition of entry. I need to show that under their t&c's they cannot make our lead booker accountable for illegal actions of others(vandalism). The police accepted they had the two correct people, Butlins let the rest stay as they were totally not involved. Any help really appreciated....
  2. Hello all. Last month i went to Butlins with 6 friends for a three day weekend. Sadly, and stupidly, two of the friends trashed their room whilst drunk and caused £3,000 worth of damage!!!!! Needless to say they were sent home the next morning, but the others had no involvement and the friends owned up to committing the damage and butlins accpeted they were the culprits. After one month being back they are trying to tell the leader booker he is accountable for all the damage and has to pay now!! Now the lead booker is the nicest bloke you could over meet, had no involvement in the damage, was not asked to leave and butlins were happy they had sent home the correct people. The two people who committed the damage have admitted this to the police, butlins security and management, but they are still only holding the lead booker accountable. I've tried reading the t &c's for butlins and don't think they can do this, but not quite sure. I also did not damage anything or get send home, but feel so sorry for lead booker who is getting all this stress from no action of his own.   3. Ok, These issues are never straight forward. I agree with Gyzmo in that the insurer should be held accountable for the substandard work. I would write a complaint to the insurer advising of the substandard work including pictures of the damage and two estimates to rectify. Once a complaint has been submitted, the insurer has strict guidelines to follow and times scales to adhere to. You can try the loss adjuster first, as Gyzmo advises, and hope they understand your position, but i see the complaint process being the natural route. Although im sure everyone on here would be of help the best action to start with, is to contact the insurance ombudsman technical help line. This helpline basically advises people on how the Ombudsman would deal with the claim if escalated past the complaint process to them. If you not au fait with the ombudsman, please see the link below: Every insurer is bound by the decisions of the ombudsman. So will near always settle if it thinks the ombudsmans will side against them and you would not believe the types of cases that go against insurers. I feel, after a few years experience, that they side more with the insured then insurer. Financial Ombudsman Service 020 7964 1400 tech line. Step 1. Notify insurer of damage and advise require loss adjuster to inspect substandard work. Step 2. If they do respond await their findings, if not, send complaint letter after discussing with ombudsman if he feels you have a chase(i do). Let me know what happens next....need any more help just message.
  4. Just to add something little. Most insurers take an economic stance to chasing outstanding accounts of this manner. Depending on the amount outstanding/ and the type of insurer i.e. large insurer has inhouse solicitors, will depend on their actions if you don't pay. All insurers have an aged debt list which includes these exact type of debts owed by total loss drivers who neglect to pay the oustanding premuim. Also, insurers terms and conditions are never perfect. I should know, i interpret wordings most days. If you advise me of the insurer(can check their t&c's) and how much outstanding, can give you an idea whether you can get out of paying. Please note the above is only my opinion and is not set in stone. Hope helps......
  5. Thanks Brindle for the link. Good info, but read already. Looking for help in regard to enforcement of CCA's against people if the contract was taken out with a minor(17yrs) and if accepted, that the CCA is unenforcible. Also could be default be removed ??? Any help appreciated on this aspect.... Im off to find insurance threads to help!!
  6. Hello all. Need some help if possible? I recently requested my credit report from Experian to see who bad my debt was, and why i could'nt get any credit. On review, i think the reason is obvious. I have never had a default before, and normally maintained my accounts in good order(well missed a few payments here and there, but no ones perfect) and found 3 defaults in one month!!! Couldn't believe it. I've moved loads over the last two years and obviously not been paying the right attention. I have two big questions to ask... 1) Two of the defaults refer to store cards taken out in arround 2002 when i was actaully only 17. They used my solo card to validate my application. Is the account enforcible? and is it a breach of the consumer credit act to engage in a contract with a minor? also, if the contractor is in breach, can i make the creditor remove the default? i don't have an issue with settling the debt, well alittle, just really need to get the defaults removed. Any idea's/responses would really be appreciated. 2) The last default is for a tv rental contract in late 2007. Im being chased by Credit Security Ltd for the debt, which is only a few hundred pounds. So far i have contacted the rental company and offered to: -settle the debt in full with one payment in a weeks time if they will totally remove the default from my report(not just change it to satisfied). They advised will consider and advise within a week. Any help or advise would greatly be appreciated. Also, as a claim handler for an insurer, more then happy to provide advise(morally correct of course lol) to any one that needs help. All the best and hope to speak to someone soon.....
  7. Hello Wrote my decline offer letter, thanks for yours, then faxed it over to them. Also rang and they confirmed receipt. Im starting to get very excited that money will help buy my first car. So do you think they will settle before AQ then?? i hope so, another £100 court fee in January would make this month very tight. O, forgot to put this on other day. Got letter from HSBC informing me i was being charged £66 for going overdrawn in December, Damm them!!! I gave them a call and demanded they withdraw the charges and got the ole rubbish about policy and breaches of contract so spoke to a supervisor and informed him he had two option 1) charge me and i put in a court claim next day for recovery of charges causing them court fee of £120 on top of my £66 back or 2) take them off. He hestitated for a min then said on this occasion will remove. From now on its going to be every occasion!! I think im nearly there, it only took 2 months and actually been really good fun learning all this new stuff and obviously talking to all the great people on this site. speak soon. o help on AQ query appreciated.
  8. Had a letter this morning from D & G solicitors, same old letter but offering £1960.00. total claim is £2200 at 8% but i've been going for contractual and claim amounts to £2550. My AQ is due 12th January. Should i decline and pay AQ and if i do will i get it all in the end ??? or is this the best i can get??? help appreciated. thanks
  9. Hello all, Sorry for not updating sooner been a very eventful month for me and recovering charges. Submitted claim to county court back on 24th nov, D & G acknowledged within 4 days and sent an offer for £1400 which i think was a good opening offer. Turned this down and a week before defence due on 15th Dec had another offer of £1700 i reluctantly turned down this offer as well. Hoping for something closer to my claimed amount detailed below: Charges £1684.00 Debit interest £127.25 Court fee £120.00 Contractual interest(15.9%) £606.35 Total £2537.60 HSBC have now entered a defence same old nonsense as their sending everyone else. Have also received AQ which is due 12th Jan. To try and speed up claim, tried ringing them yesterday to discuss but their's one man in their office til 2nd Jan who is just taking messages. Ooo, it took me ages and alot of discussion to get these numbers for D & G Solictors and other HSBC numbers. 0121 455 2206 0121 455 2660 0121 455 2111 (Debbie) 0121 455 2196 (Katie) HSBC legal department in London 0207 9117154. HSBC leeds office:0800 88 11 55 or 01226 261020. Now i need some advise should i just submit AQ and await further offers and court date or ring and negotiate on the 2nd?? Also, i'm going for contractual interest, has there been any successful cases against HSBC for this??? Should i settle or can i get the whole lot. Help would be very much appreciated. regards, Phil
  10. Hello, 4 days from issueing MCOL, its getting closer and closer to sweet social justice. I'm more looking forward to winning(David VS Galiath) then actually getting any money. Ive completed most of the N1 form but not sure on some points i.e. filled in the partuclars or claim with help from Bankfodder template but what goes in "brief details of claim". My biggest issue,!!!!! i started the claim with an idea of claiming the 8% when i issue, but after reading some interesting threads i learned a lot about contractual interest. HSBC's interest is 15.7% and i want to claim this, read else where needs to be included from prelim stage, can anyone advise on this?? can i still add to MCOl if not included previously as is normal course of action when claiming 8%. i really hope i can as diff of bout £300 on claim!!! any help would be greatly appreciated.   11. Hello all, Well, had no response to the prelim so sent the LBA on the 4th Nov. Getting close to issueing MCOL now so looking for some assistance from the greater public on some issues i have. Ive tried editing the complex spread sheet to work out contractual interest of 15.7% which is HSBC's rate instead of the county court 8%. 1) can i apply contractual interest instead of 8%? and is my formula correct, and if not what should it be? The correct formula for 8% is =(C9*0.00022)*E9 The formula for 15.7% is =(C9*0.00043)*E9 I'm also trying to add debit interest to debt but not sure if doing it properly, used complex spread sheet, put in all details requested but not sure if correct.Also, no section on it to add interest on penalties for MCOL. Is it possible to email to somebody to check for me please??? Im starting to get a bit excited by this whole process. Nearly as good as getting income tax back. Does any one know how long and when HSBC normally settle?? If any one can be of assistance, much appreciated. Best regards.

Hello all I have recently become a member and have actively read alot of the information on the site and now feel im ready to pursue my bank for recovery of their ill gotten gains (bank charges). As some forums had mentioned, if you ring up HSBC they will send you the statements for free and it's quicker then sending the Data protection letter. Well that was 20 days ago and after getting back from paris yesterday i had a letter waiting. It looked alittle too thin to be 6 years worth of statements!! and unfortuanatly was a standard letter informing me the statements will be dispatched shortly in batches. Well im very lucky then, that after reading further threads a couple of days after the phone call i learned that on the HSBC site you can print all the statements off for six years!!! Only people who have got the high lighter out and selected all the money that has ever be taken from them will understand the absolute great feeling it brings, especially when you see the total. After 6 years of banking services i have been charged £1642 in overdraft charges. My Prelim was sent on the 18/10/2006 and as of yet have not received a response!! So in anticipation of no letter being received i have readied the LBA letter. Just a few questions if anyone can be of assistance. Can they offset the settlement against my outstanding loan with them? Should i include interest with the LBA or wait? What is the difference between issueing online and going to court in my area. Any help would be appreciated including comments regarding the whole process. Best regards, Philip
