  1. :)SFU I couldnt have done it without you and all the other people on this site, if we ever meet in another life the drinks are on me:) I have already emailed the sols asking for removal of all info from credit file and am waiting a reply. I have got to get the agreement to them today as the court date is tomorrow! As usual when I need it scanner has packed in but will type the full contents of the letter later.....Once again...........many thanks

Hi SFU................submit ted my rule 22 as above and got theirs in post of tuesday.................. .now today i have received another letter from them saying On a purely commercial basis and without admission of liability the court action will be dismissed with no expense to either side. This is in full and final settlement of all claims past, present and future..................A m I dreaming?

  4. SFU once again thanks for all your help.............R22 submitted today to court and solicitors, court admin closed today and tomorrow due to industrial action so hopefully will still count as being in on time!!!

Thanks for that SFU..................I have been working out the charges on the account from the statements I have from Feb 04 to Oct 06 and between interest, PPI and late fees its currently around £5000. As the account has been going since 2001 there are obviously other charges but I dont have copy statements. I have also noticed that this Monday is the last day for intimiating, together with your grounds a note of any premliminary pleas. I have been on scottish courts websites and CAG for days now and dont know where to start with preliminary pleas! Should I be responding to solicitors amended pleas. Also in the letter from the Solicitor it states " we enclose a copy of the argrement we intend to rely on" which in my opinion does not comply and I dont believe the t &cs they have provided relate to the application form. I know the decision is mine but am thinking that if I was to "intimate a preliminary plea" by Monday it might make solicitors more willing to either give up or accept greatly reduced settlement. I would really appreciate some advice on premilinary pleas!!! Thanks

Hello again, I have received the attached from Link's solicitors together with a letter which states that "on a purely commercial basis and without admission of liability their clients may be prepared to accept a reduced amount in settlement. If i have any offer to make they will take instructions from the client. Now from my reading of the this they are sticking with the terms and conditions they originally sent but I am not sure that they are the right ones. I have been reading it over and over again and on the application page it states that Data Protection you must read condition 11 in the terms and conditions provided, however, the terms and conditions provided with this range from 1.1 to 2.4! No condition 11. I know that the the next move is entirely up to me........but would welcome advice and comment from the people who have been there already. Thanks for reading. scan0001.pdf

  8. SFU you are a star......I have just sent defence by special delivery to both court and solicitors. I have spent most of the day on here and internet trying to find a plea in law for ppi without success.....and then I got locked out for the past hour. Everything now crossed that I have done it right and await the outcome. It is like a huge weight being lifted even just to get to this stage which I could/would not have done without the help and advice of this site. I will keep you all posted. Moragh
  9. Hi everyone and apologies for not being on very much, I do not have internet access at home and am reliant on the good nature of a friend. Not a good time of year to hog someone elses computer! I attach draft defence which I have put together with assistance from SFU and other postings on this site. I would really appreciate advice/comments as tomorrow is my last day to get this in. Should I take out the references to PPI? even to my mind it looks like I am contradicting myself:confused: Any help/comments/advice greatly received as I have spent days reading posts and think I am confusing myself. 1st Draft.doc
  10. Hi all and thank you for your input its really appreciated. I have been reading and reading all sorts of posts trying to come up with a defence based on other peoples experiences and am still working on it. (BTW last day for lodging defences is 7th Jan). I have based my defence of seriously Fed ups advice but given the recent case MBNA lost on misselling PPI, wonder if I can use something along those lines...............or am I being completely thick and by doing that therefore admitting the debt??? Maybe someone with more experience in this can advise on this........at the bottom of the letter it states......... failure to comply with any of the rules 9.3, 9.4 9.6.9.10,9.11 and 33.37 (1) of the standard procedure of ordinary cause rules by the sherrif court or where applicable rule 33.37 (decree by default in family action) decree by default may be granted in terms of rule 16.2 (2) of those rules:confused: Unfortunately I have very limited internet access at the moment but please be assured I am determined to fight this and welcome all suggestions/assistance to help. I have submitted the form 07 together with £80 and also sent a letter to the solicitors requesting all the data they hold including PPI information (from a letter I found on here).   12. Many thanks. I have had a look at your thread and particularly your defence, so would I submit something similar only along the lines you posted for me earlier? and how do I claim back the PPI? I know I have been stupid in letting things go for so long but I would really appreciate some help in fighting this.
  13. Hi Ida, sorry no I dont have one. I saw a letter on here requesting all the information that the cc company hold and was wondering if I should send that together with form 07.
  14. Sorry Seriously Fed Up, to answer your question yes the front page is a full application form and the back where the t & c are is about a third of the page.
  15. Excuse me for being a bit thick but I have to put the full defence in by Thursday not just form 07 together with £80?
