  1. Hi there was posting in the wrong section about my claim. Here is what I've done so far. Ive got all my statements and calculated that they owe me £2665 from Jn 02 to the present day - 6 years. 1 - Do i now send the prelim letter for payment and not mention any interest? I include the schedule of charges? 2 - Is it worth doing an ordinary action since the fee is over 1500? 3 - Is it worth going to a solicitor to let him deal with everything? Am I correct with this so far? Any help is greatly appreciated.
  2. Ive had a look through all the pages there. Thanks for posting them. It really looks like I will be starting an Ordinary Action. Can somebody tell me the pros and cons of doing that? Also, is it worth going to a solicitor? Anyway, not at that stage quite yet so basically I send the Prelim letter with the schedule just now? I assume this is the next step? Thanks so much for the help.It really is appreciated.

  4. I have now created the spreadsheet tonight and it actually shows £2665 inc all maintenance fees etc. Now Im going to attach it with the Preliminary Letter. The line in the template says plus overdraft interest. I assume I delete this and have only the £2665. Just to confirm this is definitely the correct letter for Scotland? "I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX . I enclose a schedule of the charges which I am claiming with this letter."
  5. Thanks for the help people. Ive looked at the spreadsheets. On my statements I have two types of charges. A £20 one, a £28 one and an £8.50 maintenance fee that says for instance: "charges to 4th Feb 8.50 maintenance fee" Do I include all of the above fees on the spreadsheet? I assume the interest that is to be calculated is the amount I would have earned if the bank had never charged me? I also assume that I leave that out in the PRelim letter I am about to write.
  6. Hi there everybody. I have finally got a list of my charges and calculated that it is about 2400k that I can claim but I am extremely confused. I don't know what to do now. I think I have to send a prelim letter with a schedule of my charges attached but again got confused with the spreadsheet. Can anybody tell me an idiots quick guide of what to do? Ive been reading for hours and Im getting nowwhere! PS Also, is it 5 years in Scotland I can claim? It is the interest part that Im stuck at when filling in the sheet! What interest etc Thanks anybody for their help!!!!
  7. Hi there everybody, posted myself in the other thread and never realised there was a Scotland section!!! I got all my statements through since 2001. I have been reading on this site for about a week now trying to get my head round it all! I calculated all the charges up since 2001 and they came to £2400! I have a few questions that I havent came across the answers for or have got confused. Help is greatly appreciated. 1 - I have calculated the £20 charges and the £8.50 maintenance charges I have recieved each month together. Are these both allowed to be claimed? 2 -Am I correct in saying that I send out the Preliminary letter with the schedule next? 3 - How many years can I claim back? Ive seen 5yrs, 6yrs even 20 yrs! Just confused me even more. Do I claim from the 5? yrs to the day of the prelim lettter send out? 4 - I also have an overdraft, If I get all the charges back will they reduce my overdraft or even close my bank account? I would appreciate anybodys help on these queries I have. Thanks a lot! Think this will be a big donation from me if I win!!!
  8. I have just calculated from my statements that I have paid 2400 in charges in the last six years. Now Im sending my preliminary letter to try and recover the charges! I am attaching the schedule with it! Heres hoping!!
  9. Thanks for the help. They have now sent me all the statements and I calculated the last 6 years worth. It came to £2400!!!!!! I cant believe Ive paid that amount!I am now going to send the preliminary approach for repayment with a schedule showing the charges I am claiming for the last 6 years. I take it this is the proper way from what I gather from the FAQ etc? Again, thanks a lot
  10. The thing is, when I originally sent the fee they credited my account back with the money saying that they did not charge for this information. This is what is confusing me as to what to do. A few days later iis when they sent me the offer of 580.
  11. Hi there again. Thanks for the help. Its very much appreciated. Let me get this straight not sure if I understand what you are meaning. Step 1: I should call customer relations and ask them where my statements are or Ill start to take action. Step 2: I send the very first letter again with the fee for the statements giving them the 40 days?
  12. Hi there sorry guys I realise I didnt read the FAQ properly to begin with and this must seriously **** off you guys. However, I have read it now and am looking for your help on what I should do next. So far I have done the folowing: I sent a letter (used the template asking for transactions etc and enclosed the cheque) - The subject access request They then replied saying they did not charge for this information. A few days later I recieved an offer of £580 I wrote back neither accepting or refusing but telling them they had not complied with my request. This is the LBA I sent. I did not use recorded delivery on this one so I sent another letter the same telling them they had a certain number of days to comply so I sent that one by recorded delivery. ------------- I have not heard anything since. I realise I did not read the FAQ properly but would greatly appreciate anybodys help!
  13. Hi there people thanks for taking the time to read this. I have sent the first letter asking for statements etc and immediately recieved a letter back from them offering me £580. I sent them a letter back saying that they still had not complied with my request by giving me the statements so that I could calculate. I didnt hear from them for ages and then sent the Letter before action and I have not heard from them for over a month. I realise I may have done parts wrong but what can I do next?
  14. Ive typed in the postcode of my branch into the data protection register link and there are a few businesses that come up but not my bank. Can I send it to another branch or a main one? Please help!
  15. Does it matter what types of transactions that have put you over your limit? Eg CAn you only claim for ones that are failed Direct debits. I have had charges because of failed Direct Debits, Internet transactions, online gambling transactions, general transactions when the shop has not taken my money immediately etc. Basically can I still claim? Thanks for everybodys help
