  1. I'm sure someone must know where I can find the list of LLoyds cases to back up my request ??

  3. I'm just printing off a letter applying for a recent stay to be removed (hope it's the right one lol) but I can't find a list of lloyds cases to back it up ?? All the letters I've found state 'I attach a list of 223 test cases etc etc etc', but I can't find it !! If someone could point me in the right direction I'd be soooooooooooooooooooo gratefull !! Liz

In the particulars of claim ...it says '.I am claiming the return of money taken by the defendant in the way of charges over the last 6 years of ** do i put the total here or total before interest ?** plus interest under s69 of the County Courts Act 1984 at the rate of 8% a year of ** what goes here**' Plus do I add a peice about the daily increase ?? and where does my compound interest bit go ??

Ok, well that makes sense, I just wanted to make sure I wasn't wasting my time by writing to them, 50/50 is good enough for me, 'if ya don't ask ya don't get' (thats what my Nan used to say lol). I have 5 satisfied (1 that isn't) and even if I can get 2 removed it has to be worth the hard work (which I'm more than happy to do, just wanted to make sure I'm travelling in the right direction). I totally understand your frustration, and hope that I didn't come across as 'one that frustrates' ? Thanks for all your help. Theinymajig
  7. No worries, and thanks for the info. I have a few 'settled/satisfied' defaults on my account, and will follow your advice for those also. Am i right in my understanding that if a default is satisfied i have a good chance of getting it removed from my file ? I'm also wondering, if I have closed accounts (with no defaults or missed payments) is it worth trying to have these removed from my file even though they aren't 'bad', and if so how would I go about it ? Sorry for all the questions, u guys must hate newbies ?? Theinymajig
  8. I'm not trying to avoid paying what I owe, I truly thought the debt was satisfied..... and after 4 years with no communication to the contrary, I had no reason to believe otherwise. After phoning them (which lets face it I wouldn't have done f I thought I owed them money as the default leaves my file in 18mths anyway) he pointed out that there was still a debt. I now intend on making full payment should they be able to prove that I owe it, however I made an offer in hope that it would be an easier and quicker way of rectifying the default, and possibly would be cheaper than me fighting it all the way. On the flip side, yes I would love to see this default removed from my file, especially given the fact that it seems to have come from the fact that I was unaware of the outstanding balance.   9. I'm very new to this, so my appologies if this is not in the right place, and if I waffle on a bit, but here goes.... I'm currently in the process of reclaiming my bank charges, and decided that I would use the money to clear up any final debts I might have, so I aplied to Experian for my free 30 day trial. On looking through the report I found a Defaulted account with Vodaphone, with an outstandng balance of £170. I was under the impression that this debt had been cleared years ago, and so decided to call them. They eventually found my account, and explained that the debt had been sold on twice, and then passed back to them as I had made a few payments and then defaulted on the arrangement. (I explained that I thought I had finished paying them off, and as I have had no correpondance from any of the companies for 4 years I had no reason to think otherwise). I told the guy that I just wanted to clean up my credit so would be willing to pay it off. I offered them a one of final payment of £70 (later upped to £85) which they flatly refused saying that they wanted payment in full. (How many people do they have calling them after 4 years to clear up a debt ? thought they may have a little 'goodwill'?). They asked me to pay £56.?? a month for 3 months, I said I can maybe stretch to £15 (I had every intention of making full payment by the end of the week, just didn't want to be forthcoming). They accepted (with T&C's which I refused, but thats another story). Anyway, although I told her I'd make a payment immediately I haven't, as it occured to me that if they haven't written to me for 4 years, then they must be extremely dissorganised, and maybe they no longer have my signed agreement? Which I believe would not only mean I don't have to honour the debt but that they would also have to remove the deault ???? I wonder if anyone could clarify this for me, and maybe point me in the right direction of a primary letter, as I have no idea where to start ??   10. hi i have phoned again and they are adament that the debt has to be paid with in 6 month. As i have no way whatsoever of doing this is there anything i can do? i have offered them an arrangement but they are not budging.
