  1. Hi Bigmac versus My son is pursuing a claim on each of 3 separate accounts. He has sent the letter threatening court action and is waiting for a reply. In the event of actually having to file a claim, should he file 3 separate claims at SC court? He would be dealing with Kilmarnock court like yourself. Thanks
  2. My son had asked for records of 3 bank accounts. He has received a letter stating that the accounts cannot be traced due to lack of information even though he stated the account numbers and the name / address of his local branch in his initial template letter.He is now being asked to provide dates when the accounts were opened and closed and also the sort code for his branch. His cheque has also been returned with his initial letter. He will send the letter again, including the extra infromation. Should he update the date on his letter? As the cheque has been returned can he state that the 40 days are from them receiving his first DPA request or will it start from the date of his new request? I feel these are delaying tactics being used as I am quite sure that his initial details should have been adequate! Can anyone advise please?
  3. I have another question. If taking out an ordinary action and the bank pays up before it gets to court, who pays solicitor costs?
  4. Can someone please verify? If claiming through a summary cause action or an ordinary action, can you claim back 5 years or 6 years under scottish law? Also, if claiming back charges of varying amounts for 3 accounts si it better to lump them all together in one claim or keep them separate? Thanks

  7. Hi I'm new to all this and am only at the first stage where I'm going to ask for copies of the statements from the bank. I know I have to include a cheque for £10 but as I am asking about 3 accounts does that mean I have to pay £30? Also, in Scotland the small claims court only deals with money up to £750 and my claim will be for more than this. Who do I threaten to contact? I hope someone can help. Thanks:confused:
