  1. So i have four seperate claims agains Barclays, two currently have a bar on them against judgement/enforcement. The other two, which are for smaller amounts; £1300 and £140 have been transferred to my local court and they have filed a defence. In brief their defence is: 1 That we need to prove each charge and the date 2.their terms and conditions gave us notice of the charges. 3.we breached the terms of our contract by going overdrawn 4.they deny that the charges are unlawful or breach the unfair terms in consumer contracts 5 The charges are and remain lawfula dn therefore the claimant is not entitled to a declaration by the court as to the enfiorcability of the said charges 6 the defenant suffered loss and damage as the result of the claimant going overdrawn and accordingy in the extent that it is unable to rely on its express entitlement to enforce the charges as set out... it will seek to recover to the extent necessary such loss and damage it actually suffered, which will not necessarily be limited tio the value of the said charges and the defendant seeks to set off such sums agains any liability owed hereunder to the claimant. Its quite lengthy so I just tried to give you the gist of it. Attached was an allocation quastionaire which i need to fill in. Questions then please, as i have to admit I am getting a little worried now, though My husband will happily go to court if necessary (its in his name too) Is there anything I should be writing on the questionaire before I send it back? Has anyone else received something like this? Do you think it will go to court Would it be better if I wrote the whole defence out in case I missed something important. Very grateful for any help or comments please?

  3. Thanks everyone so far, also the notification of refusal dosen't say what to do next, or how long to wait, the guy I spoke to at the claim centre was unhelpful to say the least, but there must be a new deadline for me to aim for if I don't hear anything?

  5. I have sent four seperate court actions in motion against Barclays, two of them they have filed and acknowledgement of service for and i am waiting for the deadline to run out. The other two i herad nothing about, so when the deadline ended I requested judgement. The next day I checked it again online and it said the judgement have been rejected. When I rang to ask why they said it was beacuse Barclays had put an application to the court to have the claim stayed? Does anyone know what thay means? Then today I received the notice of rejectment which says a bar on jusgement/enforcement is in place - contact CCBC:confused:

Hi there everyone, my claim is with barclays, i've got to the stage of sending four seperate claims for four accounts we had with them, total is about £6k to claim back, we were obviously very poor in our younger days!. Notice of issues were 14th September for all of them, the only thing I have received since is an acknowledgement of service for one of the claims on 19 september, saying that they intend to defend all of the claim, so I am just checking, thay if they do not file an acknowlegement of service for the others do I ask for judgement on these after 3rd october and for the one they say they will defend, do I wait 28 days from 19th september?
