  1. thnak you harrassed senior ok in response to my first letter they sent me a statement, with no name or details other than an account number and various transactions..3 of which are item purchases, one shows a return and the rest of which are charges for letters sent etc. i still have no memory of this catalogue (nor even know which catalogue they are claiming it to be, just know that when capquest were harrassing me for it i googled jdwilliams to find they were catalogues) cannot understand why i wouldnt have paid it if i had bought stuff (it was only 15quid) and i moved a month or two after the items were purchased, but had my mail forwarded for a year so i am very confident that i never recieved any of the letters they are claiming to have sent (and adding charges for) which i would have done had they been sent. i also have no knowledge of the items, and tbh theyre not something i would have bought (i didnt have a table at the time so why would i want table mats eg?). i dont think their statement is acceptable as proof of this being my debt, all its done is make me more certain this is not my debt lol i now have the template letter requesting proof ready to send (its slightly differnt than the one i sent initially) and the letter re telephone calls ready to send. should i be adding anything in about the statement not being the proof i require? their letter also muttered something about a generic credit agreement being acceptable (which they havent sent) though i would have thought i would want a signed agreement? thanks for any help
  2. are hassling me. for a debt i have no knowledge of, which capquest and their soliocitor for rent lackeys tried to harras me for a couple of years ago (im sure was 2008). I thought i had a thread here but cant find it. i knwo i sent them a letter saying cough up some evidence i owe this debt or clear off 9most likely downloaded form here) and they wrote back kinda saying sorry, not you after all or maybe someone used my name and addy frauduently, and have left me alone ever since. earlier this year i had letter from uk search limited saying i owedmoney to jdwilliams magazines (i had never heard fo them til i investigated the capquest lark). i sent the letter id sent to capquest, but adapted to correct details for this lot etc. they sent back a letter saying they did not have to provide an actual credit agreement or some such crap. well i cba and decided to ignore it. i want actual proof i have a debt to these people or they can clear off. have also had a letter form picasso. this afternoon they rang my mobile...seems they where the 01246 number that has called a few times. i told him he hadnt sent me proof of the debt, so he put me on hold and my battery died cutting me off. i intend to tell them to quit harrasing me, that if i recieve any more letters or phone calls form them or their ;lackeys without proof of what debt he is talking about i will take legal actiopn against them for the harrassment......i assume i can do such? i really cba to deal with this for a debt that capquest couldnt proof 2 years ago, that i have no recollection of or any such thing. if i remembered it or was sure it was mine id just pay it... umm that was rambly...any advice?
  3. last year i had hassle form capquest over a debt they claimed was mine. following advice i wrote to them asking for proof of the debt and got a letter back saying they believed someone had used my name frauduently and have heard no more form them since. i recently checked my credit reports with experian and equifax. equifax shows that there is a table one search showing up by capquest in april 2008 liked to my previous address, and the reason is stated as unfufilled ddebt. i sent an email to equifax stating that this search was incorrect as capquest had not identified the debt as mine. they replied saying that "other searches" do not show up to anyone other than me and stay for 2years. however i understood that table one searches did show up? (there is also a table two other searches search reason being unclassified by capquest in april 08 for my current address). could someone please be so kind as to explian this to me, do i need to contact caquest and get them to remove it? can lenders see it and assume i have debt that has not been fulfilled? i cannot get my head round it though im sure the answer is something obvious i should know. thanks in advance.
  4. natwest charge referal fee(for something they paid even though the money was not available)/unpaid item fee(when the return or bounce a payment) one month, then the next month a fee for being into an anauthorised overdraft either because they paid the item instead or bouncing it or because they applied their charges which sent you into an not agreed borrowing.

  6. yeah this forum has expanded massively since i joined, i remember being told by family to be careful of an unknown website lol. thanks for the push re claiming again btw....clearly i need to get that started regardless of whether i can be made to fit hardship rules or not so its ready to go when a decision is made if not before. this weeks task is figuring out how much the process has changed
  7. since my last claim for charges back, which was filed on 25 oct 2006 and paid out in jan 07 there have been a total of 7 charges applied to my account. ive ignored these until now. currently there are charges totalling 180quid due to go out of my account ont he 11th sept, for returned dd's in august as one unexpectedly (because i wasnt opening mail) went out at triple the ammount it normally is. now everything is caught up again and back on track for me not having more dd's bounce EXCEPT i cant afford the charges and if they are paid will end up with more bounced dds. i spoke to natwest who said they cant and wont do anything about it, so its time to claim charges back again as im going to end up in a vicious cycle of charges i cant afford leading to more charges i cant afford. i live on my overdraft, limit is 2400, and recieve benefits including dla. until last month the last charge out of my account was in may 08, and the total since sept 06 is 132 (plus the 180 going on the 11). the benefits are my only income. does any of this mean i fit the criteria for a claim on hardship grounds? there has been no change in my income or circumstances recently except for benefits increase in april.
  8. well i got the game back form nintendo this morning with a letter stating it is counterfeit. they paid attention to the 10day limit i told them paypal had given me and got it back to me quicker than i expected. rang paypal again as i still have not been asked by them for proof. apparently the person who escalated the claim for me last week failed to log it as a counterfeit claim and someone high up now has to change it to that, then i should receive the email asking me for proof. so far no email. that made the 3rd phone call to payal about the matter, i am not impressed with them at all.
  9. phoned police last night who said do whatever ebay/paypal said to do. called into the station today and they said they never get involved with ebay, and suggested i take it up with nintendo. (which tbh in my area doesnt surprise me, they were not interested when my stolen car was seen with the same northern ireland number plate a year later) nintendo have actually been helpful, offered to send me a free post envelope to send game to them but i said i would just send it tomorrow as will be quicker. they will verify it for me.
  10. police are not interested, said its nothing to do with them. TS still waiting to see, said it might be up to a month before i hear from them. Paypal said get someone who sells the authentic games to verify its fake (no problem) on letter headed paper (big problem, stores that are prepared to do so dont have letter headed paper in local branches) then they cannot ask me to return the game as it is illegal for them to do so. on hold to nintendo atm but doubt they will be much help tbh.
  11. it has yet to be seen if trading standards will take it up, consumer direct were insistant i keep it in case ts want to see it, and said they would pass everything on to them but that doesnt mean ts will do anything i guess.
  12. recetly i bought a game on ebay (well two but one refunded instantly i complained and was already banned) that turned out to be fake. since trading standards were closed i phoned consumer direct who will report it on to trading standards. anyway seller is refusing to refund unless i send game back. i have been told not to do this as trading standards may want to see it. i have a letter ready to mail to him tomorrow, stating that i want a refund as the item was not a genuine game like i expected. (basic template taken from consumer action site). i have given him 14 days to reply to my letter, after which i am to contact consumer direct again for what to do next. they were very reassuring and said i am entitled to a refund without returning the fake (and why should i return it for him to sell to some other person?), however seller is adamant i am not and all goods must be returned prior to refund in all circumstances. who is right? thanks
  13. shrt version: Does anyone have a head office address? i wish to make a complaint. long version: in jan 2007 i bought a laptop with 3year extended warranty, which turned out to be 1 year manufacturer plus 2 year extended. fair nuff i didnt notice and should have done. in november 07 laptop monitor and wlan broke, sent of to manufacture who replaced monitor and wlan no problems. had computer for 10days. in august had exact same problems. phoned comet warranty number who said they could not do anything until i attached a working monitor for them to run diagnostic checks. after a bit of argument she said if ic ould not borrow a monitor to take it to the store and they would attach a monitor. they didnt, they merely sent it of for repair and had my computer for 3 weeks. got it back sunday. it worked all sunday afternoon then when i turned it on on monday the monitor again was broken. back it went on monday for another 3 weeks. i am really not happy about this, 1. them refusing to do anything without a monitor and 2. the fix only lasting one afternoon. (they replaced a pcb whatever that is, no mention of having fixed the wlan, and i only found that out by the girl in comet on monday ringing them to ask for me). so who do i write to?
  14. so i am buying a new laptop. the one i have selected is only available form comet or woolworths (not pcworld, not currys or dixons). comet is easier for me than woolies and its cheaper on comet so im going for buying it form them. i want extended warranty, i had it for the last laptp i bought (form pcworld) and that machine has been to be repaired 6 or more times in the almost for years i have had it. i have been happy wiht pc worlds policy and never had any problems getting them to repair faults or accidental damage. so is comets extended warranty 1. a good buy, 2. worht the money? 3. anything else i should consider? i believe as it is a hp model i could also buy the hp care package direct fomr hp, has anyone any experiance of it? is it a better or worse product than comets? any other ways of getting an extended warranty i should consider? thanks
  15. timing wise i had till the 18th jan to send in the court bundle so check will be cleared before then and cancellaions can be sent then. check is all paid in now something for others to watch for if your paying your check into a diffwerent account, on my check where they ahd written my name they had also written into account no and my account number. i was paying it into their anyway since i dont ave another account but watch out folks. (and as a by the way i am reading along on some of your threads, just being quiet) a big thank you to everyone who has offere me help and advice, reasurance and encouragement here.

  18. i had an account with midland bank which changed to hsbc. the account was closed in 2001 or 2002 ish, im not sure when. i know it was opened in 1997. is it possible i can use the dpa and get my statements wihtout knowing the account details?

  20. well well well! i just had a knock ont he door wiht an unexpected special delivery letter. from cobbets, the ful and final settlement, the usual blah about their costs would exeed but they would win and two conditions 1. i agree not to disclose to any 3rd party any details relating to the payment 2. i withdraw my claim now do i accept? or do i push for withdrawal of the first condition?

  22. im thinking of sending cobbetts an uptpdate version of my schedule of charges, since i started there have been a couple more charges applied to my account, and obviously interest as changed since then too. do you reckon i could add them on and send it to cobetts with a letter something along the lines of please find attached an udated schedule of charges, the ful ammount of xxx being the amount i would accept as settlement of this case. documents to be used in court to follow. ?? (and i downloaded the court bundle, opened it in word and it wouldn tlet me save as it is a read only file, how can i make it not read only?
