    Just to let you know that DG have finally paid up!!!

    £1250.00 credited back to my account! HURRAH!!

     

    I'm really chuffed and just wanted to say thanks to all for their advice and support, and to keep up the good work!!!

     

    Thanks again & good luck to future people trying to get their hard earned money back!!

  2. Hi all,

     

    Have re'd a letter from DG saying they are willing to pay the £1250 requested by me in the brill letter Lattie gave me.

     

    I was all ready to sign and return but then re'd a letter from court telling me that DG had until the 10th April to submit their AQ or they had the right to throw the case out (I think, sorry it's not clear, letter not to hand.) Mentioned something about the defendant having until 10th April to file or the claimant would have the right to file judgement..??... does this sound standard?

    What do you think I should do now? Is it likely that they won't file the AQ therefore I'd be entitled to claim the £1500 or shall I sign for the £1250?

    With the bank holidays and all the letter wouldn't reach DG until after the court deadline so I'm a bit confused about what to do next!

    Nearly there, I can almost smell the money!!! :)

    Forgot to say at the time but thanks so much for this letter.

    I sent it off to DG last week and am still awaiting a reply. IF they decide to pay up I'll have got all that I was owed plus the court costs back, i'd only be missing the interest @ 8% which I'm ok about.

     

    Hopefully I'll be able to post soon with good news that they are going to pay up!!

    Fingers crossed, hope to speak soon!! :(

    The thing is, I took the amount of interest debited and added that onto the balance eg: £4.49 Interest debited Account Balance: £-310.09

    I entered £-314.58 onto the spreadsheet.

    If this is incorrect will they know it is and drag the case out even longer or shall I stick to my guns as you say. The initial interest covering both accounts being claimed for is only about £50, it's the fact that it's got to the court and 8% interest stage that has got me worried.

     

    If you think I should persevere then I shall. Is the letter they've sent fairly standard? eg: 'As such there is no question of our client refunding interest when your account was in an overdrawn state' ??

  5. i can ask a couple of questions and you can see if you have.

    did you use vampiress advanced spreadsheet?

    did you put the interest charges on the right and the other charges on the left?

    on the right side did you put your balance at the time of the interest debit?

    did the s/s pick up all of the charge sometimes, a portion of it sometimes and if the balance you entered for that charge was a + number (as opposed to a negative balance) it would have picked up none of the interest debit?

     

    if you did all that - and didn't just plonk the whole amount of each interest debit onto the simple spreadsheet or the left side of the advanced s/s then you will have done it correctly.

     

    then you took the two totals of that page and did the s/s again on the 8% interest tab - that will have shown how much each charge has gained in interest since it was charged.

    if you did all that - then don't worry.

    they are just stalling - stick to your guns - reject it - accept as partial. don't even refer to their questions except to say you feel confident that if it goes to court a judge will see it your way.

     

    if you goofed - get back, i'll help with a settlement offer.

     

    Hi Lateralrus, Used the spreadsheet with turquoise and yellow boxes with explanation on the front page.

    Have checked my workings and entered the amounts and dates on the left hand side and on the right hand side entered the interest amount and balance at time of debit interest. Should I have entered with interest added or without?

    Will this small discrepancy affect my claims standing? I think it would only be the difference of pence I think...

  6. Afternoon all.

     

    Have recieved a letter from DG today. Am now panicking that I did the interest calculations incorrectly. Letter is long but comprises of:

    We reviewed your claim along with schedule of charegs. We are at a loss to understand why you have sought to recover charges and interest from our client and additionally @ 8% on the total charges and interest. Please confirm the legal basis of your claim in relation to recovery from our client of what would seem to be overdraft interest applied to your account.

    They have offered me £1,036.74. Dates of charges is between April 2001 & December 2004.

    My original request was for £1073.99 but has since risen (if I have done it correctly to £1445.05 (with 8% interest for court case) plus the £120 legal costs.

    The letter ends with the standard strictly confidential blurb and full & final statement.

     

    Can anyone tell me if I've gone wrong, if necessary I can forward interest spreasheets if that would help. ?!?!?! :?

    and also, latest thinking - as of yesterday - is to back way off on dg - let them have some time to get some offers out. netty will be on later and if you ask - she will tell you this too -

    the mods and site helpers feel that the previous approach may verge on harrassment and could def be counter productive. so, advice is to cease the e-mails, calls and faxes - you know they have your info - let due course (in their words) have a bit of breathing space. thanks for your help. we tried to get this out to most yesterday.

    Fair enough Lateralrus, I was only sending one a day so nothing to sinister!! So to confirm; if my date is Mon I need to get it in by Fri at the latest and as my claim was under £1500 without the MCOL fee I don't have to fork out the £100?

  8. on reflection, yeah maybe it was overkill lol!!! but there's always the leaving messages on everybody's voicemail too - that's another way, and demand that they get back to you. leave them with as many options to contact you as you can too, mobile, homephone, work phone, every email address you have - i think that about covers it..... don't stop til they get back to you. it's exhausting (probably more for them than for you) but they'll get the message eventually lol

     

    Hi Netty, I had been emailing them last week and again this week and go a reply from rachel via email saying they were currently looking into my claim and would get back to me in due course. I've replied asking when this is likely to be as my AQ is up on Monday - by the way, the date is Mon 12th March, do I have to file before that date or on it and also, if the amount I'm claiming was under £1500 but is now over as I had to pay the £120 court costs, does that mean I have to pay the extra £100 or not???

    Thanks a lot for your help, I was getting a bit confused with all of the info!

    Have filled in Draft order for Directions and printed off the statement for section G as my handwriting is awful and would never have been able to fit it all into that box.

    Looks like I'm ready to to take it all to Court next Monday. Hope it doesn't come to that.

    Will start sending a couple of emails a day from tomorrow, or do you reckon I send more???

    Hi all,

     

    I have been reading through various threads and have read that there is a new strategy and therfore template to use.

    There is a also a pros and cons part that goes with it with people discussing.

    Can someone let me know which one I should be using? The form they have submitted is the N149 and it's due on the 12th March. Have started emailing all of the guys at DG with no response so far. Will start emailing twice a day from tomorrow, am I likely to hear anything from them?

    Any advise greatly appreciated as am starting to worry a bit!
