Re your letter dated the 1st December 2006. Thank you for the list of charges that you have sent me, unfortunately you don’t appear to have sent the full information that I require under the Data Protection Act all I received was a single A4 piece of paper with charges from 01/02/2006 to 16/12/06. I remind you that you had 40 days to supply me with the full and up to date information; I will give you a further 7 days to supply me with this information before I take further action. Hi, right he got his ummmmm, not sure what you would call it! a single piece of A4 paper with the charges the account had, not for 6 years lol but for the last 12 months only ! What do we do now ? Please help. SPK

What arrangements do you need to know m8 ? I have spoken to them and they were really helpfull and also told me to get my friend to write to them so i can act on his behalf. Anything you need to know please reply or pm i will pick up before work in the morning. Thanks Martin. SPK

I have the letter to send to them tonight asking for the charges back. Is it ok to send ? need to know as im posting in the morning if its ok ? The Debt Management Comapy is Bains and Ernst. As to who set it up i will ask in the moring and report back. Thanks Martin SPK

Hi, if the debt has been sold to them is there any point in sending the letter asking for the charges back from the Nationwide ? Also if the debt has been sold to them can he still get these monies back ? Now im worried. SPK

We have sent off for the statements they say we will have them by the 12th. Once i have worked out what he is owed i then will send the ltter asking for them back ( cant wait lol) then the norm and the rest of the battle. Nationwide ! good gawd m8 a nightmare this one believe me... SPK

Further more I would like to add that the alleged debt is being challenged and is likely to be the subject of litigation between the ex account holder and the bank. Hi Al, he went into the bank to talk to them and they didnt want to know ! they said that the manager was now away for a week and that if he wanted to talk to anyone that he needed to come in a put it in writing lol what a rude bunch they are. Think we will just wait till the 12th when the statements are due then send the LBA asking fior all his money back. Clint

Martin, thanks for your reply, i will answer your questions as best i can. 1: I dont know if the account has been closed or defaulted till i get the letter back from the Debt Managment Comapny that my friend uses and sent it by mistake to them, i have rung them and they will send it asap to me. 2: The Debt Collection Agency they are using is Moorcroft. 3: You have lost me a bit on the last bit after this, sorry could you please explain a little more Clearer please..sorry having a blonde night. 4: I have worked out the charges that they owe him, can i still send this to them with a letter saying the account is in dispute ? Not sure on if he is entitled to benefits but will ask the question. Geeting his charges back will help no end. He has 3 accounts i have to sort then 8 credit cards !!!!!!!!! Gunna be a hard old slog i think but just to see the smile i got when i said i would try and help was enough. SPK

Hi ya Al, i have been to work and seen the guy today, he hasnt had the account closed they Froze it till funds went in there! which i have told him not to put any money in that account and to use the new one i have set up for him :O) The Woolwich are sending him letters asking for more money and telling him that more interest and charges will be put on the account daily until he deposits money to cover the what he "owes" them. What should he do ? ignore them ? they still have till the 12th Jan to give him his statements.... Regards SPK

Got to work today and spoke to the guy concerned he has told me that Natiowide have sent his account to a collections agency ! i asked to see the letter to see what to do next but he has sent it to the Debit Management Company that has been um "helping" him ! i rang them and they were very helpfull, but they havent recieved the letter yet.... What i need if someone would be so kind is a template letter telling Nationwide that the account is in dispute so i can get him to sign it and sent it off to Nationwide please.... The stage we are at is we have the statements and have worked out what he is owed. Also, as we have worked out the charges he is owed can we send that to Nationwide then at a later stage sort out the interest that he is owed ? Any help really is appreciated gang. Regards SPK

Hi Al, i have spoken to my friend on the fone just now, he hasnt had a letter but was told by a fone call!!! so he is coming to see me tomorrow with all he has so i can make a few calls for him. Spk

Thanks a million indeed, just to let you know we have drafted a letter for him but cant send till he is back at work on weds as i dont know the debet collecting agency they are using and also the banks address. Will post more on Weds. Thanks Al SPK

The letter he got saying the bank had handed the debit to a collections agency is this the address we send the letter saying that the account is in disrupt ? or do we send this to the address the account is held at ? Thanks all SPK

Hi gang, i have told a work mate that i will help him try and recoup his charges that he has built up since his wive passed away, but im having a few probs and could really do with a spot of help. 1: We have sent letters away and are at the stage where we have the statements infront of us and have worked it all out, but when can he ask for the interest back as well as they seem to have charged him interest then that has pushed him overdrawn then they charge him more and so on and so on. My question is how do we work it out ? There seems to be so much interest they have charged him and we would really like to help him out. Thanks in advance. All help really appreciated. Im back at work tomorrow so need info asap please guys n gals. SPK

Hi gang, i wonderd if you could help.... I have a pal at work he is 63 so no spring chicken. A cpl of years ago his wife passed away and since he has struggled big style! He has many accounts and credit card ( all in debit) every one of the accounts has very large charges on them which he has asked me to help him with. The first of which is the Woolwich, we got a nice letter back saying they will look into this and reply by the 12th Jan 2007 ok i said we will wait. Friday this last week work went to pay he wages into this account and they have closed it without notice and handed it to a debit clollecting agency ! is this legal ? if so what can he do ? Can he ring them and say that the account is in dispute and what they have done is not right ? Any help is appreciated Regards SPK

We have a cpl of questions 1: What do we do on money claim to stop the court case ? 2: How long after your settlement would you hear from the bank ? we have had nothing in 5 days and all accounts still open ! ?
