Hi all just an update, as of today still no cheque, i rang the court up who says that there has not been a defence submitted as yet, so im wondering what to do have i to leave it for a little while longer of have i to enter judgement??? Rang capital one but the department that deals with these issues do not recieve phone calls (typical) when i rang capital one they did say that the balance on my account was zero and that i had a 200.00 credit limit (god knows how i havent had the card for years) and i certainly dont want another!!! So do you reakon that i give them a bit more time or enter judgement???
  2. OH YES!!!!! Recieved a letter from Crap one today!!! It reads; Dear xxxxxxx I write in connection to the above court claim, which you have issues against capital one i have now had the ooprtunity to investigate your claim of 1517.54 blah blah it is denied that these charges are unlawful as you have claimed blah blah..... Whilst we do not accept liability for your claim i have in an effort to resolve the matter without the need of acourt hearing refunded 1517.54 to your account. This refund has cleared your balance and i have arranged to send you a cheque for 1091.24 which you should recieve within 14 working days. These refunds are made purely as a gesture of goodwill and we will now defend your claim on the basis that we have refunded the correct amount. So all i need to do now is wait for the cheque to arrive... they said to inform court to confirm settlement but until i have the cheque in my hand im not doing anything!!! Anyway thanks to all for all the help and support given.... Do i need to tell a moderator that the claims won or do i wait till ive recieved the cheque... Once recieved a donation will be on its way couldnt have done it without the help of this site and all the members!!!
  3. Just an update i have just rang court and cap 1 has not issued a defence as yet, after reading a few more threads i have noticed that you are meant to pm a moderator with the details of your claim?? Not sure how to pm?? Can anyone help with this??

I have read through quite a few threads but i have to admit im not the brightest spark and some of the terminology confuses the heck out of me like MCOL it must have took me a week to suss out what it was lol!! Anyway the claim was served on the 4th April so from my reckoning that means they have until the 2nd May to file a defence??? The thing is as well i cant check on line because i didnt issue the N1 through MCOL i did it at court due to being exempt from fees.... but hopefully the end is near!! Anyway thanks to evertone whao has respnded and answered a few of my silly questions ive really appreciated it!!

Hi all , recieved to day from county court notice of acknowledgement of service from capital one they are defending all the claim which in total comes to around 1500.00 they have until the 2nd may to file a defence... is it likely that this will proceed to court or is there a chance that they will settle??? Getting worried???

Hi all recieved my paperwork from my local court stating that my N1 form was served or deemed to be served on the 04.04.07, I did the form through my local court not through mcol as i am exempt from the court fees so how do i gain information like if the claims been acknowledged do i have to go to my local court?????
  7. I sent them a letter accepting the 440 on condition that this was only part payment and that i would be prsueing the remainder, I got the letter out of the templates library??? I gave them 7 days to respond saying if they accepted that or not but i havent had a response and the 7 days is up!!

Hi all, well im at the stage of completing my court form, in total i am owed £1180.00 of which capital one offered to refund me 440.00 in full and final settlement, i responded saying that i would accept this as part payment but i would be continuing my claim for the rest. Since then i havent heard anything back therefore do i claim for the full 1180.00 plus interest or knock off the 440.00??? Im due to put my court papers in on thursday so its quite a rush??

Does this sound ok i have just altered it a little but I dont know if i have missed out something important, they have only offered to knock the 440.00 off my account if i sign the attached statement!! Dear Sirs Thank you for your letter dated 09.03.07 received today 16.03.07 I respectfully decline your offer as Full and Final settlement and request, once again, that you return to me all charges imposed on this account, totalling £1180 I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. My letter before action dated 12.03.07 indicates that you have until 26.03.07 to respond before I commence legal action. My deadline remains the same despite this offer. If you do not accept my conditions, or you do not respond within 7 days, I wish to stress that I do not accept your offer. I trust this clarifies my position. Yours faithfully ?????????????? Do i need to put anything else in or is it ok????

Thanks, ive just looked at the rejection letters but cant decide which to send, the letter i have recieved is attached to a form which i have to sign that states ' i confirm my acceptance of capital ones offer to refund fees totalling £440.00. This action by capital one is accepted by me as closure of my complaint'! No where on the letter does it state full and final settlement??? So which letter do I send or do I have to send one???

I am currently at the stage where i have sent on the 12th March my 2nd letter (letter before action)! today i recieved a letter from cap 1 dated the 9th March offering as a good will gesture to reduce the fees charged since oct 2001 from 20.00 per charge to 12.00 per charge (i calculate that they owe me 1180.00) they are offering to refund my account by 440.00 (cheeky bleeders) what do I do about this letter? Do i respond or do I ignore it and carry on with waiting 2 weeks then issue a court claim??? Thanks??? Oh when it gets to the court claim is that when i add on the 8% interest??
