  1. If have returned my £10 S.A.R - (Subject Access Request) cheque, and simply given me a list of charges and the dates they were incurred. Apparently they do not charge for this information!! However it does not tell me what the charges are for ie. unpaid direct debit, exceeding overdraft limit etc. If I have to file a claim will I need to put what the charges are for on the claim particulars? Are IF being crafty about this in some way? Will not being specific about the charges on any claim reduce the validity of the claim in some way?
  2. Hi, thanks Dan. I will give Capital One a call regarding the statements. The persistant 'phone calls bother me though. For info I am £4.00 over my credit limit but only because they have added charges for being 1 day late with my last minimum payment. They are now asking for £114 immediately even though my usual minimum payment is only about £30. There must be a way to stop them calling - I tell them I will not give info over the 'phone and still they hassle me! Aaagh!!
  3. Can anyone tell me how to stop persistant 'phone calls from Capitol One? I get upto 12 a day - when I do answer I tell them I dont give information over the 'phone but half an hour later they ring again! Are they harrassing me because I have sent my Data Protection letter? 31 days since £10 cheque cashed and no sign of any statements by the way!

  5. I did this - this is what prompted me to post the query, I rang Derby County Court today and the Woman was adamant there was only one form! When I told her there was two on line she told me to use the N150 or N149, whichever I thought was best! I didn't want it striking out for using the wrong one.
  6. Lloyds TSB have filled the usual defence and the Court have now sent me the Allocation Questionnaire (N150). After reading the resources on the site I think this might be the wrong form as it is only for £165. Do I fill in the N150 or download and send back the N149 which seems to be the right one? Will my claim be struck out if I send the wrong form back? After getting so far this is just starting to do my head in! I can see why Lloyds push it all the way, how many people become fazed at this point and give up? Advice would be most gratefully recieved.Thank you.
  7. Hiya, I too have had exactly the same response letter. In your first post you said you felt you should prepare yourself for the worst - you need to prepare for this as I have gone through the letters procedure with Lloyds and no result. I will be issuing my claim at Court today or tomorrow. Do not look at it as 'the worst', look at it as an opportunity to get justice and get back what has been illegally taken from you. The only issue I have is that since I sent the letters to Lloyds asking for a refund of charges for a specific amount, the amount has risen due to more charges. Do I now sue for the amount I have been asking for in the letters, or the new increased amount? I cant find this query anywhere so if anyone can advise I would be grateful. AG
