  2. I have started to fill in the moneyclaim online and have come to the Particulars of the claim. I have entered my particular (should I include the sort code and account number of the account. Additionally I have ticked to say I reserve the right to claim interest and have entered the text provided (however what do I need to put for the daily rate of interest at the end. I know the APR is 8% but I do not know the daily rate.. Once submitted I will add to the threat and give a full run down of proceedings.   4. Hi can anyone please give me some more advise. I have been going through the stages with Abbey to claim back in excess of £4621 back in charges. I have not heard anything back from them despite the two warning letters. I am now wanting to place the claim with the court. I understand the easiest way is to do this online - please give me the website. Also what details should I enter in the claim form where it asks for details. Should this be the chronological order of events from the 1st communication to obtain my statements to the last letter I sent ? Many Thanks Charges claimed = £4621 Origional Letter sent 18th July
  5. Hi, I have just received a letter from Abbey following my initial request to refund the charges of £4700. It is from Marc Windsor head of complaints and basically goes onto say that "I know it is important to you that we resolve your complaint quickly, but we want to do a thorough investigation and sometimes this can take time. If we have not contacted you by then, we will write to you in four weeks to let you know what is happening." Is this a standard letter ? Should I wait these 4 weeks before I send the next letter ? What would you advise the next step to be. If I was to keep to my original schedule I would be sending the 2nd letter warning of court action on 2nd August. Thanks for your help
  6. Hello I have just received my list of transactions and charges from Abbey. I have calculated them to totak in excess of £7,500. I am proposing to send two request to them 1 for uncleared transactions £3700 and another of Unpaid DD and Unpaid Cheque Charges plus unauthoriesed charges. Is this advisable and if so should I send the excell spread sheet I used to calculate the charges. I have not included the interest to these charges as I understand that this can not be claimed until I have exhausted the 1st and 2nd request and then the court. Thanks for your help....
  7. Can someone help me I have had no response from the Abbey even though I sent a registered letter to them requesting the information going back to 2000. I have only received 13months of statements. Can someone please tell me how I report them for failure to comply. Is it possible to request the first 13months of charges which total in excess of £2500 then make another request or can I make an estimate of the charge going back 6 years based on these charges for 13 months.

I have also received a letter from Ms S Small stating that the archieved documents are not covered by the Data Protection Act - However as I had enclosed my £10 fee and sent a second letter stating I wish for a full 6 years worth of statements she has advised me that she has sent the fee to the relavent department and I will be forward the information in due course. I think that the stalling tactic is to see who will just give up the chase - I will be chasing again nearer the 40 days is up. As for the dataprotection act not covering the Microfiche, I feel that this is misleading as the Dataprotection action also covers your image on CCTV and information held on paper So I would just perservere - be patient but persisitant and if all else fails report them to the FSA (25 North Colonnade, Canary Wharf, London)
