  1. I rejected their letter and after completing the moneyclaim online and waiting to hear from Halifax, I received a letter stating that they were going to defend the claim. A few days later received a letter saying that it "was not commercially viable for them to defend the claim" and they have paid the whole amount of the £4300 plus calculated interest plus the court fee! This was paid directly into my bank account so it shows it is worth the effort and the stress .

  3. Has anyone successfully claimed repayment for credit card insurance payments? These have added £400+ to my credit card debt and have not given me any protection as far as I can see. Are these also penalty charges? Would welcome any advice.
  4. Got a response from Halifax saying that as I had accepted the partial settlement but not as a full and final settlement they were not prepared to offer me anything! Therefore went to moneyclaim and completed the form and received notice of issue dated 23rd October. Obviously they now have 14 days to respond so will keep fingers crossed! Also queried regarding insurance on credit card as had paid a total of nearly £400 over 6 years and have since found not worth the paper it is printed on as it only covers you if you are permanently employed (not a temporary or contract worker). So also going for the "mis-selling" option separately on this!
  5. Thanks for the advice. I am going to start with offering the £800 and see how they respond. Also chasing Halifax for nearly £4300 in charges over 6 years and they came back with an offer of £1797 being six months charges. Have used the letter from the site for partial settlement and am waiting to see what response I get from that too!
  6. Thanks for your quick response. I sent off the statement request letter and received my statements. Went through my statements and calculated the penalty charges and sent the refund request letter of. In the meantime received the letter from Sainsburys collection agents accepting my offer (which I never made) of £1350 and a day later receiving letter from Sainsburys bank themselves stating that "they are unable to consider any request for refund of charges to my account as they have been applied fairly in line with the Terms and Conditions of use that I signed and agreded to abide by". Amusingly for me, this letter was signed by the same "Customer Services Officer" in Sainsburys as who signed the letter from Halifax Credit Card Services which I received at the same time!
  7. I applied for a refund of charges from both Halifax and Sainsburys. Funnily enough received nearly identical letters declining my request for a refund for £600+ on each (as calculated by tediously going through 6 years of statements) signed by the same person in the Customer Services Department at both companies! The letters state that as I have "signed the Terms and Conditions of Use and agreed to abide by these terms, as a result they are unable to consider any request to refund any of the charges applied to my account". Has anyone else received similar letters and what should I do now?
  8. I have £1,800 to pay on my Sainsbury's credit card. Over £1,000 of this is penalty charges which I am trying to reclaim but Sainsbury's have rejected my claim. Meanwhile their collection agency has offered me a settlement if I agree to pay £1,350 by the end of October. Should I offer only £800?? (Balance minus my counterclaim) Where do I stand legally on this?? Looking forward to any help anybody can give me as a new entrant to the site! Regards Tamarlmb
