  1. But here lies the problem Annie, i have already taken them to court and won by default but they still paid the money into the account. i'm with BOS by the way. Do you mean i should threaten them with a warrant from the court? Thanks Jen
  2. Hi you wonderful people. Well i am pleased to say that the bank have 'without admitting liability' agreed to pay back all my bank charges. i received a letter from them with an out of court settlement, after i won by default through money claim online??!! Now the problem is they are insisting that they pay this money into my account (already in my account and was before i received their letter!!!) which is overdrawn and is on an enquiry only status, so the little bit of money that is left i can't even access!! Now correct me if i'm wrong but i understood that they had to settle by cheque when it went to court. I phoned the bank on Friday and told them i wanted this in cheque and they told me it was the bank's policy to refund the charges into the account from which they were taken. While i am chuffed to bits to have won this i still feel that this is my money and it's up to me which debt i pay off!!! HELP. Can anyone help me, i wondered if i can reject their offer and serve a warrant through the court, or is there another possible route to take.
  3. Thanks very much for your replies they are all greatly appreciated. I am reading as much as i can before i need to lock myself in the padded room!!! I get to a point though where too much info starts to get confusing, must be a blonde thing!!!
  4. Bank of Scotland v Cowbag 13 Story so far 25 Aug sent the S.A.R - (Subject Access Request) letter, received my statements on day 42. Sent letter requesting repayment of charges on 3 November for last 6 years amounting to £6118.30 before interest. Now as my branch is in England but i live in Scotland i understand i can claim in English courts, please correct me if i'm wrong now. The bank have written to me refusing payment so am about to send letter threatening court action before i plough ahead with the actual court. As i say this is very scary. All help greatly appreciated. i also understand that if i am successful the bank has to re instate my credit rating as it is at an all time low!!!!
  5. Hello there you wonderful people. I am claiming back charges from the Bank of Scotland. I sent the S.A.R - (Subject Access Request) letter on 25th August 2006, and 2 days later my computer gave up, so I was unable to look up what to do next. I have just compiled a letter of complaint dated 2 October but am actually feeling a bit lost and out my depth!! Help. Am I doing the right thing. All advice most appreciated.
