  2. Lula, I tried, I failed:p It`s great preparing for round 2 though, especially when you know the end result, it`s almost like having a crystal ball to see into the future. My six months from my SAR request is up now, so I`m going to serve another one on them next week, it will be interesting to see how they have recorded all our recent correspondance. I wonder if they`ll send me anything prior to 1994 LOL Keep up the fight, and crack open a few tinnies to celebrate:roll:
  3. enterprise_jj Good luck with your claim, and don`t forget, ask plenty of questions on here when you need help, there are plenty of people on CAG who have taken the bug%ers on and won so plenty of free advise is always available.
  4. Hi Lula, I`m pretty fantastic at the moment:D Abbey caved in this week and agreed to everything including my compensation request:o , so just waiting for a very big cheque to hit my doormat. They also agreed and have already actioned the removal of my Default Notice, so I`m pretty pleased at the moment. Just preparing for round 2 now when I go for a refund of charges back to 1994, should be interesting:D How are you doing now?

Andrew, I received 12 years worth of statements from Abbey (mixture of Microfiche andscreen print statements) when I sent my SAR last year, so they are able to go back at least to 1994 PM me if I can be of any more assistance (especially if they say they don`t hold data longer than 6 years) See my thread Armsoft Vs Shabby Round 1

Notty, Phone James Arrandale and put him in the picture (He has a mountain of Emails to get through, so chances are won`t get to yours for a while) Tell him you want a BACs payment into your account and he can set it up, also remind him that they failed to send you a copy of their bundle. If he won`t play ball (although I`m sure he will) just tell him you look forward to meeting him in court next Wednesday so you and him can discuss the lack of settlement payment and also abbeys failure to comply with the Judges order regarding the court bundle with the judge. Or, alternatively, you could just turn up at court, and not bother contacting him, the judge will order in your favour as Abbey won`t be there, and you`ll get your settlement within the timescale set by the judge (usually 14 days) Phoning James will get you your money quicker, but then you`ll miss out on the experience of going to court, so it`s up to you.   9. Robdblynd, The Martin Lewis piece was very good, but........ The OFT ruled last year that Credit Cards charges should be no more than £12.00, and yet still not one credit card company has entered court to disclose their fee structure, and they are all still paying out Full Settlements (I got mine in October from Cap1, and many more have received theirs since), so it`s quite likely that the same situation will happen when they report on the banks, as at the end of the day, if you take out court action against the bank they are still not going to enter court when they run the risk of being asked for full disclosure of their fee structure - It would be tantamount to banking suicide Good luck with your claim, you`ll get your money back in the end:)
  10. Stridey, Have you sent Abbey a list of charges you are claiming? Have you included interest in your calculations? (used the simple charges calculator on the site) Have you gone through and sent an LBA to Abbey and given them the relevent 14 days. Give a bit more information and I`ll try to assist you:)
  11. In your original thread you said that they offered you GOGW payment of £35.00, did they ever pay you the £35.00?? If they did, then fine, if not then you need to chase them for it. If they did not pay you the £35.00 don`t sign the settlement acceptance letter. Phone James Arrandale at the abbey and point out their error, I`m sure he will sort it out for you, but you will need to do the chasing. HTH
  12. Received my `Settlement` letter today from Abbey, terms as previously listed. Interestingly signed by "Abbey" I so want to meet that girl:D Copy going back today in the post, so cheque early next week

Jackie, If your claim is greater than the value of your default, and you`ve suffered financially as a result of the default (paid higher than standard rate interest on mortgage etc) then you are within your rights to claim compensation. Obviously you are claiming compensation at the descretion of the court, but if you have the proof to justify your claim, then most courts will look upon it favourably, they might not award you the full amount of your losses, but should be more inclined to award something. Abbey agreed to settle before going to court, so this is untried in my case, but what have you got to lose in trying (as long as you have the proof, please don`t embark on a claim without it) Good luck with your case:)

  17. I`d be quite happy with it on my N1, you seem to have covered all the necessary. Just need to adjust the bit about daily interest, it reads 8% pence, and should be a cash amount daily, other than that it looks fine.
  18. Don`t wait for the 7th March, give James or Inga a ring at the Abbey, point out to them that THEY have mis calculated the amount, and would they like to pay up the difference without the need to go to court next week. They will pay up:D
  19. Debs, Write to the Card issuer with a general SAR request. Use the wording "any accounts held by me during the past 6 years" rather than heading it with account details etc. I had 3 accounts with the Shabby and could not remember the details of all of them, so sent a general SAR and ended up with the information for all three accounts, so as long as you hav`nt moved house since the account closed you`ll be fine. Hope this is of help:)

When I made my SAR request last year, I got the normal "Not a relevent filing system" letter, and wrote back telling them basicaly if they don`t play ball then I`m going staight to court with them. I received a delivery by TNT Courier of one massive envelope, inside was all the documentation I`d asked for, along with my microfiche data going back as far as 20/04/1994 The paper that they are printed on has the following reference on (MISC 0337 Jul 06 F), so it`s not that they found these prints somewhere and decided to send them, they actually printed them off of their system.

He rang me in the end and they caved in totally (I don`t know how I stopped myself from laughing when I was talking to him) So thats me totally sorted now (With Abbey anyway:D ) There must be someone else out there I could go for???? Oh yes, the Shabby Round 2 (They sent me microfiche statements going back 12 years:o ) so after I`ve cashed their cheque I`ll start preparing my case. Have a good drink on Friday. The Abbey removed my Default Notice (I went online to Experien today and it`s gone, spoke to customer services at experien and they confirmed Abbey requested removal of All data relating to me) Received a phone call from the Abbey today (J.A.) and they have agreed to everything:D as follows - * Refund of Charges in full * Removal of default (already done) * Compensation in excess of £4.5k RESULT!!! Hopefully this is the start of a change of attitude by Abbey, as my court date is not till 22nd March, so early settlements could be the way they are going now, lets hope so. Thanks for the help from everyone who contributed on this, very much apreciated, and if I can be of help to anyone just Ask.
  23. Congratulations Deb. It may seem a bit like `Crossing the T`s and Dotting the i`s` but better to be safe than sorry, and as I said, if only for the experience it`s got to be worth it. Interestingly I had a bit of a result with Abbey today, they`ve removed a Default Notice against me today, and I`m not due in court till the 22nd March, so this is a Real result for me as I can now consider a Defamation claim against them:D I`m just waiting for James to call me to agree to pay me the Compensation I`m after, else I will start putting together my next claim details ready for filing against them, he`s got till the end of the day to phone (and I am not going to phone him, the balls in his court now:eek: )
  24. Absolutely fine with me. Thanks for the advice on my thread, I think I`ll get a new SAR off in the post today (although the response will not be back with me in time for my current court hearing on the 22/3) I`ll then be seeking advice on where to take it next as I`m sure they are not going to be prepared to pay-up on the compensation willingly, and I`m not sure what current thinking is by the Judges at the moment in relation to it either. Let me know if you need further help with yours.
