I submitted a claim for my first £750 of my claim and Abbey have sent me back a letter saying they will pay my claim which represents full and final settlement of my claim - question is do I reply and say I will accept this as part settlement (as I still have another £1100 to claim - which I think I will submit a summary clause this time) so that it does not stop me from claiming again??

Hi new therefore a few faux pax - I'm in the process of claiming back my own charges (Abbey) £2000 approx including interest and also for my brother from Royal Bank of Scotland £4800 approx. He was offered £1600 which is not even half which I was expecting therefore I have sent the letter before action to RBS but they are are having non of it. He is now prepared to do the small claims court thing but we are not sure of the process in Scotland (I live in Scotland) - does anyone have an idiots guide - I know there are postings but I need help right from the start to the finish of the process or if I can do this through the English small claims proceedure?? I think Abbey has a new delay tactic - I sent my letter asking for the refund giving them 14 days, they replied with their standard complaints letter saying that they are looking at it and we should have some sort of reply in 4 weeks. I'm not sure whether to ignore this and start claim proceedings to wait. Does anyone have a view??
