  1. Hello Ellielou, Judgement was issued via moneyclaim on 20th, their defence sent to me is dated 23rd. Not sure if this makes a difference? Alan.....
  2. Hello everyone:rolleyes: , a bit of guidance would be appreciated: Filed via moneyclaim against platform for ERC, they did not respond so I won by default, or so I thought! I Issued judgement by moneyclaim then just received letter from Drydens solicitors saying they are going to defend and have filed an application under CPR 13.3:? They have stated that my original agreement with them indemnified them in respect of reasonable costs so they are defending and counterclaiming against me for their costs which to date are £600. They have sent me a copy of their defence which is around 10 pages long but basically is a copy of the original mortgage agreement and backup documents with all of the clauses in respect to early settlement. Is this a ploy to scare me off or does it sound like they have a case? any ideas anyone? The claim was for £4800ish inc interest & court fee!

  4. Thanks Michael for your quick response, you are correct only one letter has been sent requesting a specific amount as in my first letter I didnt know the amount therefore I requested duplicate statements. I will try sending another LBA and see how it goes. Thanks......Alan
  5. Hi everyone, this is my first thread so please be patient with me if I get things wrong. After reading other forums I decided to take on the Nationwide to reclaim unfair charges on an account which I closed 18 months ago. I followed the correct procedure and my initial letter was quickly rejected. I then requested statements from them under the data protection act for a cost of £10, they provided this information on the deadline day and I duly sent a letter before action letter to them giving them 14 days to pay up (approx £3000) or face court action. On the 14th day they responded stating that my letter is being dealt with under their complaints procedure which is governed by the FSA and the FSA allows them 8 weeks to respond to a complaint:-x . Do I now stick to my guns and instigate court proceedings immediately or do I now have to wait upto 8 weeks for their response:?: Any help or advice on this point would be appreciated. Thanks.   6. Hi everyone, thanks to the great site and comments seen on the forums I decided to take on Nationwide for charges incurred on an account which was closed 18 months ago. I followed the recommended procedure, I didnt have my old statements so I initially asked for all of the charges back and copy statements. The bank sent their standard response ie. get lost so I applied for copy statements under the data protection act for £10, these came in due course on the deadline day. I then sent a letter before action to the nationwide that I would take court action unless the charges of approx £3000 were refunded in 14 days. On the 14th day I received a letter from Nationwide stating that all complaints are dealt with under FSA rules which gives them 8 weeks to respond and they will write to me within 8 weeks with their decision. What I need to know is do I still stick to my guns and instigate court proceedings immediately or do I now have to wait 8 weeks for their response. Any help or advice would be appreciated.
