Hi, I've used the following text from the templates area of the site to get my moneyclaim stuff ready: The Claimant has an account XXXXXX with the Defendant, opened 150191.Since 311000 the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied twice.Claimant contends the charges exceed the Defendant's losses caused by the breaches.The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999,Unfair Contract Terms Act 1977 and at Common Law.Claimant claims:Return of the amounts debited of £1346 interest under section69 of the County Courts Act 1984 at the rate of 8% a year from 311000 to 131006 of £302.58 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.29612; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court. Can anyone please help by explaining the part in red. Do i need to add anything in here? Does it all look okay? I wanna get it completely right!! :O)

Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £1346; (b) Interest per S.69 County Courts Act 1984 of 8% - £302.58continuing at 8% until judgment or settlement at a daily rate of £0.xx; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court. I'm stuck on the part in red!!! Is the calculation for this the £1346+£302.58 x 0.00022? Or, is it just the £1346 x 0.00022?? HEEEEELP!!!!

  5. Hi, I have finally received my statements after nearly 40 days of persistance. Can anyone tell me which is the best address to send my preliminary letter too? Cheers :O)
  6. Thanks Welly, i posted a new thread in the Halifax area last night. i didn't complete a dp form as i went into the bank and requested the statements. They told me i'd have them within a few days. According to Sue this may not be the case and i may have to wait for up to 21 days for them? Craig
  7. Just wandered if anyone had had difficulties when asking the Halifax to send copies of bank statements? I went to the bank last Thursday, paid the £5 admin fee and was told that the statements should be with me within a few days. I haven't received them yet! Has anyone else experienced delays?
