Great news, I sent a letter to the above DCA 7 days ago wanting to get the details of the Decree.Recieved letter today from them telling me that they have now closed the account and no further action will happen.Makes me think that they never had a decree to start with.Thanks rory32 for all your help.keep fighting these people as i have proven that these people will lie to get there money.Good luck eveyone see ya

  3. I just phoned my local sherrif court and they dont have any record of it also got a online credit report yesterday and it doesnt show up on it.Strange!!

  5. Good idea thanks.Think it would have supposedly happened it a glasgow sherrif court and i live in angus.Do you think they might have something on there database in Angus about it?

Just wondering if this has happened to anybody else. recieved letter from Buchananclark+wells telling me a decree has been granted against me on jan 2008.so i got an online credit check today to see if they were telling the truth.Credit check came out clear and there is no reference of a decee take out against me.Are these people lying to make me pay up.
  8. Just had a online credit report done and surprise surprise there is nothing about a decree in my name on it.Cant wait till i get there reply about the details of the decree from the DCA,should be interesting
  9. I was wondering if i should use one of the template letters to send to the OFT about them chasing statute barred debts?Anyone think this would be worthwhile?

Many thanks rory32.I spoke to them and they said the decree was granted Jan 2008.So my thought was to reopen decree when i get the details from them and use the statute barring of debts in Scotland in court if they dont drop the case.I was hoping after a few letters there maybe drop the case as they will relise they dont have a leg to stand on but im in for the long hall if needed.Thanks again

This was an account from radio rentals for renting TV,Video etc.I have never recieved any paper work about the court action but that may be because i have moved in the last year.I have just sent a letter asking for details about the decree as i am going to contest this.Do you think this is the right way to do things or would you do anything different? Hello everyone, Ive just recieved a letter Buchananclark+wells saying that they have been granted a Decree for a debt i had 15 years ago.Ive not reconised this debt or payed anything towards it for 15 years.Ive just sent them a letter from the templates librarys telling them im not paying because this is a statute debt. Does any one know if i need to pay this because of the decree? Do i need to recall the decree as they shouldnt have been issued it anyway due to the timescale? How to go about recalling a Decree and are there any template letters? Thanks for any help as i am worried sick!!!!!
  13. Hi I just ignored the letter and i went to my to check my bank account on the 7th day and they put the £432+interest+court charges in but no sign of the disputed £300.But i am expecting a letter today from them to tell me if im going to court or not.

Hi all, I filed the court papers and tha BOS have got till the 29th jan to respond,i am claiming for £732 +interest+court fees.I recieved a letter from bank last week offering me £432 +interest+court fees but there refusing to pay me the other £300 as they say there in dispute about this.I've checked my spreadsheet i sent to the court and everything seems fine.Has anyone had this before?I think its just an attemt for me to accept there offer,anyone got any thoughts?
