  1. Thanks for response. Can I claim that the £73 pounds arears fee on overdraft and £40 arears fee on morgage (ie total of £123 per month in fees) is lawful ?
  2. Quick question to anyone. Whilst I am in dialogue with barclays about my charges on one hand, on the other is a DCA on barclays behalf saying they are taking me to court for the overdraft balance of 1125 (which is arguably made up entirely of bank charges as my claim is for 2K), dispite me telling them that i was talking to barclays about my account, they appear to be pushing the subject. Should I, go to court and defend, telling the judge about my claim etc etc? tell barclays to call of their dogs? Any thoughts would be of great help.
  3. Hi, I need to advice/reassurance from somebody. I am currently in arrears on my morgage and have an agreement to pay extra amount over a year to clear up the shortfall. Great. HOWEVER, its one of these morgages thats linked with a current account and the amount of money went up I could borrow on overdraft facility, because the amount has been reduced due to morgage, and I am currently paying £10 amonth to bring it back in line with the current limits, I am being charged £3 pound a day in administration fees! Well, this seems a abit excessive to say the least, especially as they add interest as well. I want to challenge what cost £3 aday (£90 average a month) but am cautious as its linked with my morgage. Any thoughts would be greatly appreciatted.
  4. Update Barclay letter received this morning, the usual, don't agree...blah blah blah. offer of 1000 in my account within 7 days.
  5. Update. Having deceided to give barclays the extra few days to respond, yesterday they did..................my account has been passed to their DCA and they have added another 25 quid to my account. I guess no token offer then. LBA will be sent. I will also tell them to stop any action whilst my account is in dispute.
  6. Just to say, since I asked them to more or less confirm that it I they are after.........I haven't heard a word from them. Should I be worried?
  7. Update:- Charges £2010 Sent of Request for payment giving 14 days (time up 20th October). Have had reply from BK saying response by 1st November latest. Should I ignore and keep to my own timescale which would be LBA(?) BTW I have a 1025 overdraft with BK, so I suppose they will offset against this? Also, I have a loan with BK, I suppose they will offset the rest against that? Thus I see no readies as such!!!!!!!!!!!

Hi all, Sorry if I have missed this question being answered previously in other threads, but I have a running battle with verious DCA, westcot, morecroft etc, and dispite my letters they keep syaing pay up in 7 days or we will visit! They are very carful as to say "a representative", in bold letters. Now my understanding is a Baliff cannot visit unless a CCJ has been issued. Correct? On another point......Kays catalogue keep switch DCA's is this legal ?

  10. Hi all, Been away for a few days and have just caught up on all your comments. Having re read the letter, other than my name, address and a mention of the catalogue company there is no other reference that it is me they want. For instance:- 1. No reference to my agreement number 2. The balance they are after is higher than what I fought it was. I take it I can ask them to :- 1. confirm the agreement. 2. as for a break down of costs. This letter arrived out of the blue, as I was dealing with another company who never replied to my letters. Any thoughts.

  12. Hi, I fell into trouble with kays when I missed payments. They passed my account to a firm called NDR demanding full payment of something like £125. I wrote to them eaying I couldn't pay the full amount but would offer 25 a month and please send payment slips etc etc. I heard nothing except a month ago I got default notice from NDR. Now I have a letter (arrived yesterday) from a another firm called morrcroft debt recovery, saying letter before intended litigation, and asking for 430.68, which i guess is the full balance of kays account. I have until the 19th of this month to pay in full or they threaten the following:- 1. Warrent of execution by baliffs against goods owned. 2. Application for attachement of earning order with present employer 3. Application for charging order on property 4. Application for me to attend court for questioning. Blar blar about court costs being paid by me. Then a £12 levied against me because they have had to send this letter!! Any advice would be greatly appreciatted.
  13. wow........a lot of info here! I have only had a quick scan, but one question:- was the boyfriend on the council tax bill ? May of missed that detail. If he was, then he is liable for half the debt.
  14. Thankyou all for your comments/thoughts on this. I will ring to see what the council will do about this. My local council has been very inflexible in the past (they said word from high was to crack down on late payments). However, it really gets my goat when your up-to-date, and then the automated wheels start to churn, and nothing can be done.
  15. Hi, Can anyone give some advice. I had a letter yesterday / well demand really for full payment of council tax because of 3 payments being late. Fair enough, the payments were late, that is because council tax is paid in advance and I pay at the end of each month. Anyway, I am late, but I am also up-to-date. Can they really take me to court and demand full payment ? Dosn't really seem to be any flexibility in the scheme ? Any words of advice would be greatly appreciatted
