  1. Thank you for your reply. I really want to have nothing more to do with them, i am supposed to be claiming cash back in a few months and I can see all sorts of problems on the horizon. However, I am also concerned about opening a can of worms and regretting standing up to them. I am not really sure where to go from here, of course this is just made worse by the fact that I am practically unable to communicate with them, no phone number, no audible email address, all emails I have had from them went into my spam folder stating "unknown sender" they really dont want to be contacted. I may just write to them and send the phone back and hope for the best but its never that simple......
  2. I stupidly ordered a mobile from these jokers last week on next day delivery, took 5 days to be delivered and then when it finally came it doesnt bl**dy work!! To make matters worse on phoning customer services I get stuck going around in circles on an automated system, the recording introduces herself as Rachel, WTF give he computer a name and that makes it alright i suppose!! "Rachel" is useless tells me to send the phone back special delivery (thats me £6 out of pocket then) it will be looked at and replaced if faulty, if not faulty it will be returned along with a bill for the technicians. (oh I can see whats coming ) If there had been someone real to speak to I could have told them its the battery not holding its charge (I charged it as per the manufacturers instructions) all I need is a replacement battery! I called the sales line and guess what, you got it - a real person answered, useless but real. He told me I should speak to someone at customer services but I was one step ahead of him, I told him there was no humans at customer services!! To which he replied "oh no not on the weekend" Why is it there are always plenty of staff to sell you the s**t but no one to look after the mugs who have signed up for it. (please excuse my bad language but I am not a happy bunny!) I really cant bear the thought of having to spend the next 18 months dealing with these imbeciles if any one has any advice for getting rid of them it would be very gratefully recieved (although I dont think I can as I have opened the phone box). I should have gone with my gut instinct and gone to O2 or a high street shop (but from what I read thats not always plain sailing either) and finally.......Thanks for letting me rant Gem ps. if anyone knows of any contact details (I cant even find an email address) for dial a phone I would really appreciate it
  3. Hello, I hope everyone had a good Christmas & new year. I am affraid I have not yet been in a position to submit my court papers, but I am now ready to do so, with renewed enthusiasm, just a couple of queries first. Having completed the form back in October I was wondering whether any new issues had come to light, Is there anything I need to add? I have been reading the threads and cant see anything, but would just like some reassurance, I feel a little out of touch at the mo. I shall continue to read as many threads as possible. Do I need to send another letter before action because of the delay? I would really appreciate any assistance. Thanks
  4. N1 form now complete and ready to go Friday morning, I am actually quite proud of it, in fact its stunning, bring it on !! until the next bit when i am sure I will crumble again. Could not have done it with out all the wonderful advice on here ( would not have even contemplated it), Thanks.
  5. Thank you, points taken on board.
  6. Just checked their site.. it says: 6.4 Upon registering for your free trial, your method of payment will be authorised for up to three months of service - to verify your identity, and to protect us from theft and fraud. Some banks or payment card companies may reflect this authorisation against your available balance or credit limit. No actual charges, however, will be made against the card if you cancel prior to the end of your free trial. Not clear!
  7. No, i don't think you understand, i shall just say this once, they have removed/blocked MY RIGHT to access MY MONEY without MY AUTHORISATION/CONSENT with no communication whatsoever. I think you will find as they have blocked my money in which i have no access to, is called theft!
  8. It stinks !! I only signed up for this because it was advertised as a free trial, if they had said £15 sign up charge I would not have done. It probably would not have wound me up so much had they not taken (frozen) the last £15 in my account leaving me with nothing until Friday. What if I had not had the money in my account would they have taken it anyway making me overdrawn and facing bank charges. I do understand what has been pointed out from their terms & conditions, but it is a bit sketchy and surely it must be against some kind of trade descriptions law when the are describing it as free.
  9. Have finally got to speak with someone at LOVEFILM who completely denied taking any money, having already spoken to my bank today I knew different. Eventually, to my dismay, she admitted they had in fact frozen the money in my account, I then asked her what bl**dy right she had to do that !! To which she replied "we havent actually taken the money only frozen it" Whats the difference she has stopped me from accessing my money, to me there is no difference!! When I asked her when it will be unblocked she replied at the end of the "FREE" trial. ( I dont think so !!!) After a few words in her ear she agreed that it would be unblocked today.... However this instruction would take two days to reach my account... at which point a gave up and agreed that would be satisfactory. Does it really take the bank two days or was she just fobbing me off?
  10. Have tried several times to contact them today, no reply to email. Manged to get hold of their phone number (which is no where to be seen on their website) only to be told their computers are down and to try again in an hour.
  11. I have just recently signed up with LOVEFILM for a supposedly free trial, 2 days after registering I have had £15 taken from my bank by them. On registering it stated that there was nothing to pay for 21 days or until I had rented a certain amount of films. I am very annoyed and wondered whether there is a cooling off period after signing up as I want to cancel this and get my money back. Any advice would gratefully appreciated. Gem
  12. That`s great. I can include some charges that I had knocked off. Thanks!
  13. I have received the usually response from Lloyds so I am pushing on with the next step. N1 almost ready. I just have one question..........When I started with the prelim my charges went back to Sept 2000, can I still include these charges as they are now over 6 years old or is it essential to now only go back as far as late October 2000. Any help gratefully received. Gem
  14. I have received the standard reply from Lloyds but from the collections centre in Andover. LBA prepared today ready to go recorded delivery on Monday. Have been very busy reading loads of threads feels like my heads gonna explode, so much info but its great and very inspirational to read. Good Luck to everyone and keep up the good work!! Gem
  15. I am preparing my LBA having recieved the standard letter from Robert Udy this morning, but I am not sure which address to use. Todays letter only has a PO Box address and as I understand it you cant send recorded delivery to a PO Box. So would I be better sending to the same place as my prelim letter which was 350 Euston Road, London or taking a chance a not sending it recorded delivery? Sorry for being so thick but I want to get it right....
  16. Thanks that was quick, will give them a call Gem
  17. I sent my Prelim letter out on the 21st September asking that my £200 was returned, I have not heard anything from them and I am getting ready to send LBA, however I have just checked my cap 1 statements online and to my surprise they have credited my account with £80 calling it an Overlimit fee refund. I assume they have arrived at the figure by reducing each fee to £12. I am looking for some advice as to what to do next I will persue them for the remaining £120, LBA next, but do I change my schedule of charges and deduct the £80 paid back. I feel a bit annoyed that they havent bothered to communicate with me. Thanks Gem
  18. The fee account charge is, as I believe it for the different perks of each type of account. For years I had a Gold account, which cost me £10 a month and gave me things like AA cover and other cr*p perks that I never used, have just downgraded my account to a classic account which is free. I think they also do another type of account, maybe "select" which costs £8 a month. I dont think you can reclaim these amounts.
  19. Can anyone help me. I read somewhere yesterday that any "overdraft usage fees" should not be included. I have found several of these on my statements over the last 6 years and they are for £25 each. I assumed that they were to be included and so I did. Would be grateful of any help. Thanks
  20. Prelim letter was delivered to Lloyds today, the clock has started ticking. From what I have read here they wont pay up without a fight, which is costing them more money, but that suits me.
  21. I have the same address in Brighton, but I have managed to get hold of a great phone number for them which appears to actually get through to the guys at Brighton and not a direct line to Bangalor (dont know if I have spelt that right!!). This number has proved invaluable to me over the past couple of days. 0870 2424763
  22. Prelim letter sent recorded delivery to Lloyds today with spreadsheet attached. So as I see it my first deadline is about the 5th October at which point I will send my letter before action. I am feeling a little nervous now, but getting lots of inspiration from reading all the threads and I am sure I will be able to muddle through. The thought of eventually having just over £1000 in my back pocket is helping to keep me motivated, not to mention the great feeling I am sure comes with getting one over on Lloyds !!
  23. I had similar experiences with Lloyds, one time I went into my branch to discuss my overdraft, I had gone over the limit by about £80 of which £70 were their charges, I was advised that the only way they could help me resolve the short term cash flow problem was to move my mortgage to Lloyds. I could not believe it at no point were my mortgage payments involved in this situation at all. I am now in the process of reclaiming over £1000 of charges and have a parachute account, as soon as I have my money back I will get as far away as possible from them. Good Luck.
  24. Have received my statements from Lloyds ( amazingly before my request for them was even received by Lloyds, according to the Post Office track & trace). Anyway it seems I have just over £1000 to claim back, so here goes, will be preparing next letter tomorrow. I would be grateful for some advice on the best method of contacting Lloyds; email, recorded delivery or straigh to my branch.
  25. Sorry added this to the wrong thread. I have started one already in LLoyds section.
