  1. They didnt mention anything, I had to ask what benefit i caould claim while my appeal was under way. They said i could either claim JSA and look for work or ESA with medical evidance of being unfit for work I wasnt untill my father told me from the local CAB that the DWP should have put me on a reduced rate of IS/IB untill the appeal was concluded
  2. The DWP should have put you onto a lower rate of IS/IB, thats what i have been told this week. When the DWP stopped my benefits they put me onto ESA, which i am still on at the moment.. My advice would be to get advice from the CAB asap and also tell your doctor about this Telephone the DWP up and ask if they can reinstate ur benefit at the reduced rate or make a new claim for ESA.... You will need to send in Medical Notes again for ESA
  3. Here is my dealings with the DWP/ATOS and Appeals I failed my medical in april due to some so called dwp doctor. Anyways to cut a long story short, i have chronic depresion and anxiety and also bad psoriasis on my hands, They gave me 8 points for the mental health part of the test and my benefit was stopped without warning, 5 days after the payment date the letters came saying i was fit for work. I phoned them up and they said that if i had a problem with the decision i had to appeal, so i did. They have now put me onto ESA and i have to start all over again with my GP getting mecical notes and all the stress and anxiety i had when my GP first signed me on the sick. I waited 8 weeks for a payment from ESA, and to top that the council had stopped housing benefit and i was getting a lot of stress from this due to them wanting rent paid ect, After 8 weeks HB/CT is sorted but i have been left in arrears of 10 weeks worth of water rates and getting hastle from this now. I had a work focused interview yesterday, was very nervous but it was a in and out interview, See you in a month every month. Yesterday my appeal paperwork came through, OMG it looks like they have had some ping pong between the DWP and ATOS, then i noticed near the end the DWP had send back my report to ATOS and it had been amended to suit. 4-5 things this DWP doctor wrote on the forms was scorred out and No problems put in its place. So the DWP have not said they cannot make a decision and it is going to the Tribuneral.. This i am not looking forward to, I find it very hard to talk to people i dont know and get very nervous and shakey. Anyways thats my story, i just wish i had got someone profecional to help me with the appeal and maybe i wouldnt have needed to go to the tribuneral Skip
  4. Here is the full wording from the advert: elddis whirlwind 2 berth ideal starter caravan lightweight 750kgs , new tyres , new battery , isabella awning , 2 berth, 2 singles or 1 large double, 240v mains , 12 v lights , awia cd radio , fridge/freezer 12v/gas/240v, portapotti toilet, gas hob 2 rings + hotplate , grill, great for a cheap holiday can be viewed anytime cash on collection please must be taken away within 7 days as loss of storage space This was a private seller, It was a Buy it now / best offer type listing. I made the offer of £400 and it was accepted, I made this offer on the basis that the advert was correct and mentioned nothing about the overall condition of the caravan, I wasnt expecting a new caravan, but looking at other ebay adverts ect, most of them state that there has been some damp or sold as spare / repair due to damp. What i am trying to find out is, because i made the offer and it was accepted, this became a contract between myself and the seller?? Skip
  5. Hi there, sorry if this is in the wrong section, but im strugeling with the after sale of a caravan i got of ebay last week. First of all it was on a Buy it Now / Best offer I read the description and looked at the photos then decided it was ok to buy Now i then made an Offer of £400, £150 less than the buy it now. This offer was accepted within 1 hour of making it. Once the auction finished i sent a email saying that i would collect it at the weekend. All ok, Now i traveled down with my family "220 Miles" to pay and collect it. On inspecting the caravan "Late 80s model" it did have some signs of water ingress and a soft floor, it did not look that bad. So i paid for it. Why i hear you ask..! Well it was bought on ebay and it was a contract, so i had to pay for it regardless of its actual condition, Am i correct? Anyways today a week after i got it, i had a good look around it and started to repair it, on stripping back the inner skin of the front, the whole left front and left side of the caravan is rotten. So a little upset after spending £400 on a caravan thats not really usable i decided to ask for a refund via ebay resolution center. Well you can gather the outcome ( Still in progress ) Now what i am asking is: can the Sale of Goods act cover me against this even though i got it on ebay and traveled down and looked at it and paid cash ? To tell the truth i thought it was only a small ammount of repairs it needed bit not to the extent it has, witch i must say had been covered up and made to look like its fine? Help, I would be happy for a partial refund if a full refund is not possible. Any ideas or solutions or have i just done what i didnt want to happen Thanks Skip
  6. Hello all, Sorry my first post is such a under the weather type.. First of all i had a speeding fine from the magistrates which i had to pay back £10 a fortnight but i have a major problem forgetting things, Anyways now Philips have the debt and the first letter i got from them was wanting the full payment of £120 ( £40 more than my speeding fine) i logged onto there online account section and requested to pay it back at £10 per fortnight it said they would write to me to say weather i could or could not pay by instalments. While waiting for the letter i paid £10 off using there online payment system where it charged me 50p. So the letter came 5 days later saying that they wont accept my offer of £10 a fortnight and requested full payment of £120. Now this week a letter came by hand saying Notice of Attendance, seemingly they came to collect the full ballance but i heard the letterbox but no knock at the door. Now the outstanding ballance has gone from £110 to £210 in a matter of days. Can anyone help me with this, i cant afford to pay it all of at once because i am on income support due to a disability The longer i leave it the more they are going to charge me and keep adding extortionate ammounts to my account. I cant afford to pay it of in one, i could at a big struggle pay £30 a fortnight, but this would leave me in debt with other things, I have all ready turnt my heatng off due to my monthly bill for electric being £125 this time Help please Many thanks in advance to anyone who may help me Skip..
