  2. hi i have recently split from my husband and deceided move out and go on holiday to clear my head. i was advised to not leave the house as it is a joint tenancy , but when i went back after 2 weeks i found that he had called BT and told them that we have split up and that he wanted a new phone in his name. BT have now sent me a bill for some £450 , £160 as a final bill and the rest as cancellation charges for the phone and broadband. i did call bt to tell them that I did not cancel this contract and that he had no authourisation to do so , but all thay could tell me is that as he was a close family member and must have had the relevent account details when calling , that this was o.k and all they needed. How can this be? my name was the only one on the contract and i have not given them authority to deal with anyone else regarding my account. they did ask if i wanted to resume service , however the phone line is now a new number and he has had sky BB activated , so i am basically being asked for money for cancelling a contract that i never did and i have no way of resuming the service even if i wanted to. ANY advice would be gratefully appreciated on this. thankyou
  3. no problem maz , good luck with argos. i was totally surprised yesterday when i went down to welcome and they had all the new paperwork ready for me to resign minus the ppi , which for the first time the figures were given to me worked out at 66 a month for 48 months ! , no hard sell or nothing maybe , if anybody does visit welcome in future to purchase a new car , knowing what sort of money they make on these policies , you could use this is as a heavy bargaining chip to get the price and payments down and then cancel within 30 days, as the original monthly figure quoted was 408 , then down to 379 with some bartering whereas the ppi was then included and now 312 with ppi taken off, if they think they can make the money from the ppi , they will lower the asking price of the car and up the p/x quite substantially if you have one and then the choice is yours with the ppi. reidnet , this is just my opinion as i feel i have had quite a good result overall with welcome and apologies if this isn't quite the advise you want posted with regards to ppi so please delete if you feel that telling someone to get ppi and then cancel flies in the face of a lot of others on here who are having major problems cancelling / claiming back. thankyou
  4. for anyone who finds themselves in the same situation i managed to find out that it is 14 days or 30 if life cover is included in the ppi. had a call from welcome saying "no problem" however they want me to go down and re-sign without the ppi on the policy, so some serious hard sell heading my way, depending on what actually happens when i go down there i might need to come back for some more advice , but hope that the 14 / 30 day cooling off period might help someone else. not sure about posting links on here but can be found on fsa website.
  5. thanks for your reply. the only agreement that i have at the moment relates only to the whole finance agreemnt, with PPI included in totals with interest etc so do not know if 14 days is part of their terms and conditions, rather i assumed that you had a 14 day cooling off period as you do with any finance agreement and that as the PPI was paid via finance , that i could cancel it within 14 days.(or would i need to cancel the whole finance agreement?) im sure that he did mention something about 30 days when talking about the PPI so will more than likely receive the PPI documents around 31 days ( or am i just being cynical ). i have been reading a fair bit on here about caiming back missold ppi's but cant find anything relating to cancelling it straight away , so i suppose my main priority is finding out if their is such a standard cooling off period with insurance policies as there is with finance agreements or whether it would only apply if actually stated in any terms and conditions. thanks again
  6. hello i have brought a car from welcome finance withing the last 10 days and now looking at what the PPI is going to cost , i have had second thoughts on the insurance. As it is currently less than 14 days since the agreement was signed , is it just a straight forward case of cancelling the policy within the cooling off period ? i have unfortunately had to deal with these sort of places in the past and sort of knew what to expect from them , so from the original figure quoted of 108 per week , we bartered with the price of the car part ex and warranties , gap etc and i got the price down to 86 per week , however this was the WITH PPI. if i now cancel the PPI , (if indeed i can) can they renegotiate to whole contract and cost as , as i say the price of the (new) car came down 1k and i got the full 2200 part ex i wanted on my car instead of having to refinance 1000 still owing on my px as they originally wanted and i suppose they could say that this deal was done on the provision i took out the PPI and if i want to cancel it , the original price of the car and 1200 instead of 2200 for the part ex would then count? hope that this makes sense and that somebody can help. thankyou
  7. further to my previous post above i now realise exactly what abbey are trying to do and would be grateful if a mod could go through the below letter , a cross between LBA and rejection of offer letter. i have done this because the LBA template states that they havn't yet responded to my prelim letter , which they have , and i wasnt sure what one to send first , the rejection or the LBA and was hoping that this would cover both. if i'm wrong and a certaing set procedure HAS to be followed exactly then advice on what to do next would be appreciated. (I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £645 less 220.00 already refunded to my account. I will accept the sum of 220.00 offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. Although your letter states that you will cancel charges to the sum of 260.00 as a gesture of goodwill, during my telephone conversation with yourselves on 02/10/2006 your representative stated that 40.00 of the amount refunded were reversals of charges due in octobre and November for which I thank you, however these charges were not in my letter dated 14th august and do not form part of my request for refunds of charges or in this letter before action,leaving the amount still owing to myself as 425.00. I am enclosing a copy of the schedule of the charges which I am claiming. I have already sent you a copy of this in my original letter of the [XXDATE OF FIRST LETTERXX]) thankyou in advance for any advice on this matter
  8. thanks for your reply i have just spoken to abbey and they stated that the missing 40 is from 2 further reversals ,1 for october and 1 for november which were pending and now i'm confused so if anybody could help me with the following as abbey seem to be overlapping what im claiming for and current pending charges. at time of prelim letter for charges of 650. account 120 o/d with these charges not currently being claimed for. at time of goodwill gesture letter (today) account 150 o/d adjusted to 70 credit = 220(150 o/drwn +70 now in credit) + 40 pending / the 260 quoted am i right in thinking that the 40 pending has been taken off the original claim so that i cannot later claim it and they are doing me out of that 40 by confusing the issue and that they have only refunded 220 of the original 650. surely the 40 of pending charges is to my advantage as it was not in my original claim and that infact i have only been refunded 220 and my letter before action claim should be 430 (650 total) with another claim going in for the 150 o/d charges which have now been covered by the part refund i got today.tough luck for refunding the pending ones abbey i didnt ask you to sort of thing and its their loss? confused, i am , but it looks like if anyone is making a claim and are o/d with seperate charges , they will try and confuse the issue with claim,current/pending charges.
  9. hello after sending in a preliminary letter for a refund of 650 i today received a letter stating that as the charges do not contravene their regulations they cannot agree to refund them, however as a gesture of goodwill they are prepeared to cancel charges totalling 260. the actual account was 150 od all in charges anyway, which dont relate to the claim of 650 and was to be a separate claim , and now the account is 70 in credit so they have already refunded what works out 220 and not the 260 offered. the letter states nowhere that this is full and final settlement. obviously i will sent the rejection of offer letter , but should i stear clear of using the 70 credit the account is now in as this might constitute accepting their offer? or just use it as part payment and still pursue the outstanding 430 in the rejection letter letting them know that the 150 cancelled charges were not part of the original claim and another will be forthcoming thankyou
  10. hello have read as much as possible and have sent a prelim letter for 645.00 for one account no probs,but on another account ,after going o/d for 1.99 i have now had charges applied to this acount for some 220.00 with this months penalties. no monies have been paid to abbey for these charges so it's just an o.d balane of -220 ,do i just cut and paste relevent details of the preliminary letter to get these charges reversed as opposed to claiming back money??? on another note,barclaycard passed on my debt to credit solutions ltd and an agreement is in place to repay my debt to them for some 2500.00 for which i estimate over 800.00 is unlawful charges,can this acount be put on hold if i start proeedings against barclaycard and the new/true amount of the debt is in question?? thanks for any help on either of the above.
