  1. OK, been to Court. The Usher said that the case had been taken out, as it was settled. I explained that although a letter had been sent, no money had arrived, so he spoke to the Judge, who reinstated the case. I met the Judge about 20-minutes later who asked if I would be prepared to accept the settlement figure of £4634, which I was. He therefore agreed to adjourn the case so that if Lloyds don't pay up shortly, I can pick up where we left off and continue with the suit without further delays. Nice chap. We'll just wait a bit now. I do feel very confident that its just a matter of process now for the settlement to arrive.

  3. One (I hope) slight hitch - no money! The [problem] Letter said my settlement would be deposited into my account within five working days from 17th, but as of today (25th) nothing has arrived (seven working days). I spoke to [problem] twice today and they couldn't find my file and promised a call-back. No call-back. As the court hearing is tomorrow, they recommended I attend, which I am very happy to do. They said that Lloyds would not be represented, as they have agreed to settle. They also said that this is happening quite often at the moment, as they are handling thousands of cases and there are delays in the payment process. Doesn't make them look to smart, but they didn't seem that bothered. Any suggestions or guidance for when I appear in court?

Burnsies02-v-LloydsTSB Just received letter from Sechiari, Clark and Mitchell acting for LloydsTSB confirming settlement of £4,634 inc costs a couple of days before scheduled court hearing. Action started about 12-months ago, but well worth the wait and effort. Thanks to everyone at CAG!
  6. :D:D RESULT!!! :D:D I'm pleased to confirm a result. I received a letter today dayed 17th July from [problem] that settlement of £4,634 will be made in the next five working days (just in time for the court date). It seems that I didn't need to chase them for their court bundle after all, as our letters will have crossed. I'll write to the court as advised as soon as the cash is in the bank (my account, that is). Meanwhile, for sport, am I right in thinking that under the terms of the Data Protection Act, I can ask [problem] for copies of all records they have in relation to my case? Possibly of some interest (or as a minimum, add to their admin burden)? MANY THANKS for all who have supported me!!!!

I modified a little, as the DTI material seemed of lower significance. Not much original art I'm afraid! Dave

  9. Hi After nearly 12-months of pursuing my case, I have now got a Court date of 26th July 07. The Court has requested that both parties submit any documents that will be used in Court, and to forward copies to each other. I have taken mine to the Court and sent on priority main to Lloyds' lawyers, Sechiari, Clark and Mitchell. However, I have not received anything from the other party. Is this: - Something I should chase for? A tfurther tactic on their part to delay? An indication that they do not wish to be represented in court? Of any relevance? Any feedback or opinions welcome.   11. Please can someone give me some advice, as I'm stuck with the process. By way of background - I initiated action in August last year online - Passed to local court in October (11th) - Allocation Questionnaire sent on 22nd October - did not ask for Stay - Lloyds lawyers (Sechiari Clark and Mitchell) asked for Stay - Stay granted by Court on 20th November for 30 days The Stay says that the following steps must be taken by 14 Dec 06: "Either the claimant must notify the court that the whole of the claim has been settled; (see note below) OR the claimant or defendant must write to the court requesting an extension to the stay period, explaining the steps being taken towards settlement and identifying any mediator, expert, or other person helping with the process. The letter should confirm the agreement of all other parties (see note ii below) OR all parties must file a completed allocation questionnaire to the court. Where a settlement of some of the issues in dispute has been reached, a list of those issues should be attached to the completed questionnaire. The list must be agreed with the other parties and must indicate that it has been agreed." Lloyds has made no attempt to contact me with any offer of settlement or mediation, and I don't see the need to request an extension, given that I wrote to Lloyds several times and they refused to enter into further communication. Since I already submitted an Allocation Questionnaire in October, I don't know what else I would add, therefore I can't see that any of the above steps apply. However, I have now received a letter from the court stating that unless I comply with the order above dated 16 November , by 19th February, my case will be struck out!! I can't get anyone at the court to advise on what is expected of me. Help, please, as I don't want to lose based on some quirk in the process logic.

  13. Hi All Just posting details of my claim, plus a little question... Wrote twice in Aug, asing for my money back: - - £4,112.67 of charges and interest. - Served suit on 11th September online - Defence Entered on Last Day (11th October (not sure who does the maths on 28days!)) - Notice of Transfer of Proceedings sent same day, with Court Allocation Questionnaire My question is that Lloyds have applied additional charges totalling £170 since the original claim was submitted to the court, can I just add this, or do I need to start a separate claim?
