  1. Hi All before i update you on the wynne v rbs saga, a big thanks to FC for the links and guidance provided in the post above. Anyhow, i now have the court bundle together and first thing tomorrow i will be sending copies to the CC and defendants solicitor, ive spent approx 6 hrs reading,printing, reading, clicking, clicking back, re-reading etc.....but im sure it will be wrth it!! My big concern now is that the claim is my partners, but ive handled it from day one, (never expected it to go this far!!) and hence have slowly built up my knowledge/understanding of the relevant issues/procedures etc....whereas if it goes all the way to actually sitting down at court and presenting our case my partner hasnt had the benefit of the last 7 months research, and quite frankly she is terrified!!......so will have to work hard on preparing her and/or pray they settle before then!! Either way we will be seeing this out to the end, and im sure we will be victorious!! (my churchillian moment!!)

  3. -------------------------------------------------------------------------------- Hi all Firstly thanks for taking the time to read our post!! I am handling my partners bank charges claim against the RBS, and as the title suggests we have received a 'Notice of Allocation to the small claims track (hearing)' i.e a court date for 07th sept, prior to that all documents to which we intend to rely upon within court, need to be sent to court and the defendants solicitors by 16th July. The details Defendant: RBS Defendant Solicitor: Cobbetts Court Date: 07/09/2007 Court: St Helens county bank charges: £1466 exc interest £2146 inc interest Action so far Standard letters initially ( statement request, LBA etc.....) HMCS online Cobbetts filed acknowledgement Cobbetts filed defence Cobbetts made 'request for further information' We used template letter from CAG to decline request We provided court/cobbetts allocation questionnaire (N149), breakdown of charges, and draft order for directions. Current Status As outlined above, court in september.....but this is where the questions start!! In the last correspondance from court notifying us of the court date, no reference was made to the 'Order for directions'....so am i correct in assuming that this request was not granted, and therefore we need to take no action ourselves regards that document. What documents/evidence to support claim do we need for court. My partner is non too confident about the prospect of attending/speaking in court, is it possible for me to 'represent' her in some way on the day, or is it just going to be a case of me making sure she is extremely well prepared!! Im not expecting anyone to 'spoon feed' me with this information, as i will be thoroughly researching the above issues using the resources on this site, BUT any sound advice, guidance, links to relevant documents etc.... or messages of support will be greatly appreciated, the easier, and less stressfull i can make the whole process the better!!   5. Hi Just 'popped in' to say hello and thanks to all who have provided information, knowledge, support etc....for the site!! I started our claim against RBS a while ago, and have now reached the stage of they have entered a 'defence' and made a 'request for further information'. Following hours and hours of trawling the site, i have now completed our AQ and responded to the solicitors 'request for further information' And boy would i have been knackered without the info and resources within this site, and a little note for other 'newbies' like myself....stay focused, dont try and take shortcuts and read, read some more and read again....because everything you need is there, honest!!
