Hi Hope someone can help, after 2nd letter my agreement has come, dont want to post it on here, but can e mail it, It is from 1991 and is titled Halifax Visa Card Application, they have tampered with a credit card number on the top, which is a different credit card number to the card I had, whether it has ever been changed in this time I am unsure about. Underneath where it says Your Halifax Visa Card Application there is a piece which say credit card regulated by the consumer credit act 1974, then it has all the information completed and signed by me. Advice appreciated as I am not sure if it is valid or not?
  7. HI Hope someone can help, after letter 2 I have now received credit agreement. I am not sure if it is valid, and didnt want to post it on the web, but could e mail it out. The Agreement is singed 12 April 2008 and the signature isvalid, it is definetly not signed by Cap 1. The letter head on it is Capital One Application form, and half way down ti does say Credit Card Account agreement. Advice appreciated and next steps as to what I should do or templates. thanks

  9. sorry for such a radical title, but if anybody could advise would be so appreciated. my wifes mother died about 2 years ago of cancer, she was working class in a council flat, with little savings, and had a nat west creidt card with about £1000 on it, my wife has since on behalf of her father taken on paying the minimum amount of £80 a month and has done so for this time. Her father can ill afford to live never mind pay this bill and we have not got a clue where to go with this, our situation is we are in a DMP with Payplan and currently paying creditors by this method. Today a letter came out the blue from Nat West asking for full payment of the balance from the estate of £750 which is outstanding now, there is no estate, and I found this letter highly insensitive. Can anyone please advice where we stand legally, should we ask for a CCA etc, or just make £1 token payments???

Thanks everyone for your help Since I wrote my last post Prepared a court letter stating how LLoyds had been abusing the legal system - and CC it to Office of Fair Trading E mailed it to somebody in customer services - name from this site, copied in Chief Executive guessed the e mail, Also faxed it this morning and posted it at lunchtime just checked my account on offchance to find Full settlement I have just transferred to my current account at COOP and As soon as I can get at these funds will make a donation thanks again Mark
  11. Thanks for that But does anyone know if I need to do something for this 1 month period which is about to expire. Do I need to write to the court stating what I have done to try and settle or will they set a date for the case automatically.
  12. My stay of executiion nearly done now - November 16th In my month written to solicitor twice and faxed twice Also written to court as well to cancel the 1 month extension which go t rejected. Not heard anything from solicior at all to settle, I think it is all wrong that they waste court time. Quite funny yesterday as I got letter from LLoyds threatening me to go legal if I dont pay my £450 which is all of bank charges and in my claim. Dont they talk to each other?? Just wondered if anybody could give me advice of next steps on what to do on the 16th and whether I should write to court and if there are any standard letters or approaches I should use.
  13. I have 2 accounts with these guys both with charges I can recliam, can I merge them together or do I need to do 2 seperate claims. Any advice greatly appreciated Mark
  14. I have now got a letter from the call, something like a stay of execution, to settle out of court until November 15 Can anybody advice me what to do, I have already written to SCM should I write to the court, and what do I do after November 15
  15. I have now sent off my allocatation form and got today from LLoyds solicitors an allocation questionaire, it states wanting another 30 days to settle out of court, is this normal in line of Lloyds bank? Do i need to do anything else?
