Received Defence stating that "particulars of claim do not disclose reasonable grounds for bringing a claim against the defendant to recover the bank charges" and that "the defendant will apply to strike out the claim for summary judgement" N1 form was accompanied with a schedule of charges and interest levied on my account. Sent for statements got them within 40days - no problems! Worked out moneys owed, sent off preliminary letter requesting refund of moneys charged - 12.09.06 Got letter from public relations department - Sorry you feel this way we have handled your account correctly - therefore go ahead and take legal action, not bothered!! make sure you address legal action to registered company address. Feel a little windy - Is next step to call their bluff send "Letter before Action" 14 day notice, and then if no word to commence court proceedings?? Please advise.

Just thinking of taking Barclaycard to task. Down and out actor, maxed the card, now they are piling on the interest have not got enough money to pay interest fees which are being loaded on, cannot seem to get enough to get the balance back in limit. Can I claim refund for unfair levy, haven't got all my statements, do I send a Data Protection (SAR) letter and then take it from there like all the default charges and late payment fees. Please advise.

Well got the first step over requested my statements for the last 6 years which arrived today. Downloaded simple interest table and have logged in all account charges. Could anyone please let me know what I can claim for I have an "Advantage Gold Account" looking at the account there are items on the statement Referral Charges, account charges, account interest charges, Unpaid S/O & DD fees??????? If I can clam for all the above the bank owes me £2,448.00 I need to ensure that what I can claim is correct prior to sending 14 day notice letter requesting refund of charges.

Congratulations, I am just about to start out - I am not sure how much the bank owes over 6 year period, (from 04 to 06 owes £1532 excluding interest) have sent out Data protection letter with cheque for statements. noticed you only waited approx a week between asking for statements and sending out preliminary letter. Was that because you actually knew how much they owed you. The letter I have just sent Customer Relations " Data Controller" gives them 40 days to send statements until I get them will I be able to send out prelim letter for refund??? Or did your prelim letter not specify the amount of money you wanted refunding?? Your reply would certainly assist me get my head around the sequencing. Regards
