  1. Hi there just got a PCN from LAmbeth council in south london saying basically that i turned right when i should ahve carrried right on. There are clear photos with my car vrn ..cant remember doing it mind you but it is not an uncommon route. anyway here is what they say: Contravention cod nad description 32D failing to drive in direction shown by arrow on a blue sign (proceeding in the wrong direction) Observed by CCTV camera operator "The Council believes that a Penalty Charge is payable with respect to the associated vehicle for the following alleged traffic contravention: 32D Failing to drive in the direction shown by the arrow on a blue sign (proceeding in the wrong direction). The alleged contravention was noted by a camera operator who was observing footage from the CCTV camera taken at the time stated. This alleged contravention is supported by videotaped evidence. " can they do this?? do i have realistic grounds for appeal? cheers

  3. Thanks for your help so far .....i have received my second notice and so i will send them a ltter back to tell them to f@k off!! I would like you not to send any further as the basis for your charges is false. From your own documentation, the terms and conditions of entering the car park pertain to an acceptance of contract between yourselves and the driver of the vehicle. As I was not the driver at the time, this contract has never been accepted by me and is therefore void. Having visited your premises (on foot), I note that these terms are not clearly placed for an objective bystander to see prior to entering the premises to forewarn of such a charge, nor from a reasonable distance (given the tiny writing) to indicate that one should read it. I might respectfully remind you that any threat of fine before court action is illegal and therefore null and void under the Bill of Rights 1689. I would therefore be most grateful if you would no longer contact me on this matter. If you continue to issue me with further letters, I must advise you of the terms and conditions of writing to me, which are thus: I will accept two free letters but any third letter received; would trigger the acceptance of the fact that you agree to pay me an admin fee of £50 per letter, but the third letter would also be a free letter unless I received a fourth letter related to this matter. In which case I would have to charge for ALL three ‘reminder’ letters. An invoice will be issued requesting payment within 7 days or court action would follow on the 8th day. These terms are fair under the Unfair terms Act 1999 as this is for my time and expenses. Any fifth letter would trigger a harassment action under the 1997 Protection from Harassment Act, which I would be entitled to claim £5,000 in damages for mental anguish.
  4. thanks Brechiner - very useful ideas if not 'in-yo-face' style. I guess it gives them what they are trying to give us!! anyway finally got round to the parking lot - cause of course it was my wife who was driving and not me - I was at work (and i am registered keeper). I guess I could argue that too, that the agreement is with the driver and not me and i am not obliged to tel them who it is. anyway got a few photos. here is the link to my photos (sorry about size of files!!): http://www.doctors.net.uk/DocStore/DSView/...?folderid=42835 A few views from where the car was parked - and arrows to point out where the signs were. There was a big van obscuring the sign near the car, plus ofcourse a few delivery type around obscurring the view a little of the others. plus also has scan of the 'pcn'.

Anyone heard of UK parking control LTD? just got a fine through the post after parking in their car park (recently acquired i might add) in Upper Norwood, London - they said "..when you enter this private car park for any reason... you agreee to pay the sum of £95 (£75 if paid within 14 days)" Left me FUMING!! :mad: can they do this -are there different regulations for private firms? (who are obviously cowboys). I mean the signs didnt exactly say sign on the dotted line for a cheque please!!! (and they werent as clear as they are making out). anyway be interestd to hear from anyone who has had any similar dealings and what ur experience/advise was. cheers

Hi there has anyone considered getting this book: "UK Driving Secrets Guide 2006" ?? {link removed 26/8 on advice of site helper apparently it IS sh#te! } not plugging it at all ...but wasnt 100% convinced. I guess it would spell out what it would otherwise take a few mins/hours trawling through various websites/forums...but for £28. cheers
  7. oh i have just realised in going through my mail - I sent a letter into them AGES ago (well about 2-3months) before i even knew about this site ...claiming that the charges were bolox and give me my money back .... I think they hve just rejected the claim ...now does this count as the first letter?? :? and if so can i send the 'second' letter and also say .."oh btw i have recalcualted the amounts i think u owe me £xxx" (to include the 6 years) ??? or do i just ignore the fact that i have sent that letter and that they have replied - as there are blatant points that beg being ripped apart (but they end the letter with " you have 14 days or we will consider the matter closed , etc") sorry - now very confused!! :? cheers
  8. Actually just been reading through some more posts ...maybe i will now ask for the full statements. Also have another questions about the charges: there is a "returned d/d" - a returned direct debit - am i allowed to claim for this too?? cheers

Hey Mandyf - glad to have a companion on this journey!! yes well i have an old dormant barclays account ..for bits n bobs (aka ebay purchases + sales!!) - which hasnt really charged me so i will probably have that ready in the reserves. Now I have only JUST received my data stuff ...i was pretty miffed as it must have been beyond the 40 days ...but as it included statements right up until last week I might forgive them that. one annoying thing about Lloyds statements is that since sept 01 apparently they changed the way their statements are produced so they have only given me a list of charges. I guess this does make it MUCH easier for me. It was sort off fun remembering the sort of htings I was up to 'back in the (bachelor) dayz'!! I did, though, find it a little strange that when i queried it they assumed all i was interested in was the various charges - well it was true () but i guess they must be used to it by now. Question for forum members (the 3 viewing this that is ): should i trust them or should i ask for the "reams of statments" (that i apparently dont need)?? If so it looks quite straight forward so all i need to do is get that spreadsheet that is on this forum somewhere ...to tot up all the charges and present it in the pre-done letter. ....now all i have to do is find it... :?

Thansk Caro for wise words!! well just to feedback ...i have now received the statements ...well actualy it was a couple of weeks ago -but for free as described above. fortunately or unfortunately actually Barclays have been pretty good with me - I must say. there's only about £20-40 that i can see that i could possibly claim (and thats in 6 years!!). As am quite happy with them might just leave it there - well there's a much bigger fish in my Lloyds and i hear they're closing accounts down from people who successfully claim....so this account could come in handy. cheers
  11. Had a quick look and couldnt find one but does any one have a template of "SCHEDULE OF CHARGES" ??? ok i AM being lazy but if someone has done one it would be rather helpful. (i'm guess perhaps in a 'form' format linking to db which can be printed as report - eg as in Access, HanDbase or other DB program )

  14. Hi am just about to start my claim for the bank charges ....just thought that i could record my progress along the way via this thread. Am total newbie but am very grateful for both the site and those read/advising (me -in advance!! & of course) others. Right then first thing is first and on with the data request: Originally sent out a letter ..to Peter Townsend (seemed the safest bet in terms of getting a responce) + £10.... but then i read a thread, called 08457 555555 and asked for 6 years worth of statements. They just asked why i wanted them (i said i was auditing myself!!) They didnt mention any charges and said it owould be there in 3-5 days. lets see!!!

  16. Hi all hope u dont mind but I thought i would track my journey via this thread (i suppose a sort of blog) to track my claim for dreadfullly unfair charges!!! So am totally new to this ..read about it a couple of weeks ago on the MSE site and now sitting on my ass and getting down to bussiness!! be grateful for advice along the way!! cheers

Thanks for that - will do. first thing thou ....as many will have done - I got this link via MSE (martin) and in his advice on how to start he says: If you don’t.[know how much/what the charges are] Send the letter in the library requesting a full and comprehensive list of charges made on the account (including the date of the 'offence, the exact wording used - e.g. Unpaid Direct Debit, or Debit under advice etc... - and the amount) - the Data Protection Act disclosure request. Errr ....which library and where to exactly ??? sorry ..once i get going i promise i wont use crutches again!! ;->

A true wealth of information!! ok well i am SERIOUSLY peev'd at my bank LTB and so willing to have a go at their TOTALLY unfair charges esp over the last year. Will also try my luck with Barclays .....Egg card ...etc .... wish us luck!! omer
