  1. Your case is similar to one of mine so I'm interested in your results. Have you followed the process in SurlyBonds thread?: http://www.consumeractiongroup.co.uk/forum/legalities/24013-defaults-proposed-method-removal.html Did you do the S10/S12 notices? What was there reaction?

Following on from my original thread: http://www.consumeractiongroup.co.uk/forum/legalities/29451-default-removal-debt-not.html I've issued the letters to O2 on 12 Sept but not yet arrived as being re-directed. Sent recorded delivery. I assume the clock doesn't start running until they receive it. I'm not 100% sure how this one will turn out as the account is re-activated. I'm hoping the default will dissappear and normal monthly status will resume. Either that or another entry will appear for O2 for the rejuvinated account. I'll keep checking my credit files.

Following on from my original thread - http://www.consumeractiongroup.co.uk/forum/legalities/29451-default-removal-debt-not.html I've issued the suggested letter in removing my default for this debt which has been fully paid. This was noted as delivered on 12 Sept 2006. The letter asks for an acknowledgment within 5 days - and presumably they must comply or challenge within 21 days. Probably a daft question - what do I do if they don't acknowledge? Presumably this bit is not as important and so should just sit back and wait - at least till 21 days are up before doing anything further. It's strange but once you issue these letters - your hoping for an immediate response even though you realsitically know they'll take their time!
  4. Update: Letter delivered 14/9/06 and had an acknowledgement today - 16/9/06. Letter is from Maureen Walters, Corporate Regulatory Risk, Ground floor North, Charterhall house, City Road, Chester CH88 3AN if that helps anyone else. Fingers still crossed

  6. Update: Wow - they're fast to reply. Per Royal mail only delivered 11 September. Got my acknowledgment letter dated 12th Sept and my "offer" dated 13 Sept in the post today! My offer was £218 (6 months worth of charges). A lecture about their charges and how I should maintain my account etc. Also.. There's also a bit in there, after the goodwill offer of . A veiled threat???:o Also, included in my letter was a schedule of charges - the total of these was £1526 compared with my calc of £1168. I've spent all night checking this against the statements and it appears they have made a right mess of their schedule inclusing charges that don't appear on the statements, missing off charges that do and not takin g into account a refund I've already had a while back! They did though show I've overlooked a few charges and so I've revised my claim to £1421 only based on what I can reconcile. I don't want them accusing me of cheating! Any way. I've fired off a thanks but will accept as partial only, outlined my revised claim and asked them to check their figures. I've stuck to my original deadline of reply (26/9/06) before I fire off LBA. I wait with baited breath! I must admit, after reading all these threads I was gob smacked their reply was so quick!
  7. Checked on line today - Recorded delivery received 11 September 2006. I wonder what their reaction is when they get these - I doubt they're suprised anymore... I feel a caption competition coming on!
  8. Ok I've gone the whole hog now and issued letters to Capital Bank - as you say contract terminated although paying by an arrangement - therefore all conditions of the contract are revoked. I'll keep this thread up to date on developments:o ALso issued a notice to O2 - even though account is re-activated (although still waiting for it to get connected) I want to make sure default is removed so starting action now. I'll make a new thread for that one in due course as it develops. Wow...in just a week I feel like I've started legals on eveyone!! A feel a warm glow inside:D
  9. Hi I'm looking at this thread, considering taking action to recover my charges against Capital One. I have a list of charges etc. I'm a bit concerned though about retaliatory action. I continue to use my cards but keep them within limits - i'm using the cards correctly etc. I saw a couple of threads about defaults etc. Are Capital One closing accounts or asking for money back etc once they receive requests for refunds?
  10. Thanks for the advice. I'm very certain I did not receive a default notice from O2. I basically hit financial troubles last year, got behind with payments and made arrangements with them. Because I couldn't pay off in a 3 month period they handed over to those lovely people at Moorcroft and it took me a few more months to clear once O2 added a termination charge. My credit history continued to show the reducing balance as I paid month by month but history showed late payments which I expected. It was only at the end whilst I questioned the last amounts outstanding that the status changed to 8 (default) on Experian. I've discussed accounts with O2 today and they were quite happy to reinstate accounts (as if it was common practice) - I'm as confused as you - I'll keep an eye on the status over the coming months to see if it changes. If not I will proceed as you suggest. I must admit - I was feeling quite depressed before reading these threads as although we've had problems in the past were now on top of our finances. However, past problems seemed to me would hold me back from getting on with our lives. My main desire to clean up my record is to a) get cheaper (competitive) products to reduce my debts further and b) get a decent bank account (don't care about overdraft but do want to be treated like a proper customer) Weve been on a cardcash account for ages and feel like a second class citizen with Halifax despite not being/going overdrawn for 6 years! I think I'll give the unpaid account a try - got nothing to lose after all. Thanks for your advise in these threads - really excellent and very encouraging. Is that light at the end of the tunnel??
  11. Hi, I've been reading the threads on default removals with interest and will be taking action to clear up my records, If possible. Do you think these methods will work in connection with an account that is still being paid off? Also, I had problems with an O2 account, needed to settle the debt through a credit agency but a default appeared on my file. However the account is now re-instated (today) as the debt is paid in full. As the account is now running normally will the status revert from 8 to showing the normal monthly history - any ideas?
  12. I finally received my statements after much faffing about and follow up calls. Eventually I had two copies of statements posted! I did though get a nice letter apologising for the delay and they refunded my £5 fee for bank statements which was nice. Unfortunately the arrived just before a family holiday so I've only just sat down with highlighter in hand and excel in the other to compile my list. £1168 in total over 6 years - wow! I'm today posting my preliminary letter setting out my claim and asking them for the £1168 back. I didn't include the interest and assume if they settle now (lol) I can't claim this. I can only claim the 8% interest if I initiate court action after the next letter the LBA? So fingers crossed - sit back - and watch the fireworks. Can I say though this site rocks! The information here is fantastic. I'm also following the threads on default notices in credit files and have issued my first letter today - (I'll keep that to a seperate thread though)
  13. Ok, my request for charges has moved on and they are now promising to send statements for the last 6 years for a fee of £5. Authorised them to deduct £5 from my bank account and they advised should have them within 7 days. Interesting though that they only charge £5 to reproduce 6 years of statements! Ok, only takes an operator to push a few buttons but the paper and postage etc must moun up - appears much more reasonable than the DD penlties etc:p

Hi all, I am currently obtaining details of charges etc to calculate my claim etc. I've searched the site for answers to the following question but it keeps coming up blank - I think my browser settings (and firewall) are preventing searches etc. For every £39/£35 penalty for missed direct debits/standing orders etc - how much do I claim back - is it simply the diff between the charge and the £12 OFT figure? Not had any luck downloading sheet (firewall again) Also, We have a mortgage with the Halifax - are they likely to use this against us? I'm relishing the opportunity to make a claim - for years I have complained to them about the charges but had no joy (on most occasions no response either) Thanks
