  1. Hello I hope someone can advise on this. I had a CCJ in Spring 2007 for nearly £20K. The sneaky credit card company took me to court without ever giving me notice etc etc. When I did find out I sent a claim to the court saying I could only pay £5 a month, which the court agreed. One payment was collected in summer 2007 and nothing since! My bank account details have not changed in all that time and a direct debit was in place but the funds have never been requested. In view of non-collection for over four years can I get the debt struck off or similar? Thanks in advance for any advice.
  2. My son was clamped by this company on Sunday in Field Street, WC1. He had been recording in "The Joint" studio and has been parking opposite for many months. In seems that in the last week London Parking Control ("LPC") have erected signs and now control the parking for this space. He went out as a tow truck arrived to tow the car away. They asked for £450 to release the car later reduced to £330 comprising of £80 PCN and £250 tow truck charge. The car was already clamped and the operator was trying to put the towing equipment around the wheels whilst my son was trying to negotiate the release. I intend to contact the landowner and ask what his agreement is with LPC and suggest that they pursue a PCN policy only as clamping only causes trauma and confrontation. The parking spaces do not appear to be used on a Sunday for their 'normal' purpose. However he has clearly been excessively charged by LPC and would a forum big wig agree that a small claims policy would be the best route here to try and recover some funds? Thank you
  3. I sent your letter to Barclays and got the following reply:- "With regard to the Social Security Administration Act 1992, this legislation has regrettably been commonly misinterpreted. Where the law refers to a "charge" this is meant as "to assign an asset" rather than "to incur a fee". The true meaning of this section therefore is that benefits cannot be used as security or assigned to a third party. This does not mean we cannot charge fees in respect of the products and services we offer you as your banker." It then continues with the standard OFT and legal proceedings waffle about unfair charges. Any ideas?
  4. Thank you Welshman, thought I would not get a reply so went ahead with moneyclaim and just put before Jan 84. I will follow your thread. I have had a few replies from Barclays and they all seem rather 'cocky'. I wonder if they feel they have some grounds to turn down these claims.
  5. Barclays do not know when my account was opened and neither do I. They have just told me prior to January 1984 when electronic records began. Is that enough for the money claim?
  6. I did accept the £815 versus £905 claimed as the difference was so small. I need to pay CAG their % but HSBC have paid the money into an account I have no access to! Once I get a debit card or cheque book, you will get your slice. Many thanks.
  7. Here's a tricky one for the founders:- 1) Cap1 have sent me a letter offering to refund the difference between my claim and the £12 that the OFT have said they believe is fair. So this is about an offer for 40% 2) I had defaulted on this account and it had gone to a debt collection agency. I settled the account for a lesser amount as a 'full and final settlement' confirmed in writing by Cap1. 3) The amount that Cap1 have said they will refund will.......'be reduced from your outstanding balance and your credit file will be amended to reflect this.' So it seems they are going to pay themsleves Any ideas please?
  8. This has dragged on for a while and after receiving an offer for 30% of the claimed amount, I sent an LBA but got another offer exactly the same. I was about to complete the money form online and saw that you must have claimed contractual interest, so I have sent a new LBA with a new xl that includes contractual interest. After the requisite 14 days I will move to the money claim unless there is a surprise offer.
  9. Having received my statements I sent a letter asking for repayment of £905 in fees, I have already received an offer of £815 which I an very tempted just to accept as it is 90% of the claim. I will alter the letter to say 'partial' from 'full and final' as I have other claims against the bank to be filed. I have to say that HSBC have been very quick in the processing of all the details, so much so, that no other company has yet to even send in the copy statements! On receipt of the money from HSBC I will donate my first 5%. Many thanks for the advice on this forum.

  11. Got my letter back from Barclays today with the normal speel that others had received along with my cheque for £10 as they will be supplying free copy statements. To save reading hundres of other threads the contact at Barclays for new claimants looks to be: Peter Townsend Manager Barclay Data Protection Radbroke Hall Knutsford Cheshire WA16 9EU Will keep you posted as the claim advances.
  12. Hello All Sent my SAR last week and have already received a reply. Cap 1 were the quickest to reply, probably as my letter went directly to Miss K Blunt as advised on another thread. I will update you as we go.

    Hello All Sent my SAR last week and have recieved today the identity check letter although strangely they are asking me for a cheque for £10 even though I sent one last week. To make sure things keep moving, I will send another cheque anyway. Will keep you posted.
  14. Philip Thanks for your quick reply. My credit record is also shot to bits, so I am not too worried about the partial settlement bit. I was however ruthlessly pursued by Cap1 and their agents and would like some retribution. Letter going off today and I will start a new thread and let everyone know what happens. Although it's far too late for me, I would advise anyone never to mess up your credit record it causes so many problems. Thanks Trusty
  15. I have a very similar situation except that I had a balance of £6000 and NCO on behalf of Cap1 accepted a payment of £3000 in full & final settlement. I am sure that my charges will be less than £3000 but would you still pursue anyway? Having read through the thread I am not sure.
  16. Fellow forumites I am going to start to try and claim my charges back from Barclays. I have been banking with them since 1978 and have paid some considerable charges in the past. I have already sent them the SAR - (Subject Access Request) - (Subject Access Request) letter based on the template. I included several accounts that I have held with them during this period but did not include my credit card details on which I have defaulted. I have agreed a small monthly payment of £25 versus a debt of approx. £7000 and a complete freeze on interest charges. I know that I also paid many charges on my cc account but I do not want to jeopardise the 0% interest deal. I am more than happy if all charges reimbursed are paid towards reducing my debt with Barclays. (I will stay pay 5% to the forum organisers). I also intend to claim all the charges going back to account opening as I believe they may equate to at least 50% or more of my outstanding debt. Has anyone with a payment arrangement with Barclays tried to reclaim charges? I still have several personal accounts and two business accounts active with Barclays, so I hope they will not act abruptly to close those accounts? Thanks for any advice and I will update you when I get my reply from them.

  18. Thanks for your reply. It is not that I doubt that they will refund the charges but I assume they will then cancel the payment schedule and the zero interest deal that I have negotiated with them. The debt in total over several cards adds up to: Morgan Stanley Dean Witter £10,000 Egg £15,000 Barclaycard £7000 HSBC £8000 RBS/Mint £8000 All of them have frozen interest for the past 3 years although I must have paid a fortune in over-limit and late payment charges interst at 16% per annum on this sum is much greater than the charges. I will open a thread somewhere and try and get some discussion going on it. Thank you for your reply.
  19. Hello All What a useful site and what a shame that I cannot go back more than 6 years. I will be sending of several letters tomorrow but would you claim charges back from cc companies that have defaulted but you have agreed payment schedules with and have stopped chraging you interest? I would not want to jeopardise losing the zero interest deal as the outstanding balances are very high. (>25k). Any advice please?
