  2. Last week I go my letter through for a preliminary hearing on 6 February. I called Barclays today to ask if they want to settle. They took my number and told me they will get back to me. They also took the details of the hearing. I have not heard anything back yet. Do they normally take their time in getting back to you. Should i call again this afternoon if i haven't heard anything?

  5. I have just got a letter with a court date on 6 February for a preliminary hearing? What is that, can I ask them to settle before that hearing takes place. I have no idea what preliminary is?

  7. I am currently waiting for a court date. I sent off my allocation questionaire which was due to be with the court by 10 December. I sent it by special delivery. I have not heard anything from them yet about a court date. Is it normal to wait this long? Once i have my court date is it wise to contact Barclays and ask if they want to settle? Much appreciate any advice on this.
  8. Hi Craig I am at the same stage as you. I am sending my allocation questionaire to the court today. I received EXACTLY the same defence as you have so it seems to be the standard one. In the templates section there is a guide to filling in the allocation questionaire. Good luck! SH
  9. I issued my MCOL last Thursday. In the particulars of claim it states that i woudl send Barclays another copy of the schedule of charges. How do i go about it. Stupid question but do i send them a covering letter saying i have issued the claim and enclose a copy of the charges, which i have sent them in all my earlier correspondence with them. They know i have issued a claim as it was deemed to have been served yesterday. Is there a template for this? Or can i just send them a copy of the schedule of charges?

I went into the bear garden chat room and was adviced that i can send them the rejection letter and still issue court claim on the same day as they have not really responded to my letter. I am sending the letter today recorded delivery and will issue the claim on Wednesday. Its not as if they don't know it is comming and they have had plenty opportunities to remedy the situation.
  11. Do i have to reply to their offer letter of full and final settlement?? I kind of messed up a bit. I don't have access to a computer at home and i have been off sick for a week which is when i received their offer of £500 in full and final settlement. I am back at work now but the 14 day deadline is up tomorrow. Should i send a letter today and give them another 7 days or should i just issue the money claim tomorrow???
  12. I am getting ready to issue a court claim in relation to Barclays Bank. The problem is that i will shortly be moving from London to Scotland (in the next 3 weeks) so i do not know what to do with the claim. Should i just issue the claim here and then inform them of a change of address once i have moved?????? I don't mind travelling back to London to attend court. The 14 days are up tomorrow. They have offered me £500 as a goodwill gesture and full and final settlement but i do not want to accept that, so should i respond to that letter and give them and extra say 7 days or issue the claim tomorrow when the 14 days is up since my LBA. Pleeeeease help i don't know what to do.
  13. i really don't want to accept the £500 but i don't know how it works as i have started it all here. I am claiming by charges back from Capital 1 as well but i will start that after my move. I have to issue my money claim this week so i don't know what to do. I am moving in about 3 weeks but i doubt it will be sorted by then. Does anyone have any advice on what to do in a situation like this???? Pleeeeease!
  14. Thanks for your reply. I sent them a LBA on 6 October so they have until next week to pay up. I also think it is a shame not to hold out for another £600.00. It is peanuts to Barclays but it is a lot of money to me, and will really come in handy for my moving costs etc. So can i bring the claim in a scottish court eventhough i started all this here???? I know the system is different up there. I don't know why Barclays hold out so long cos it ends up costing them more in the long run with interest being added and all that.
  15. I have received an offer from Barclays. It seems to be the standard letter they send out and have offered me £500 in full and final settlement. This if of a claim of £1100.00. I don't want to accept it but i am moving to Scotland in the next month or so. Will i still have time to do the money claim or should i just take the £500? I really don't want to do that so what are my options???
  16. I have received a response from Barclays to my preliminary letter. It is the standard letter "sorry you are not satisfied with our services blah,blah...." and a copy of their terms and conditions. They say they will be looking into it and get back to me by 11 October 2006. Sorry, but 14 days are up this Thursday 28 September so I will be sending my LBA on that day. At least something is slowly starting to happen now. OOOOO, what if i become the first person where they actually turn up to court to defend their claim.

    Thanks for all the replies. I am still very confused to how to calculate the interest. I will phone them and check but i am sure the interest was 29% apr.When i work it out i have done the total amount (£410) and added 29% interest on it and multiplied by the 4 years but that don't seem right! I really want to get the letter off but i hve to work this out first. Would the above be right???? That works out at £475.60 in interest for the 4 years. Seems a bit much to me?? Any advice please.
  18. I sent letter off to Barclays asking for a refund of my charges last week. I have now received a response, the usual standard letter of "... sorry you are not happy with our level of service bla bla..... and a terms & conditions leaflet. They have said they will reply by 11 October 2006, however the 14 days deadline expires on 28 September so i will be sending out the LBA on that date. A couple of questions: 1. Should i respond to their letter in the meantime or just wait and send LBA on 28 September? 2. Do i have to acknowledge receipt of their recent letter in my LBA???

    What letter do I send to Capital One to ask for my charges back. The one I sent to my bank don't seem appropirate. The template for credit cards/store cards in the template library is a letter before action. Is this the first letter i should sent to Capital One? Secondly how do i calculate the interest on the charges i have incurred on my credit card?

  21. I sent the first letter to Barclays yesterday by recorded delivery. I also enclosed a schedule of charges, however when i used the spreadsheet i deleted the 8% interest column as these were not relevant at this stage. Was I right to do this or should i have left it? Please help.
  22. I have checked the letter template section but I am not sure which letter to sent to Capital One asking for payment. I belive it is the one specifically for Credit/Store cards but it says letter before action on it. Am I not meant to send them a letter asking for the charges back before i send them a letter before action. The letter template used for the bank is not appropriate to a credit card account. Can someone please help me and let me know what letter to send.:?
  23. I received my statements yesterday. I was quite surprised at how quickly i received them, not like my bank who held out until a day before the 40 days was up. Again a really stupid question but can I also claim for the charges they have put on the account for going over the credit limit as well as the late payment charges????? I'm pretty sure i can but i just want to make sure before i start.

  25. I have just telephoned Capital One to request copies of all my statements since my account was opened. I was asked why i would want all these. I did not mention anything about charges. I was told he would have to pass my request on to the relevant department and they will send me the statements within 7-10 days. Lets wait and see. I read on another thread here that Capital One dealt with this quickly. Would it have been better to request this in writing or should i just wait and see and then write to them if i do not hear anything within say 14 days????? only last month they charged me twice. One lot of charges as my payment was a few days late and then another lot because the first lot of charges took my account over the limit.
